H.F. 2122 Section 1. Section 272.10, subsections 2 and 3, Code 2018, 1 are amended to read as follows: 2 2. Licensing fees are payable to the treasurer of state and 3 shall be deposited with the executive director of the board. 4 The executive director shall deposit twenty-five percent of 5 the fees collected annually with the treasurer of state and 6 the fees shall be credited to the general fund of the state. 7 The remaining licensing fees collected during the fiscal year 8 under this chapter shall be retained by and are appropriated 9 to the board for the purposes related to the board’s duties. 10 Notwithstanding section 8.33 , licensing fees retained by and 11 appropriated to the board pursuant to this section that remain 12 unencumbered or unobligated at the close of the fiscal year 13 shall not revert but shall remain available for expenditure for 14 the activities of the board as provided in this chapter until 15 the close of the succeeding fiscal year. 16 3. The executive director shall keep an accurate and 17 detailed account of fees received , including fees paid to the 18 treasurer of state and fees retained by the board. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill provides that the licensing fees established by 23 the board of educational examiners and collected under Code 24 chapter 272 shall be retained by the board. 25 The bill strikes language that requires the board’s 26 executive director to deposit 25 percent of the fees collected 27 annually with the treasurer to be credited to the general fund 28 of the state. 29 -1- LSB 5766YH (5) 87 kh/jh 1/ 1
