H.F. 2262 Section 1. EDUCATIONAL SERVICES FOR INCARCERATED JUVENILES 1 AWAITING TRIAL —— DEPARTMENT OF EDUCATION STUDY AND REPORT. 2 1. The department of education shall conduct a study of 3 educational services provided across the state to juveniles 4 incarcerated by a state or local law enforcement agency while 5 awaiting trial. The department shall consider all applicable 6 state and federal laws, rules, regulations, and court rulings 7 to determine whether educational services currently being 8 provided comply with applicable legal requirements. A state or 9 local law enforcement agency shall comply with any request for 10 information submitted by the department as part of the study. 11 2. The department of education shall submit a report on 12 its findings and recommendations to the general assembly and 13 the governor no later than January 4, 2019. The report shall 14 include any best practices for providing educational services 15 to juveniles incarcerated by a state or local law enforcement 16 agency while awaiting trial, any recommended policy changes 17 by state or local law enforcement agencies to ensure that all 18 applicable legal requirements are followed, and any recommended 19 legislation on this subject. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 This bill requires the department of education to conduct 24 a study of educational services provided across the state to 25 juveniles incarcerated by a state or local law enforcement 26 agency while awaiting trial. The bill requires the department 27 to consider all applicable state and federal laws, rules, 28 regulations, and court rulings to determine whether educational 29 services currently being provided comply with applicable 30 legal requirements.
