1.
DEPARTMENT

THE
DEPARTMENT

HEALTH.

1.
Beginning
July
1,
2018,
the
director
of
human
services
4
shall
work
with
the
director
of
public
health
to
transfer
the
5
duties
of
the
department
of
human
services
regarding
the
mental
6
health
and
disability
services
regions
to
the
department
of
7
public
health
effective
July
1,
2019.
8
2.
Any
contract
entered
into
by
the
department
of
human
9
services
in
matters
related
to
the
mental
health
and
disability
10
services
regions
in
effect
at
the
conclusion
of
the
fiscal
year
11
beginning
July
1,
2018,
shall
continue
in
full
force
and
effect
12
pending
transfer
of
such
contracts
to
the
department
of
public
13
health.

3.
Any
rule,
regulation,
form,
order,
or
directive
15
promulgated
by
the
department
of
human
services
regarding
the
16
mental
health
and
disability
services
regions
in
existence
at
17
the
conclusion
of
the
fiscal
year
beginning
July
1,
2018,
shall
18
continue
in
full
force
and
effect
until
amended,
repealed,
or
19
supplemented
by
affirmative
action
of
the
department
of
public
20
health.

4.
With
regard
to
updating
references
and
format
in
the
Iowa
22
administrative
code
in
order
to
correspond
to
the
transferring
23
of
the
duties
related
to
the
mental
health
and
disability
24
services
region
from
the
department
of
human
services
to
25
the
department
of
public
health,
the
administrative
rules
26
coordinator
and
the
administrative
rules
review
committee,
in
27
consultation
with
the
administrative
code
editor,
shall
jointly
28
develop
a
schedule
for
the
necessary
updating
of
the
Iowa
29
administrative
code.
30
5.
The
director
of
human
services,
in
cooperation
with
the
31
director
of
public
health,
pursuant
to
section
2.16,
shall
32
prepare
draft
legislation
for
submission
to
the
legislative
33
services
agency,
as
necessary,
for
consideration
by
the
general
34
assembly
during
the
2019
legislative
session,
necessary
to

complete
the
transfer
of
its
duties
related
to
the
mental

health
and
disability
services
regions
to
the
department
of

public
health
effective
July
1,
2019.

EXPLANATION
4
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
5
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
for
the
transfer
of
duties
related
to
the
7
mental
health
and
disability
services
(MHDS)
regions
from
the
8
department
of
human
services
(DHS)
to
the
department
of
public
9
health
(DPH)
and
directs
the
director
of
human
services
to
10
work
with
the
director
of
public
health
to
transfer
the
duties
11
related
to
MHDS
regions
effective
July
1,
2019.
The
bill
12
directs
DPH
to
assume
the
duties
related
to
the
MHDS
regions.

The
bill
provides
that
any
contract
entered
into
by
DHS
in
14
relation
to
MHDS
regions
in
effect
at
the
conclusion
of
the
15
fiscal
year
beginning
July
1,
2018,
shall
continue
in
full
16
force
and
effect
pending
transfer
of
such
contracts
to
DPH.

Additionally,
any
rule,
regulation,
form,
order,
or
directive
18
promulgated
by
DHS
relating
to
MHDS
regions
in
existence
at
the
19
conclusion
of
the
fiscal
year
beginning
July
1,
2018,
shall
20
continue
in
full
force
and
effect
until
amended,
repealed,
or
21
supplemented
by

action
of
DPH.
With
regard
to
22

references
and
format
in
the
Iowa
administrative
code

in
order
to

Finally,
the

director
of
human
services,
along
with
the

of
public

health
and
in
compliance
with
Code
section
2.16,
is
required

to

the
legislative

services
agency,
for
consideration
by
the
general
assembly
32
during
the
2019
legislative
session,
necessary
to
implement
the
33
transition
of
duties
related
to
MHDS
regions
to
DPH,
effective
34
July
1,
2019.
