H.F. 2371 Section 1. Section 669.14, Code 2018, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 15. Any claim relating to a constructed 3 honeybee hive on state property, provided the state and beehive 4 owner, if not the state, acted reasonably and in good faith. 5 Sec. 2. Section 670.4, subsection 1, Code 2018, is amended 6 by adding the following new paragraph: 7 NEW PARAGRAPH . q. Any claim relating to a constructed 8 honeybee hive on municipal property, provided the municipality 9 or beehive owner, if not the municipality, acted reasonably and 10 in good faith. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill amends the Iowa tort claims Act and the Iowa 15 municipal tort claims Act to create an exemption from liability 16 for claims related to constructed honeybee hives on public 17 property against state agencies and municipalities, provided 18 that the state agency, municipality, or beehive owner acted 19 reasonably and in good faith. 20 The Iowa tort claims Act defines state agency to include 21 all executive departments, agencies, boards, bureaus, and 22 commissions of the state.
