H.F. 2497 paragraph shall be used to support demonstration projects in 1 subwatersheds as designated by the department that are part 2 of high-priority watersheds identified by the water resources 3 coordinating council. 4 (b) The moneys appropriated in this lettered paragraph 5 shall be used to support demonstration projects in watersheds 6 generally, including regional watersheds, as designated by the 7 division and high-priority watersheds identified by the water 8 resources coordinating council. 9 (3) In supporting projects in watersheds and subwatersheds 10 as provided in subparagraph (2), subparagraph divisions (a) and 11 (b), all of the following shall apply: 12 (a) The demonstration projects shall utilize water quality 13 practices as described in the latest revision of the document 14 entitled “Iowa Nutrient Reduction Strategy” initially presented 15 in November 2012 by the department of agriculture and land 16 stewardship, the department of natural resources, and Iowa 17 state university of science and technology. 18 (b) The division shall implement demonstration projects 19 as provided in subparagraph division (a) by providing 20 for participation by persons who hold a legal interest in 21 agricultural land used in farming. To every extent practical, 22 the division shall provide for collaborative participation by 23 such persons who hold a legal interest in agricultural land 24 located within the same subwatershed. 25 (c) The division shall implement demonstration projects on 26 a cost-share basis as determined by the division. Except for 27 edge-of-field practices, the state’s share of the amount shall 28 not exceed 50 percent of the estimated cost of establishing the 29 practice as determined by the division or 50 percent of the 30 actual cost of establishing the practice, whichever is less. 31 (d) The demonstration projects shall be used to educate 32 other persons about the feasibility and value of establishing 33 similar water quality practices. The division shall promote 34 field day events for purposes of allowing interested persons to 35 -2- LSB 5035HV (2) 87 ec/tm 2/ 22
H.F. 2497 establish water quality practices on their agricultural land. 1 (e) The division shall conduct water quality evaluations 2 within supported subwatersheds. Within a reasonable period 3 after accumulating information from such evaluations, the 4 division shall create an aggregated database of water quality 5 practices. Any information identifying a person holding a 6 legal interest in agricultural land or specific agricultural 7 land shall be a confidential record. 8 (4) The moneys appropriated in this lettered paragraph 9 shall be used to support education and outreach in a manner 10 that encourages persons who hold a legal interest in 11 agricultural land used for farming to implement water quality 12 practices, including the establishment of such practices in 13 watersheds generally, and not limited to subwatersheds or 14 high-priority watersheds. 15 (5) The moneys appropriated in this lettered paragraph 16 may be used to contract with persons to coordinate the 17 implementation of efforts provided in this paragraph. 18 (6) The moneys appropriated in this lettered paragraph 19 may be used by the department to support urban soil and water 20 conservation efforts, which may include but are not limited 21 to management practices related to bioretention, landscaping, 22 the use of permeable or pervious pavement, and soil quality 23 restoration. The moneys shall be allocated on a cost-share 24 basis as provided in chapter 161A. 25 (7) Notwithstanding any other provision of law to the 26 contrary, the department may use moneys appropriated in 27 this lettered paragraph to carry out the provisions of this 28 paragraph on a cost-share basis in combination with other 29 moneys available to the department from a state or federal 30 source. 31 (8) Not more than 10 percent of the moneys appropriated in 32 this lettered paragraph may be used for costs of administration 33 and implementation of the water quality initiative administered 34 by the soil conservation division. 35 -3- LSB 5035HV (2) 87 ec/tm 3/ 22

H.F. 2497 renovation of the dome of the Iowa state capitol. 1 Of the moneys appropriated in this subsection, the 2 department shall be authorized to expend such amount as is 3 necessary for the costs of installing outdoor lighting at the 4 Iowa state capitol. 5 From any moneys appropriated in this subsection and 6 remaining upon completion of the repair and renovation of the 7 dome of the Iowa state capitol, the department shall expend 8 such amount as is necessary for maintenance projects for 9 the Iowa state capitol and the Ola Babcock Miller building. 10 However, any unencumbered or unobligated moneys made from an 11 appropriation in this subsection and remaining at the close of 12 the fiscal year beginning July 1, 2017, shall be deposited in 13 the state capitol maintenance fund created in section 2.12B. 14 Sec. 12. 2017 Iowa Acts, chapter 173, is amended by adding 15 the following new section: 16 NEW SECTION . 4A. EFFECTIVE DATE. This division of this Act, being 27 deemed of immediate importance, takes effect upon enactment. 28 DIVISION IV 29 MISCELLANEOUS PROVISIONS 30 Sec. 14. Section 8.57C, subsection 3, paragraph a, 31 subparagraph (2), Code 2018, is amended to read as follows: 32 (2) The fiscal year beginning July 1, 2018 2019 , and for 33 each subsequent fiscal year thereafter. 34 Sec. 15. There is appropriated from the rebuild 2 Iowa infrastructure fund for the fiscal year beginning July 1, 3 2018, and ending June 30, 2019, the sum of fourteen million 4 four hundred thousand dollars to the technology reinvestment 5 fund, notwithstanding section 8.57, subsection 5, paragraph 6 “c” . 7 DIVISION V 8 MAINTENANCE FUNDS 9 Sec. 16. NEW SECTION . 2.12B State capitol maintenance fund 10 —— appropriation. 11 1. A state capitol maintenance fund is created in the state 12 treasury under the control of the legislative council. The 13 fund shall consist of all moneys appropriated to the fund. 14 2. There is appropriated from the rebuild Iowa 15 infrastructure fund for deposit in the state capitol 16 maintenance fund, for the fiscal year beginning July 1, 2018, 17 and for each fiscal year thereafter, the sum of five hundred 18 thousand dollars. 19 3. Moneys in the state capitol maintenance fund shall be 20 expended upon approval of the legislative council and used for 21 maintenance projects for the Iowa state capitol and the Ola 22 Babcock Miller building. 23 4. Notwithstanding section 12C.7, subsection 2, interest or 24 earnings on moneys deposited in the state capitol maintenance 25 fund shall be credited to the state capitol maintenance fund. 26 Notwithstanding section 8.33, moneys credited to the state 27 capitol maintenance fund shall not revert at the close of a 28 fiscal year. 29 Sec. 17. NEW SECTION . 8A.331 Routine maintenance fund —— 30 appropriation. 31 1. A routine maintenance fund is created in the state 32 treasury under the control of the department. The fund shall 33 consist of all moneys appropriated to the fund. 34 2. There is appropriated from the rebuild Iowa 35 -18- LSB 5035HV (2) 87 ec/tm 18/ 22
