Section
1.
Section
99D.7,
subsection
23,
Code
2018,
is

amended
to
read
as
follows:

23.
To
require
licensees
to
establish
a
process
to
allow
3
a
person
to
be
voluntarily
excluded
from
the
wagering
area
of
4
a
racetrack
enclosure
and
from
the
gaming
floor,
as
defined
5
in
section
99F.1
,
of
all
other
licensed
facilities
under
this
6
chapter
and
chapter
99F
as
provided
in
this
subsection
.
The
7
process
shall
provide
that
an
initial
request
by
a
person
to
8
be
voluntarily
excluded
shall
be
for
a
period
of
five
years
9
or
life
and
any
subsequent
request
following
any
five-year
10
period
shall
be
for
a
period
of
five
years
or
life.
The
11
process
established
shall
require
that
licensees
be
provided
12
electronic
access
to
names
and
social
security
numbers
of
13
persons
voluntarily
excluded
through
a
secured
interactive
14
internet
site
maintained
by
the
commission
and
information
15
regarding
persons
voluntarily
excluded
shall
be
disseminated
16
to
all
licensees
under
this
chapter
and
chapter
99F.
The
17
names,
social
security
numbers,
and
information
regarding
18
persons
voluntarily
excluded
shall
be
kept
confidential
19
unless
otherwise
ordered
by
a
court
or
by
another
person
20
duly
authorized
to
release
such
information.
The
process
21
established
shall
also
require
a
person
requesting
to
be
22
voluntarily
excluded
be
provided
information
compiled
by
the
23
Iowa
department
of
public
health
on
gambling
treatment
options
24
and
shall
also
require
that
a
licensee
disseminate
information
25
regarding
persons
voluntarily
excluded
to
all
licensees
under
26
this
chapter
and
chapter
99F
.
The
state
and
any
licensee
under
27
this
chapter
or
chapter
99F
shall
not
be
liable
to
any
person
28
for
any
claim
which
may
arise
from
this
process.
In
addition
29
to
any
other
penalty
provided
by
law,
any
money
or
thing
of
30
value
that
has
been
obtained
by,
or
is
owed
to,
a
voluntarily
31
excluded
person
by
a
licensee
as
a
result
of
wagers
made
by
the
32
person
after
the
person
has
been
voluntarily
excluded
shall
not
33
be
paid
to
forfeited
by
the
person
but
and
shall
be
credited
to
34
the
general
fund
of
the
state.

By
1
January
1,
2019,
the
racing
and
gaming
commission
shall
develop
2
and
thereafter
maintain
a
secured
interactive
internet
site
3
to
provide
licensees
electronic
access
to
names
and
social
4
security
numbers
of
persons
voluntarily
excluded
as
provided
5
in
this
Act.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
8
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
process
involved
when
a
person
10
requests
to
be
voluntarily
excluded
from
the
wagering
area
11
and
gaming
floor
of
a
gambling
facility
licensed
under
Code
12
chapters
99D
and
99F.
13
The
bill
provides
that
the
racing
and
gaming
commission,
14
and
not
the
licensees,
shall
establish
the
process
to
allow
15
a
person
to
be
voluntarily
excluded
and
shall
be
responsible
16
for
disseminating
information
concerning
persons
voluntarily
17
excluded
to
all
gambling
facility
licensees.
The
bill
also
18
requires
the
commission
to
provide
licensees
electronic
19
access
to
names
and
social
security
numbers
of
persons
20
voluntarily
excluded
through
a
secured
interactive
internet
21
site
maintained
by
the
commission.
The
bill
provides
that
the
22
information
regarding
persons
voluntarily
excluded
shall
be
23
kept
confidential
unless
otherwise
ordered
by
a
court
or
by
24
another
person
duly
authorized
to
release
such
information.
25
The
bill
requires
the
racing
and
gaming
commission
to
develop
26
and
subsequently
maintain
the
secured
interactive
internet
site
27
by
January
1,
2019.
