H.F. 2300 Section 1. Section 489.1101, subsection 4, Code 2018, is 1 amended to read as follows: 2 4. “Profession” means the profession of certified public 3 accountancy, architecture, chiropractic, dentistry, physical 4 therapy, practice as a physician assistant, psychology, 5 professional engineering, land surveying, landscape 6 architecture, law, medicine and surgery, optometry, osteopathic 7 medicine and surgery, accounting practitioner, podiatry, real 8 estate brokerage, speech pathology, audiology, veterinary 9 medicine, pharmacy, nursing, or marital and family therapy , or 10 mental health counseling, provided that the marital and family 11 therapist or mental health counselor is licensed under chapters 12 147 and 154D , or social work, provided that the social worker 13 is licensed under chapters 147 and 154C . 14 Sec. 2. Section 489.1102, subsection 2, Code 2018, is 15 amended by adding the following new paragraph: 16 NEW PARAGRAPH . c. For purposes of this section, marital 17 and family therapy, mental health counseling, psychology, and 18 social work shall be deemed to be professions which could 19 lawfully be practiced in combination by licensed individuals or 20 a partnership of licensed individuals. 21 Sec. 3. Section 496C.2, subsection 4, Code 2018, is amended 22 to read as follows: 23 4. “Profession” means the profession of certified public 24 accountancy, architecture, chiropractic, dentistry, physical 25 therapy, practice as a physician assistant, psychology, marital 26 and family therapy or mental health counseling, provided that 27 the marital and family therapist or mental health counselor is 28 licensed under chapters 147 and 154D, social work, provided 29 that the social worker is licensed under chapters 147 and 30 154C, professional engineering, land surveying, landscape 31 architecture, law, medicine and surgery, optometry, osteopathic 32 medicine and surgery, accounting practitioner, podiatry, real 33 estate brokerage, speech pathology, audiology, veterinary 34 medicine, pharmacy, and the practice of nursing. 35 -1- LSB 5715HV (3) 87 ss/rh 1/ 2

H.F. 2300 Sec. 4. Section 496C.4, subsection 2, Code 2018, is amended 1 by adding the following new paragraph: 2 NEW PARAGRAPH . c. For purposes of this section, marital 3 and family therapy, mental health counseling, psychology, and 4 social work shall be deemed to be professions which could 5 lawfully be practiced in combination by licensed individuals or 6 a partnership of licensed individuals. 7 Sec. 5. EFFECTIVE DATE. This Act, being deemed of immediate 8 importance, takes effect upon enactment. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill adds to the list of professions permitted to 13 practice in professional limited liability companies and 14 professional corporations and to the list of professions 15 that may be practiced in combination by licensed individuals 16 or a partnership of licensed individuals in a professional 17 corporation. 18 The bill adds mental health counseling and social work to the 19 list of professions permitted to form a professional limited 20 liability company. The bill also permits marital and family 21 therapy, mental health counseling, psychology, and social work 22 to be practiced in combination by licensed individuals or a 23 partnership of licensed individuals in a professional limited 24 liability company. 25 The bill adds marital and family therapy, mental health 26 counseling, and social work to the list of professions 27 permitted to form a professional corporation. The bill also 28 permits marital and family therapy, mental health counseling, 29 psychology, and social work to be practiced in combination by 30 licensed individuals or a partnership of licensed individuals 31 in a professional corporation. 32 -2- LSB 5715HV (3) 87 ss/rh 2/ 2
