The moneys appropriated in subsection 1 shall be used for 4 the public purpose of providing a grant to a national nonprofit 5 organization with over 80 years of experience in assisting 6 children and adults with disabilities and special needs. The 7 moneys shall be used to support a nationally recognized program 8 that began in 1986 and has been replicated in at least 30 other 9 states, but which is not available through any other entity 10 in this state, and that provides assistance to farmers with 11 disabilities in all 99 counties to allow the farmers to remain 12 in their own homes and be gainfully engaged in farming through 13 provision of agricultural worksite and home modification 14 consultations, peer support services, services to families, 15 information and referral, and equipment loan services. 16 3. Notwithstanding section 8.33 , moneys appropriated in 17 this section that remain unencumbered or unobligated at the 18 close of the fiscal year shall not revert but shall remain 19 available for expenditure for the purposes designated until the 20 close of the succeeding fiscal year. 21 Sec. 8. 2017 Iowa Acts, chapter 168, is amended by adding 22 the following new section: 23 NEW SECTION . The moneys appropriated in subsection 1 shall be 17 used to support projects in subwatersheds as designated by the 18 division that are part of high-priority watersheds identified 19 by the water resources coordinating council established 20 pursuant to section 466B.3 . 21 b. The moneys appropriated in subsection 1 shall be used to 22 support projects in watersheds generally, including regional 23 watersheds, as designated by the division and high-priority 24 watersheds identified by the water resources coordinating 25 council established pursuant to section 466B.3 . 26 3. In supporting projects in subwatersheds and watersheds 27 as provided in subsection 2, all of the following shall apply: 28 a. The demonstration projects shall utilize water quality 29 practices as described in the latest revision of the document 30 entitled “Iowa Nutrient Reduction Strategy” initially presented 31 in November 2012 by the department of agriculture and land 32 stewardship, the department of natural resources, and Iowa 33 state university of science and technology Iowa nutrient 34 reduction strategy as defined in section 455B.171, as amended 35 -6- LSB 5028HV (2) 87 da/rn 6/ 28
H.F. 2491 by 2018 Iowa Acts, Senate File 512, section 18 . 1 b. The division shall implement demonstration projects as 2 provided in paragraph “a” by providing for participation by 3 persons who hold a legal interest in agricultural land used in 4 farming. To every extent practical, the division shall provide 5 for collaborative participation by such persons who hold a 6 legal interest in agricultural land located within the same 7 subwatershed. 8 c. The division shall implement a demonstration project on 9 a cost-share basis as determined by the division. However, 10 except for edge-of-field practices, the state’s share of the 11 amount shall not exceed 50 percent of the estimated cost of 12 establishing the practice as determined by the division or 13 50 percent of the actual cost of establishing the practice, 14 whichever is less. 15 d. The demonstration projects shall be used to educate other 16 persons about the feasibility and value of establishing similar 17 water quality practices. The division shall promote field day 18 events for purposes of allowing interested persons to establish 19 water quality practices on their agricultural land. 20 e. The division shall conduct water quality evaluations 21 within supported subwatersheds. Within a reasonable period 22 after accumulating information from such evaluations, the 23 division shall create an aggregated database of water quality 24 practices. Any information identifying a person holding a 25 legal interest in agricultural land or specific agricultural 26 land shall be a confidential record under section 22.7 . 27 4. The moneys appropriated in subsection 1 shall be used 28 to support education and outreach in a manner that encourages 29 persons who hold a legal interest in agricultural land used for 30 farming to implement water quality practices, including the 31 establishment of such practices in watersheds generally, and 32 not limited to subwatersheds or high-priority watersheds. 33 5. The moneys appropriated in subsection 1 may be used 34 to contract with persons to coordinate the implementation of 35 -7- LSB 5028HV (2) 87 da/rn 7/ 28
