The sovereign state of Iowa recognizes that life is 3 valued and protected, and each life, from the moment of 4 conception, is accorded the same rights and protections, 5 including the rights to life, liberty, and the pursuit of 6 happiness, guaranteed to all persons by the Constitution of the 7 United States, the Constitution of the State of Iowa, and the 8 laws of this state. 9 2. This section shall not be construed to create or 10 recognize a right to an abortion or to impose civil or criminal 11 liability on a woman upon whom an abortion is performed. 12 Sec. 2. CONTINGENT IMPLEMENTATION. This Act shall be 13 implemented contingent upon recognition by either the United 14 States supreme court or an amendment to the United States 15 Constitution that states have the authority to prohibit 16 abortion at all stages of pregnancy. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill provides for the recognition that life is valued 21 and protected, and each life, from the moment of conception, is 22 accorded the same rights and protections, including the rights 23 to life, liberty, and the pursuit of happiness, guaranteed 24 under the Constitution of the United States, the Constitution 25 of the State of Iowa, and the laws of the state. 26 The bill is not to be construed to create or recognize a 27 right to an abortion or to impose civil or criminal liability 28 on a woman upon whom an abortion is performed. 29 The bill is to be implemented contingent upon recognition by 30 either the United States supreme court or an amendment to the 31 United States Constitution that states have the authority to 32 prohibit abortion at all stages of pregnancy. 33 -1- LSB 5895YH (3) 87 pf/rh 1/ 1
