H.F. 228 Section 1. Section 124.414, subsection 1, paragraph b, Code 1 2017, is amended to read as follows: 2 b. “Drug paraphernalia” does not include hypodermic needles 3 or syringes if manufactured, delivered, sold, or possessed for 4 a lawful purpose. “Lawful purpose” includes hypodermic needles 5 or syringes delivered, sold, or possessed through an approved 6 needle exchange program established pursuant to rules adopted 7 by the department of public health. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill relates to the criminal offense of manufacturing, 12 delivering, selling, or possessing drug paraphernalia by 13 exempting hypodermic needles or syringes delivered, sold, or 14 possessed through an approved needle exchange program. 15 Currently, a person who illegally manufactures, delivers, 16 sells, or possesses drug paraphernalia commits a simple 17 misdemeanor under Code section 124.414. Current law also 18 provides that “drug paraphernalia” does not include hypodermic 19 needles or syringes if manufactured, delivered, sold, or 20 possessed for a lawful purpose. The bill specifies that 21 “lawful purpose” includes hypodermic needles or syringes 22 delivered, sold, or possessed through an approved needle 23 exchange program established pursuant to rules adopted by the 24 department of public health. 25 -1- LSB 1919YH (4) 87 jm/rh/rj 1/ 1