H.F. 2491 efforts provided in this section. 1 6. The moneys appropriated in subsection 1 may be used by 2 the department to support urban soil and water conservation 3 efforts, which may include but are not limited to management 4 practices related to bioretention, landscaping, the use of 5 permeable or pervious pavement, and soil quality restoration. 6 The moneys shall be allocated on a cost-share basis as provided 7 in chapter 161A . 8 7. Notwithstanding any other provision of law to the 9 contrary, the department may use moneys appropriated in 10 subsection 1 to carry out the provisions of this section on a 11 cost-share basis in combination with other moneys available to 12 the department from a state or federal source. 13 8. Not more than 10 percent of the moneys appropriated in 14 this section may be used to pay for the costs of administering 15 and implementing the water quality initiative by the 16 department’s division of soil conservation and water quality as 17 provided in section 466B.42 and this section. 18 DIVISION III 19 DEPARTMENT OF NATURAL RESOURCES 20 GENERAL APPROPRIATIONS 21 GENERAL FUND AND MAJOR FUNDS 22 Sec. 10. 2017 Iowa Acts, chapter 168, section 44, is amended 23 to read as follows: 24 SEC. 44. H.F. 2491 in November 2012 by the department of agriculture and land 1 stewardship, the department of natural resources, and Iowa 2 state university of science and technology Iowa nutrient 3 reduction strategy as defined in section 455B.171, as amended 4 by 2018 Iowa Acts, Senate File 512, section 18 . 5 b. The division shall implement demonstration projects as 6 provided in paragraph “a” by providing for participation by 7 persons who hold a legal interest in agricultural land used in 8 farming. To every extent practical, the division shall provide 9 for collaborative participation by such persons who hold a 10 legal interest in agricultural land located within the same 11 subwatershed. 12 c. The division shall implement a demonstration project on 13 a cost-share basis as determined by the division. However, 14 except for edge-of-field practices, the state’s share of the 15 amount shall not exceed 50 percent of the estimated cost of 16 establishing the practice as determined by the division or 17 50 percent of the actual cost of establishing the practice, 18 whichever is less. 19 d. The demonstration projects shall be used to educate other 20 persons about the feasibility and value of establishing similar 21 water quality practices. The division shall promote field day 22 events for purposes of allowing interested persons to establish 23 water quality practices on their agricultural land. 24 e. The division shall conduct water quality evaluations 25 within supported subwatersheds. Within a reasonable period 26 after accumulating information from such evaluations, the 27 division shall create an aggregated database of water quality 28 practices. Any information identifying a person holding a 29 legal interest in agricultural land or specific agricultural 30 land shall be a confidential record under section 22.7 . 31 4. The moneys appropriated in subsection 1 shall be used 32 to support education and outreach in a manner that encourages 33 persons who hold a legal interest in agricultural land used for 34 farming to implement water quality practices, including the 35 -21- LSB 5028HV (2) 87 da/rn 21/ 28
H.F. 2491 establishment of such practices in watersheds generally, and 1 not limited to subwatersheds or high-priority watersheds. 2 5. The moneys appropriated in subsection 1 may be used 3 to contract with persons to coordinate the implementation of 4 efforts provided in this section. 5 6. The moneys appropriated in subsection 1 may be used by 6 the department to support urban soil and water conservation 7 efforts, which may include but are not limited to management 8 practices related to bioretention, landscaping, the use of 9 permeable or pervious pavement, and soil quality restoration. 10 The moneys shall be allocated on a cost-share basis as provided 11 in chapter 161A . 12 7. Notwithstanding any other provision of law to the 13 contrary, the department may use moneys appropriated in 14 subsection 1 to carry out the provisions of this section on a 15 cost-share basis in combination with other moneys available to 16 the department from a state or federal source. 17 8. Not more than 10 percent of the moneys appropriated in 18 this section may be used to pay for the costs of administering 19 and implementing the water quality initiative by the 20 department’s division of soil conservation and water quality as 21 provided in section 466B.42 and this section. 22 DIVISION VII 23 IOWA RESOURCES ENHANCEMENT AND PROTECTION (REAP) FUND 24 SPECIAL PROVISIONS 25 Sec. 22. 2017 Iowa Acts, chapter 168, is amended by adding 26 the following new section: 27 NEW SECTION . Notwithstanding section 22 455A.19, subsection 1, paragraph “a”, subparagraph (1), of 23 the moneys allocated to the open spaces account of the Iowa 24 resources enhancement and protection fund, up to $1,000,000 may 25 be used by the department of natural resources for state park 26 maintenance and repair for the fiscal year beginning July 1, 27 2018, and ending on June 30, 2019. 28 DIVISION VIII 29 IOWA CODE CHANGES 30 Sec. 25. NEW SECTION . 455B.262B Cooperation with the state 31 geologist. 32 The department may request and receive assistance from the 33 state geologist pursuant to section 456.14 to allow for the 34 allocation and use of water resources, and the preclusion of 35 -23- LSB 5028HV (2) 87 da/rn 23/ 28
