H.F. 328 Section 1. Section 542B.2, subsection 9, Code 2017, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . c. Notwithstanding paragraphs “a” and “b” , 3 a person shall not be construed to be engaged in the practice 4 of engineering if the person establishes or constructs a soil 5 and water conservation practice that does not require a permit 6 from the department of natural resources. For purposes of 7 this paragraph, a “soil and water conservation practice” means 8 grassed waterways, terraces, water and sediment control basins, 9 wetlands, tile and tile drainage systems, saturated buffers, 10 and bioreactors designed to treat wastewater. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill provides that the establishment or construction 15 of a soil and water conservation practice, as defined in the 16 bill, shall not be construed as the practice of engineering, as 17 that term is defined in current Code chapter 542B, relating to 18 licensure of professional engineers and land surveyors. 19 -1- LSB 1650YH (7) 87 gh/sc 1/ 1
