Section
1.
Section
461A.46,
Code
2017,
is
amended
to
read

as
follows:

461A.46
Closing
time.

1.
Except
by
arrangement
or
permission
granted
by
the

director
or
the
director’s
authorized
representative,
all
5
persons
shall
vacate
state
parks
and
preserves
before
10:30
6
p.m.
Areas
may
be
closed
at
an
earlier
or
later
hour,
of
which
7
notice
shall
be
given
by
proper
signs
or
instructions.

2.
Notwithstanding
subsection
1,
lake
Macbride
state
park
9
shall
be
closed
at
8:30
p.m.
and
all
persons
shall
vacate
the
10
park
before
that
time.

3.
The
provisions
of
this
section
shall
not
apply
to

authorized
camping
in
areas
provided
for
that
purpose.

A
person
shall
not
possess,
use,
or
consume
an
alcoholic

beverage,
as
defined
in
section
123.3,
in
lake
Macbride
state

park.

person
violating
this
section
is
guilty
of
a
simple

misdemeanor
punishable
as
a
scheduled
violation
pursuant
to

section
805.8B,
subsection
6,
paragraph
“c”
.

paragraph

Code

is
amended
to
read
as
follows:

For
violations
of
sections
461A.35
,
461A.42

and

the
scheduled
fine
is
fifty
dollars.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
regulates
the
closing
time
for
and
the
possession,

use,
or
consumption
of
alcoholic
beverages
in
lake
Macbride

state
park.

The
bill
provides
that
lake
Macbride
state
park
shall
be
32
closed
at
8:30
p.m.
and
all
persons
shall
vacate
the
park
33
before
that
time.
Currently,
the
park
closes
at
10:30
p.m.
34
This
provision
does
not
apply
to
authorized
camping
areas.

A
violation
of
this
provision
is
punishable
as
a
scheduled

violation
with
a
fine
of
$15.

The
bill
also
prohibits
a
person
from
possessing,
using,
or

consuming
an
alcoholic
beverage
in
lake
Macbride
state
park.

Currently,
alcoholic
beverages
are
prohibited
by
rule
(IAC
5
571-61.7(2)(e))
in
lake
Macbride
state
park
only
on
beaches,
6
and
the
prohibition
does
not
apply
to
rental
facilities
located
7
within
the
200-foot
buffer
of
land
surrounding
the
sand
or
8
fenced-in
area
that
have
been
officially
reserved
through
the
9
department
of
natural
resources.
A
person
violating
this
10
provision
is
guilty
of
a
simple
misdemeanor
punishable
as
a
11
scheduled
violation
with
a
fine
of
$50.
