H.F. 373 Section 1. Section 321A.3, subsection 1, Code 2017, is 1 amended to read as follows: 2 1. The department shall upon request furnish any person a 3 certified abstract of the operating record of a person subject 4 to chapter 321 , or 321J , or this chapter . The abstract shall 5 also fully designate the motor vehicles, if any, registered in 6 the name of the person. If there is no record of a conviction 7 of the person having violated any law relating to the operation 8 of a motor vehicle or of any injury or damage caused by the 9 person, the department shall so certify. A fee of five dollars 10 and fifty cents shall be paid for each abstract except for 11 abstracts requested by state, county, or city officials, court 12 officials, public transit officials, or other officials of a 13 political subdivision of the state or a nonprofit charitable 14 organization described in section 501(c)(3) of the Internal 15 Revenue Code. The department shall transfer the moneys 16 collected under this section to the treasurer of state 17 who shall credit to the general fund all moneys collected. 18 If a fee established in this section is collected by the 19 department of administrative services for a record furnished 20 through an electronic portal maintained by the department of 21 administrative services, the department of administrative 22 services shall transfer the moneys collected under this section 23 to the treasurer of state who shall credit the moneys to the 24 general fund. 25 EXPLANATION 26 The inclusion of this explanation does not constitute agreement with 27 the explanation’s substance by the members of the general assembly. 28 Under current law, moneys collected by the department 29 of administrative services (DAS) for furnishing certified 30 abstracts of drivers’ operating records through an electronic 31 portal maintained by DAS are transferred to the DOT which then 32 transfers the moneys to the treasurer of state to be deposited 33 in the general fund. This bill requires that the moneys 34 collected by DAS be transferred directly to the treasurer of 35 -1- LSB 1373HV (1) 87 ns/nh/rh 1/ 2
