H.F. 2399 Section 1. Section 233A.1, Code 2018, is amended to read as 1 follows: 2 233A.1 State training school —— Eldora and Toledo . 3 1. Effective January 1, 1992, a diagnosis and evaluation 4 center and other units are established at Eldora the state 5 training school to provide to court-committed male juvenile 6 delinquents a program which focuses upon appropriate 7 developmental skills, treatment, placements, and rehabilitation 8 on education, observation, and rehabilitation designed to 9 help such juveniles recognize accountability for delinquent 10 behavior by confronting and eliminating delinquent norms, 11 criminal thinking, and antisocial behavior . The state training 12 school shall assist such juveniles in the development of 13 skills necessary to function effectively and positively in the 14 community in a manner consistent with public safety by doing 15 all of the following: 16 a. Providing humane, disciplined confinement to male 17 juvenile delinquents who present a danger to the community. 18 b. Holding male juvenile delinquents accountable for their 19 delinquent behavior. 20 c. Developing efficient and effective juvenile correctional 21 programs within the framework of professional correctional 22 standards and available resources. 23 2. The diagnosis and evaluation center which is used to 24 identify appropriate treatment and placement alternatives 25 for juveniles and any other units Units for court-committed 26 male juvenile delinquents which are located at Eldora and 27 the unit for juvenile delinquents at Toledo shall together 28 be known as the “state training school” . For the purposes of 29 this chapter “director” means the director of human services 30 and “superintendent” means the administrator in charge of the 31 diagnosis and evaluation center for juvenile delinquents and 32 other units at Eldora and the unit for juvenile delinquents at 33 Toledo state training school . 34 3. H.F. 2399 state training school at Eldora shall not exceed the population 1 guidelines established under 1990 Iowa Acts, ch. 1239, §21 , as 2 adjusted for subsequent changes in the capacity at the training 3 school. 4 Sec. 2. Section 233A.14, Code 2018, is amended to read as 5 follows: 6 233A.14 Transfers to other institutions. 7 The administrator may transfer to the schools state training 8 school minor wards of the state from any institution under the 9 administrator’s charge but no person shall be so transferred 10 who is mentally ill or has an intellectual disability. Any 11 child in the schools state training school who is mentally ill 12 or has an intellectual disability may be transferred by the 13 administrator to the proper state institution. 14 Sec. 3. Section 915.29, subsection 1, unnumbered paragraph 15 1, Code 2018, is amended to read as follows: 16 The department of human services shall notify a registered 17 victim regarding a juvenile adjudicated delinquent for a 18 violent crime, committed to the custody of the department of 19 human services, and placed at the state training school at 20 Eldora or Toledo , of the following: 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 This bill relates to the state training school at Eldora. 25 Code chapter 233A.1 establishes a diagnosis and 26 evaluation center and other units at Eldora to provide 27 juvenile delinquents a program which focuses upon 28 appropriate developmental skills, treatment, placements, 29 and rehabilitation. The bill eliminates references to the 30 diagnosis and evaluation center and specifies that such units 31 established at Eldora shall provide court-committed male 32 juvenile delinquents a program which focuses on education, 33 observation, and rehabilitation designed to help such juveniles 34 recognize accountability for delinquent behavior by confronting 35 -2- LSB 5307HV (2) 87 hb/rh 2/ 3
H.F. 2399 and eliminating delinquent norms, criminal thinking, and 1 antisocial behavior. The bill provides that the state training 2 school will assist such juveniles in the development of 3 skills necessary to function effectively and positively in 4 the community in a manner consistent with public safety by 5 providing humane, disciplined confinement to male juvenile 6 delinquents who present a danger to the community; holding male 7 juvenile delinquents accountable for their delinquent behavior; 8 and developing efficient and effective juvenile correctional 9 programs within the framework of professional correctional 10 standards and available resources. 11 Under current law, “state training school” is defined to 12 include units for juvenile delinquents located at Eldora and 13 Toledo. The bill amends the definition of “state training 14 school” to eliminate references to Toledo and makes conforming 15 amendments to Code sections 233A.14 (transfers to other 16 institutions) and 915.29 (notification of victim of juvenile by 17 department of human services). 18 -3- LSB 5307HV (2) 87 hb/rh 3/ 3