H.F. 2491 conflicts among users of water resources, as provided in this 1 part. 2 Sec. 26. NEW SECTION . 456.14 Water resource management. 3 1. The state geologist shall maintain historical data, 4 collect existing data, and compile new data regarding water 5 resources, including surface water sources and groundwater 6 sources, and geological formations that impact upon those water 7 resources. Such data shall be managed in a manner that allows 8 it to be made available for use by the department of natural 9 resources and the public. 10 2. The state geologist shall measure, assess, and evaluate 11 groundwater sources and subsurface geological formations in 12 a manner that assists the department of natural resources in 13 optimizing allocations and uses of groundwater sources in 14 this state, including as provided in chapter 455B, division 15 III, part 4. The state geologist may use data described in 16 subsection 1 to measure, assess, and evaluate all of the 17 following: 18 a. The sustainability and existing or potential 19 vulnerabilities of groundwater sources. 20 b. The risk, prediction, or indication of drought, the 21 impacts of drought, and the presence, intensity, or duration 22 of drought conditions. 23 c. Subsurface geologic hazards to groundwater resources. 24 d. The recharge of groundwater sources, including recharge 25 rates. 26 e. The presence of reserves of groundwater sources. 27 f. The potential of groundwater sources present in 28 subsurface geologic formations. 29 3. The state geologist shall develop and use management 30 tools, computer programming, or modeling as necessary or 31 convenient to administer this section. 32 4. The state geologist shall prepare, use, and make 33 available maps or other methods of presentation that provide 34 for the geospatial visualization of data described in 35 -24- LSB 5028HV (2) 87 da/rn 24/ 28

Upon request by the department of natural resources, the 3 state geologist shall assist the department in regulating water 4 quantity from water resources as provided in section 455B.262B. 5 EXPLANATION 6 The inclusion of this explanation does not constitute agreement with 7 the explanation’s substance by the members of the general assembly. 8 GENERAL. This bill relates to agriculture and natural 9 resources by making appropriations for the fiscal year 10 beginning July 1, 2018, and ending June 30, 2019, to support 11 related entities, including the department of agriculture and 12 land stewardship (DALS), the department of natural resources 13 (DNR), Iowa state university of science and technology (ISU), 14 and the state university of Iowa (UI). 15 The bill primarily appropriates moneys to DALS and DNR. 16 The appropriations are made to support those departments 17 for administration, regulation, and enforcement of certain 18 programs. The bill requires the departments to submit 19 quarterly reports to the general assembly and department of 20 management regarding the expenditure of appropriated moneys. 21 The bill also provides moneys to support specific programs 22 or projects administered by those departments. The bill 23 appropriates moneys from a number of sources, including the 24 general fund of the state (general fund), including a number 25 of major funds, including the state fish and game protection 26 fund (Code section 456A.17), the groundwater protection fund 27 (Code section 455E.11), and the environment first fund (EFF) 28 (Code section 8.57A). The bill also appropriates moneys from 29 a number of other sources, including unclaimed pari-mutuel 30 wagering winnings (Code section 99D.13), the renewable fuel 31 infrastructure fund (Code section 159A.16), the special 32 snowmobile fund (Code section 321G.7), and the unassigned 33 revenue fund (uncodified). For DALS, the bill 1 appropriates moneys from the general fund in order to support 2 its administrative divisions, including consumer protection 3 and industry services, soil conservation, and food safety and 4 animal health. Moneys are transferred to ISU to support its 5 midwest grape and wine institute. 6 DALS —— MISCELLANEOUS SOURCES —— DESIGNATED APPROPRIATIONS. 