H.F. 2404 Section 1. Section 910.3B, Code 2018, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4. An award under this section made to the 3 victim’s estate or heirs at law shall not be reduced by any 4 third-party payment, including any insurance payment, unless 5 the offender is a named or covered insured. 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 This bill relates to restitution paid to the estate or heirs 10 at law of a crime victim. 11 The bill provides that restitution awarded under Code 12 section 910.3B to the victim’s estate or heirs at law shall not 13 be reduced by any third-party payment, including any insurance 14 payment, unless the offender is a named or covered insured. 15 Currently, restitution awarded under Code section 910.3B 16 shall not be an amount less than $150,000. 17 -1- LSB 5625HV (2) 87 jm/rh 1/ 1
