H.F. 2114 Section 1. Section 22.7, subsection 9, Code 2018, is amended 1 to read as follows: 2 9. Criminal identification files of law enforcement 3 agencies. However, records of current and prior arrests , 4 immigration status information, and criminal history data shall 5 be public records. 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 This bill relates to criminal identification files of 10 law enforcement agencies and immigration status information. 11 Currently, criminal identification files of law enforcement 12 agencies are confidential records, except for records 13 of current and prior arrests, and criminal history data. 14 “Criminal history data” is defined in Code section 692.1(5). 15 Under Code section 22.7, confidential records may be released 16 by court order, the lawful custodian of the records, or by 17 another person authorized to release such records. 18 The bill makes immigration status contained in a criminal 19 identification file of a law enforcement agency a public 20 record.
