H.F. 2256 Section 1. Section 307.32, Code 2018, is amended to read as 1 follows: 2 307.32 Annual report —— secondary road construction program 3 —— structurally deficient bridges —— repeal . 4 On or before February 15 of each year, the department, in 5 collaboration with the Iowa county engineers association, shall 6 compile the annual reports received from counties pursuant to 7 sections 309.22 and 309.22A into a cumulative report and submit 8 the cumulative report in electronic format to the chairpersons 9 of the senate and house of representatives standing committees 10 on transportation and the legislative services agency. This 11 section is repealed June 30, 2019. 12 Sec. 2. Section 309.22A, Code 2018, is amended to read as 13 follows: 14 309.22A Annual report —— replacement and repair of 15 structurally deficient bridges —— repeal . 16 1. On or before September 15 of each year, the county 17 engineer of each county in the state shall certify and file 18 a report with the department, as part of the annual report 19 required under section 309.22 , detailing the manner in which 20 moneys received by the county that originated from the road use 21 tax fund were used to replace or repair structurally deficient 22 bridges in the county. The report shall include all of the 23 following: 24 a. 1. The number of bridges under the county’s jurisdiction 25 that have been replaced or repaired to the point that they 26 function at full capacity. 27 b. 2. The number of bridges under the county’s jurisdiction 28 that have been partially replaced or partially repaired to 29 alleviate some structural deficiencies, but not to the point 30 that the bridges function at full capacity, and a brief 31 description of the replacements or repairs necessary to allow 32 them to function at full capacity. 33 c. 3. The number of bridges under the county’s jurisdiction 34 that are in the process of being replaced or repaired and a 35 -1- LSB 5691HV (2) 87 ns/rh 1/ 3

The number of bridges under the county’s jurisdiction 3 that remain structurally deficient and a description of the 4 timeline for replacement or repair of each bridge, if any. 5 2. This section is repealed June 30, 2019. 6 Sec. 3. ELECTRIC, HYBRID, AND HIGH-EFFICIENCY MOTOR 7 VEHICLES —— REPORT. The department of transportation shall 8 estimate the impact of increased usage of electric, hybrid, 9 and other high-efficiency motor vehicles in this state on 10 future revenues to the road use tax fund. The department shall 11 evaluate and may recommend the creation of alternative funding 12 mechanisms or the alteration of existing funding mechanisms to 13 mitigate any estimated decrease in future revenues to the road 14 use tax fund related to increased usage of electric, hybrid, 15 and other high-efficiency motor vehicles. The department shall 16 submit a report, in paper or electronic format, containing the 17 department’s estimate, evaluation, and any recommendations to 18 the general assembly and the state transportation commission 19 on or before December 31, 2018. 20 EXPLANATION 21 The inclusion of this explanation does not constitute agreement with 22 the explanation’s substance by the members of the general assembly. 23 In 2016, the general assembly passed legislation requiring, 24 on or before September 15 of each year, the county engineer of 25 each county to certify and file a report with the department 26 of transportation (DOT), as part of the annual report required 27 under Code section 309.22, detailing the manner in which moneys 28 received by the county from the road use tax fund were used to 29 replace or repair structurally deficient bridges in the county. 30 The legislation also required, on or before February 15 of each 31 year, the DOT, in collaboration with the Iowa county engineers 32 association, to compile the annual reports into a cumulative 33 report and submit the cumulative report in electronic format 34 to the chairpersons of the senate and house of representatives 35 -2- LSB 5691HV (2) 87 ns/rh 2/ 3

These provisions are set to be repealed 2 effective June 30, 2019. 3 This bill strikes the future repeal provisions. Because 4 counties generally do not receive moneys directly from the 5 road use tax fund, the bill also clarifies that the reporting 6 requirements apply to moneys that originated from the road use 7 tax fund. 8 The bill requires the DOT to estimate the impact of increased 9 usage of electric, hybrid, and other high-efficiency motor 10 vehicles on future revenues to the road use tax fund. The DOT 11 must evaluate and may recommend the creation of alternative 12 funding mechanisms or the alteration of existing funding 13 mechanisms to mitigate any estimated decrease in future 14 revenues to the road use tax fund related to increased usage 15 of electric, hybrid, and other high-efficiency motor vehicles. 16 The bill requires the DOT to submit a report containing the 17 DOT’s estimate, evaluation, and any recommendations to the 18 general assembly and the state transportation commission on or 19 before December 31, 2018. 20 -3- LSB 5691HV (2) 87 ns/rh 3/ 3
