H.F. 26 Section 1. NEW SECTION . 274.3 Exercise of powers —— 1 construction. 2 1. The board of directors of a school district shall 3 operate, control, and supervise all public schools located 4 within its district boundaries and may exercise any broad and 5 implied power, not inconsistent with the laws of the general 6 assembly, related to the operation, control, and supervision 7 of those public schools. 8 2. Notwithstanding subsection 1, the board of directors of 9 a school district shall not have power to levy any tax unless 10 expressly authorized by the general assembly. 11 3. This chapter, chapter 257, chapter 257B, and chapters 12 275 through 301, and other statutes relating to the boards of 13 directors of school districts and to school districts shall be 14 liberally construed to effectuate the purposes of subsection 1. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill relates to the exercise of powers by the board of 19 directors of a school district. 20 The bill authorizes a school board to exercise any broad or 21 implied power, not inconsistent with the laws of the general 22 assembly, related to the operation, control, and supervision 23 of the public schools located within its district boundaries. 24 However, the authority does not encompass the power to levy 25 any tax unless expressly authorized by the general assembly. 26 Statutes relating to school boards and school districts shall 27 be liberally construed to effectuate the authority granted 28 under the bill. 29 -1- LSB 1444YH (2) 87 kh/rj/jh 1/ 1