7 The bill appropriates moneys to DALS from several sources in 8 order to support a number of designated purposes, including 9 moneys derived from unclaimed winnings from horse and 10 dog races, for administration and enforcement of racing 11 regulations; and moneys credited to the renewable fuel 12 infrastructure fund for purposes of motor fuel inspection and 13 auditing biofuel processing and production. 14 DALS —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill 15 makes special appropriations from the general fund to DALS in 16 order to support specific purposes including milk inspection, 17 the local food and farm program, an agricultural education 18 organization, and assistance to farmers with disabilities. The 19 bill also appropriates moneys to DALS for deposit in the animal 20 disease preparedness and response fund (Code section 163.3B). 21 DALS —— GENERAL FUND APPROPRIATIONS —— WATER QUALITY 22 INITIATIVE (WQI). The bill appropriates moneys from the 23 general fund to DALS for deposit in the water quality 24 initiative fund (Code section 466B.45) to support the WQI, 25 including high-priority watershed projects. 26 DNR —— GENERAL FUND AND OTHER MAJOR FUNDS APPROPRIATIONS. 27 The bill makes appropriations from the general fund and several 28 major funds to DNR in order to support its administrative 29 divisions involving natural resources and environmental 30 protection including moneys credited to the state fish and 31 game protection fund and moneys credited to the groundwater 32 protection fund that are not otherwise statutorily allocated. 33 DNR —— MISCELLANEOUS SOURCES —— DESIGNATED APPROPRIATIONS. 34 The bill appropriates moneys to DNR from a number of sources 35 -26- LSB 5028HV (2) 87 da/rn 26/ 28
H.F. 2491 to support designated purposes, including moneys deposited in 1 the special snowmobile fund to provide for administering and 2 enforcing the state snowmobile programs; and moneys deposited 3 in the unassigned revenue fund for purposes of paying for 4 administration of DNR’s underground storage tanks section. 5 DNR —— SPECIAL GENERAL FUND APPROPRIATIONS. The bill also 6 makes special appropriations from the general fund to DNR 7 in order to support specific purposes including floodplain 8 management and dam safety and forestry health management 9 programs. 10 ISU —— SPECIAL GENERAL FUND APPROPRIATION. The bill 11 appropriates moneys from the general fund to ISU to support the 12 operation of the veterinary diagnostic laboratory operated by 13 the college of veterinary medicine. 14 DALS, DNR, AND UI —— EFF GENERAL APPROPRIATIONS. The 15 bill appropriates moneys from the EFF to support a number 16 of programs administered by DALS and DNR. For DALS, the 17 moneys are appropriated to support programs involving soil 18 conservation, watershed protection and nutrient management, 19 and the loess hills development and conservation fund. For 20 DNR, moneys are appropriated to support programs involving 21 state parks, geographic information systems, water quality 22 monitoring, public water supplies, regulation of animal feeding 23 operations, air quality, and floodplain management and dam 24 safety. 25 UI —— WATER QUANTITY MANAGEMENT. The bill appropriates 26 moneys from EFF to UI to support the geological and water 27 survey for its operations and to measure, assess, and evaluate 28 water quantity sources and assist DNR in regulating water 29 quantity. 30 DALS —— EFF SPECIAL WQI APPROPRIATION. The bill 31 appropriates additional moneys from the EFF to the water 32 quality initiative fund to support the WQI administered by 33 DALS, subject to the same conditions applicable to moneys 34 appropriated to that fund from the general fund. 35 -27- LSB 5028HV (2) 87 da/rn 27/ 28
H.F. 2491 IOWA RESOURCES ENHANCEMENT AND PROTECTION (REAP) FUND —— 1 SPECIAL PROVISIONS. The bill appropriates moneys from the EFF 2 to the REAP fund in lieu of the $20 million standing limited 3 appropriation from the general fund (Code section 455A.18). 4 The bill appropriates moneys from the REAP fund to DNR to 5 support the regular maintenance and operations of state parks 6 and staff prior to allocations made from the fund. DNR is also 7 authorized to use moneys allocated to the fund’s open spaces 8 account for state park maintenance and repair. 9 CODIFIED STATUTORY PROVISIONS. The bill provides that DNR 10 request cooperation with the state geologist and requires 11 the state geologist to maintain, collect, and compile data 12 regarding water resources, including surface water sources and 13 groundwater sources, and geological formations that impact upon 14 those water resources. The state geologist is also required 15 to measure, assess, and evaluate groundwater sources and 16 subsurface geological formations in a manner that assists DNR 17 in optimizing allocations and uses of groundwater sources in 18 this state. 19 -28- LSB 5028HV (2) 87 da/rn 28/ 28
