H.F. 2476 Section 1. Section 321M.9, subsection 1, Code 2018, is 1 amended to read as follows: 2 1. Fees to counties. 3 a. Notwithstanding any other provision in the Code to the 4 contrary, the county treasurer of a county authorized to issue 5 driver’s licenses under this chapter shall retain for deposit 6 in the county general fund seven dollars of fees received for 7 each issuance or renewal of driver’s licenses and nonoperator’s 8 identification cards, but shall not retain any moneys for 9 the issuance of any persons with disabilities identification 10 devices. 11 b. (1) The county treasurer of a county authorized to 12 issue commercial driver’s licenses pursuant to section 321M.6 13 may charge a fee for the administration of commercial driver’s 14 license skills tests by the county. For a person who resides 15 in the county administering the test, the fee shall not exceed 16 fifty dollars. For a person who resides outside the county 17 administering the test, the fee shall not exceed seventy-five 18 dollars. The county treasurer shall retain the fees charged 19 under this paragraph for deposit in the county general fund. 20 (2) This paragraph is repealed July 1, 2021. 21 c. The five dollar processing fee charged by a county 22 treasurer for collection of a civil penalty under section 23 321.218A , 321A.32A , or 321J.17 shall be retained for deposit in 24 the county general fund. 25 d. The county treasurer shall remit the balance of fees and 26 all civil penalties to the department. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 Under current law, certain counties are authorized to issue 31 commercial driver’s licenses and administer commercial driver’s 32 license skills tests if certified to do so by the department of 33 transportation. This bill provides that the county treasurer 34 of a county authorized to issue commercial driver’s licenses 35 -1- LSB 6216HV (1) 87 ns/rh 1/ 2

H.F. 2476 may charge a fee for the administration of commercial driver’s 1 license skills tests by the county. For a person who resides 2 in the county administering the test, the fee shall not exceed 3 $50. For a person who resides outside the county administering 4 the test, the fee shall not exceed $75. The bill requires the 5 county treasurer to retain the fees charged under the bill for 6 deposit in the county general fund.
