H.F. 2310 Section 1. Section 331.502, subsection 1, Code 2018, is 1 amended to read as follows: 2 1. Have general custody and control of the courthouse, and 3 shall have supervisory custody and control of areas of the 4 courthouse not occupied by the judicial branch, subject to the 5 direction of the board. 6 Sec. 2. NEW SECTION . 602.1303A Supervision and control. 7 1. For purposes of this section “occupied” means 8 courtrooms, offices, and other physical facilities used 9 exclusively by officers and employees of the judicial branch. 10 2. The judicial branch shall have supervisory custody and 11 control of only the areas occupied by the judicial branch in 12 facilities provided by a county or city pursuant to section 13 602.1303. 14 3. The county or city shall have supervisory custody and 15 control of all other areas in facilities not occupied by the 16 judicial branch. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill relates to the supervisory custody and control of a 21 county courthouse. 22 Currently, the county auditor has general custody and 23 control of the courthouse, subject to the direction of the 24 board of supervisors. The bill specifies that the county 25 auditor shall have supervisory custody and control of areas of 26 the courthouse not occupied by the judicial branch, subject to 27 the direction of the board of supervisors. 28 The bill creates new Code section 602.1303A specifying that 29 the judicial branch shall have supervisory custody and control 30 of only the areas occupied by the judicial branch in facilities 31 provided by a county or city pursuant to Code section 602.1303. 32 The county or city shall have supervisory custody and control 33 of all other areas in facilities not occupied by the judicial 34 branch. 35 -1- LSB 5584HV (1) 87 jm/rh 1/ 2
