H.F. 2426 Section 1. ADMINISTRATIVE RULES —— CHILD SUPPORT 1 DELINQUENCY —— HARDSHIP. The department of human services 2 shall revise rules pursuant to chapter 17A to establish the 3 criteria and procedures for reviewing the amount to be withheld 4 from the obligor’s income to pay a child support delinquency 5 when such amount is based on the department’s hardship 6 criteria. The rules shall provide that the child support 7 recovery unit may periodically initiate such reviews and that a 8 child support obligee may request such a review not more often 9 than every two years. The rules shall be effective no later 10 than January 1, 2019. 11 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 12 importance, takes effect upon enactment. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill requires the department of human services to 17 revise rules pursuant to Code chapter 17A to be effective no 18 later than January 1, 2019, to establish the criteria and 19 procedures for reviewing the amount to be withheld from the 20 obligor’s income to pay a child support delinquency when such 21 amount is based on the department’s hardship criteria.
