1.
NEW
SECTION
.
135.37B
Body
piercing
——
minors.
1
1.
For
the
purposes
of
this
section:
2
a.
“Body
piercing”
means
a
hole,
mark,
or
scar
in
the
skin
3
of
a
person
made
through
the
act
of
penetrating
the
skin.

b.
“Minor”
means
an
unmarried
person
who
is
under
the
age
5
of
eighteen
years.

2.
A
minor
shall
not
obtain
a
body
piercing
and
a
person
7
shall
not
provide
a
body
piercing
to
a
minor,
except
in
an
ear
8
lobe,
without
receiving
prior
consent
from
the
minor’s
parent,
9
guardian,
or
legal
custodian.

3.
The
department
shall
adopt
rules
pursuant
to
chapter
17A
11
necessary
to
administer
this
section.

EXPLANATION
13
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
14
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
a
minor
from
receiving
and
a
person
from
16
providing
to
a
minor,
a
body
piercing,
except
in
an
ear
lobe,
17
without
prior
consent
from
the
minor’s
parent,
guardian,
or
18
legal
custodian.
For
purposes
of
the
bill,
“body
piercing”
19
means
a
hole,
mark,
or
scar
in
the
skin
of
a
person
made
through
20
the
act
of
penetrating
the
skin,
and
a
“minor”
is
an
unmarried
21
person
who
is
under
the
age
of
18
years.
A
person
who
knowingly
22
violates
the
bill
is
guilty
of
a
simple
misdemeanor,
which
23
results
in
a
fine
of
between
$65
and
$625,
imprisonment
of
up
24
to
30
days,
or
both.
