H.F. 2109 Section 1. INTERIM STUDY COMMITTEE —— PUBLIC RECORDS 1 AND CONFIDENTIAL RECORDS UNDER IOWA’S OPEN RECORDS LAW. The 2 legislative council is requested to establish a legislative 3 interim committee to meet during the 2018 interim to study and 4 discuss issues relating to the statutory designation of certain 5 public records as confidential records under chapter 22 (Iowa’s 6 open records law). The committee shall work to develop a clear 7 statutory categorization of the terms “government records”, 8 “public records”, and “confidential records” to facilitate the 9 assignment of particular government records to each category, 10 and to provide a framework to better inform and provide 11 guidance to public record custodians relating to their rights 12 and responsibilities under chapter 22. In conducting the study 13 and developing recommendations, the committee shall consider 14 testimony from interested stakeholders, including but not 15 limited to representatives from the attorney general’s office, 16 the Iowa public information board, the Iowa state association 17 of counties, the Iowa league of cities, and state and local 18 government agencies. The committee shall submit its findings 19 and recommendations to the general assembly by December 31, 20 2018. 21 EXPLANATION 22 The inclusion of this explanation does not constitute agreement with 23 the explanation’s substance by the members of the general assembly. 24 INTERIM STUDY —— PUBLIC RECORDS AND CONFIDENTIAL RECORDS. 25 This bill requests the legislative council to establish 26 a legislative interim committee to meet during the 2018 27 interim to study and discuss issues relating to the statutory 28 designation of certain public records as confidential records 29 under Code chapter 22 (Iowa’s open records law).