H.F. 2497 infrastructure fund to the department for deposit in the 1 routine maintenance fund, for the fiscal year beginning July 2 1, 2018, and for each fiscal year thereafter, the sum of two 3 million dollars. 4 3. Moneys in the routine maintenance fund are appropriated 5 to the department for purposes of routine maintenance 6 projects for physical properties under the control of the 7 department. For purposes of this section, routine maintenance 8 includes regular upkeep of physical properties and recurring, 9 preventive, and ongoing maintenance necessary to delay or 10 prevent the failure of physical properties. 11 4. Notwithstanding section 12C.7, subsection 2, interest 12 or earnings on moneys deposited in the routine maintenance 13 fund shall be credited to the routine maintenance fund. 14 Notwithstanding section 8.33, moneys credited to the routine 15 maintenance fund shall not revert at the close of a fiscal 16 year. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill relates to and makes appropriations to state 21 departments and agencies from the rebuild Iowa infrastructure 22 fund and the technology reinvestment fund, and provides for 23 related matters. The bill is organized by divisions. 24 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 25 division appropriates project funding for FY 2018-2019 from 26 the rebuild Iowa infrastructure fund for projects for the 27 departments of agriculture and land stewardship, cultural 28 affairs, human services, natural resources, public defense, 29 public safety, and transportation, and for the office of the 30 chief information officer, economic development authority, 31 law enforcement academy, treasurer of state, and the judicial 32 branch. The division also appropriates project funding from 33 the rebuild Iowa infrastructure fund for multiple fiscal years 34 to the department of administrative services and the board of 35 -19- LSB 5035HV (2) 87 ec/tm 19/ 22
H.F. 2497 regents. 1 DIVISION II —— TECHNOLOGY REINVESTMENT FUND. This division 2 appropriates project funding for FY 2018-2019 from the 3 technology reinvestment fund for the departments of education, 4 human rights, management, public health, homeland security and 5 emergency management, public safety, and natural resources, 6 and for the office of the chief information officer, the 7 state public defender, judicial branch, and board of parole. 8 This division also appropriates project funding for multiple 9 fiscal years beginning in FY 2018-2019 from the technology 10 reinvestment fund to the department of human services and the 11 secretary of state. 12 DIVISION III —— CHANGES TO PRIOR APPROPRIATIONS. This 13 division makes a change to the reversion provision for 14 moneys appropriated to the department of education from the 15 technology reinvestment fund in FY 2012-2013. The division 16 makes a change to moneys appropriated from the rebuild Iowa 17 infrastructure fund to the board of regents for a project at 18 the state university of Iowa and for projects at the Iowa 19 state university of science and technology, and the state 20 fair authority to authorize reimbursement of infrastructure 21 costs incurred in the prior fiscal year. The division also 22 changes project funding for a project at the Iowa state 23 university of science and technology. The division also makes 24 a change to the reversion provision applicable to moneys 25 appropriated from the rebuild Iowa infrastructure fund to the 26 department of natural resources for FY 2014-2015, and adds a 27 reversion provision to moneys appropriated from the technology 28 reinvestment fund in the 2017 Iowa Acts. The division also 29 provides that any moneys remaining from an appropriation for 30 the repair of the dome of the Iowa state capitol at the close of 31 the fiscal year beginning July 1, 2017, shall be deposited in 32 the state capitol maintenance fund created in the bill. 33 This division takes effect upon enactment. 34 DIVISION IV —— MISCELLANEOUS PROVISIONS. H.F. 2497 8.57C, concerning the technology reinvestment fund, is amended 1 to provide that the appropriation to the fund from the general 2 fund for fiscal years beginning on or after July 1, 2018, is 3 changed to fiscal years beginning on or after July 1, 2019, and 4 to provide for an appropriation to the fund from the rebuild 5 Iowa infrastructure fund for the fiscal year beginning July 1, 6 2018, of $14.4 million. 7 DIVISION V —— MAINTENANCE FUNDS. This division creates two 8 new maintenance funds. 9 New Code section 2.12B creates a state capitol maintenance 10 fund in the state treasury under the control of the legislative 11 council. The new Code section provides an annual standing 12 appropriation of $500,000 from the rebuild Iowa infrastructure 13 fund for deposit in the new fund beginning in FY 2018-2019. 14 Moneys in the state capitol maintenance fund shall be 15 expended upon approval of the legislative council and used for 16 maintenance projects at the Iowa state capitol and the Ola 17 Babcock Miller building. The bill provides that interest or 18 earnings on moneys deposited in the fund shall be credited to 19 the fund and moneys credited to the fund shall not revert at 20 the close of a fiscal year. 21 New Code section 8A.331 creates a routine maintenance fund 22 in the state treasury under the control of the department of 23 administrative services. The new Code section provides an 24 annual standing appropriation of $2 million from the rebuild 25 Iowa infrastructure fund for deposit in the new fund beginning 26 in FY 2018-2019.
