the

device

franchisee,

memorize,
or
store,
temporarily

on
the

bill
relates
to
the
illegal
use
of
a
scanning
device
or

encoding
machine.

ILLEGAL
USE
OF
SCANNING
DEVICE
OR
ENCODING
MACHINE.
The
bill

replaces
the
term
“reencoder”
with
the
term
“encoding
machine”.

The
bill
defines
“encoding
machine”
to
mean
an
electronic
8
device
that
is
used
to
encode
information
to
a
payment
card.
9
The
bill
also
expands
the
definition
of
“merchant”
to
10
include
an
establishing
financial
institution
referred
to
in
11
Code
section
524.5.
12
The
bill
modifies
the
definition
of
“payment
card”
to
13
include
an
access
device
as
defined
in
Code
section
527.2.

The
bill
also
modifies
the
term
“scanning
device”
to
include
15
a
wireless
access
device,
a
radio
frequency
identification
16
scanner,
an
electronic
device
that
utilizes
near
field
17
communications
technology,
and
any
other
electronic
device
used

obtain,
memorize,

A
class
“D”
felony
is
punishable
by
confinement
for
no
more
11
than
five
years
and
a
fine
of
at
least
$750
but
not
more
than
12
$7,500.

The
bill
creates
a
new
criminal
offense.
Under
the
bill,
14
a
person
shall
not
possess
a
scanning
device
with
the
intent
15
to
use
such
device
to
obtain
information
encoded
on
a
payment
16
card
without
permission
of
the
authorized
user,
the
issuer
of
17
the
authorized
user’s
payment
card,
or
a
merchant,
or
possess
18
a
scanning
device
with
knowledge
that
a
person
other
than
the
19
authorized
user,
the
issuer
of
the
authorized
user’s
payment
20
card,
or
a
merchant
intends
to
use
the
scanning
device
to
21
obtain
information
encoded
on
a
payment
card
without
permission
22
from
the
authorized
user,
the
issuer
of
the
authorized
user’s
23
payment
card,
or
a
merchant.
A
person
who
violates
this
24
provision
commits
an
aggravated
misdemeanor.
An
aggravated
25
misdemeanor
is
punishable
by
confinement
for
no
more
than
two
26
years
and
a
fine
of
at
least
$625
but
not
more
than
$6,250.

CRIMINAL
MISCHIEF
IN
THE
THIRD
DEGREE.
If
a
person
28
intentionally
damages,
defaces,
alters,
or
destroys
property
29
upon
real
or
personal
property
that
has
the
ability
to
process
30
a
payment
card
as
defined
in
Code
section
715A.10
in
the
bill,
31
with
no
right
to
do
such
an
act,
that
person
commits
criminal
32
mischief
in
the
third
degree.
Criminal
mischief
in
the
third
33
degree
is
an
aggravated
misdemeanor.
