1.
Section
455A.4,
Code
2018,
is
amended
by
adding

the
following
new
subsection:

SUBSECTION
.

The
department
is,
except
as
otherwise

provided
by
law,
empowered
to
make
and
execute
agreements,

contracts,
grants,
and
other
instruments
necessary
to
carry
out
5
the
department’s
obligations.
The
department’s
obligations

shall
not
be
expanded
or
enlarged
by
this
authority
beyond
7
the
powers
specifically
delegated
to
or
conferred
upon
the
8
department.

Sec.
2.
REPEAL.
Chapter
28N,
Code
2018,
is
repealed.

Sec.
3.
REPEAL.
Sections
455A.8
and
455A.8A,
Code
2018,

are
repealed.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
changes
duties
and
responsibilities
of
the
16
department
of
natural
resources.

The
department
currently
does
not
have
explicit
18
authorization
to
make
and
execute
agreements,
contracts,
19
grants,
and
other
instruments
necessary
to
carry
out
the
20
department’s
obligations.
The
bill
grants
the
department
this
21
authority.
22
Currently,
a
Mississippi
river
partnership
council
provides
23
a
forum
for
stakeholders
to
discuss
matters
relevant
to
the
24
health,
management,
and
use
of
the
Mississippi
river.
The
25
council
has
the
authority
to
develop
strategies
and
work
with
26
communities,
organizations,
other
states,
and
federal
agencies
27
to
further
its
goals.
28
The
department
currently
contains
the
Brushy
creek
29
recreation
trails
advisory
board
that
has
the
purpose
of
30
maintaining
and
improving
the
trail
system
within
the
Brushy
31
creek
recreation
area
and
the
adjoining
state
preserve.
32
The
bill
repeals
the
Mississippi
river
partnership
council
33
and
the
Brushy
creek
recreation
trails
advisory
board.
