481A.41
Baiting
of
deer.
1
1.
As
used
in
this
section,
unless
the
context
otherwise
2
requires:
3
a.
“Bait
an
area”
means
to
transport
feed
to
an
area
and
4
place,
expose,
deposit,
distribute,
concentrate,
or
scatter
it
5
with
the
intent
to
lure,
attract,
or
entice
deer
to
a
specific
6
location.
7
b.
“Baited
area”
means
any
area
where
feed
is
transported
to
8
and
placed,
exposed,
deposited,
distributed,
concentrated,
or
9
scattered
with
the
intent
to
lure,
attract,
or
entice
deer
to
a
10
specific
location.
11
c.
“Feed”
means
grains,
fruits,
vegetables,
nuts,
hay,
12
or
any
other
natural
or
artificial
products
containing
food
13
additives
or
materials.
“Feed”
does
not
include
minerals
unless
14
those
minerals
contain
feed
or
food
by-products.
15
d.
“Mineral
site”
means
any
area
where
minerals
have
been
16
transported
to
and
placed,
including
areas
where
minerals
were
17
previously
transported
to
and
leached
into
the
soil.

2.
A
person
shall
not
hunt,
take,
or
attempt
to
take
deer
19
in
a
baited
area
or
within
two
hundred
yards
of
a
baited
area
20
unless
the
feed
has
been
gone
from
the
baited
area
for
at
least
21
ten
days.

3.
A
person
shall
not
place
a
tree
stand,
blind,
or
any
23
other
permanent
hunting
shelters
or
stands
within
fifty
yards
24
of
a
mineral
site,
and
a
person
shall
not
hunt,
take,
or
25
attempt
to
take
deer
within
fifty
yards
of
a
mineral
site.

4.
Spilled,
scattered,
or
exposed
feed
as
the
result
27
of
normal
agricultural
practices
and
the
establishment
and
28
maintenance
of
food
plots
is
not
considered
baiting.

5.
A
person
shall
not
bait
an
area
on
public
property,
or
30
place
minerals
on
public
property.

bill
relates
to
the
baiting
of
deer.

The
bill
defines
what
a
baited
area
is,
relevant
to
deer,
1
and
prohibits
hunting,
taking,
or
attempting
to
take
deer
in

a
baited
area
or
within
200
yards
of
a
baited
area.
The
bill
3
also
defines
what
a
mineral
site
is
and
prohibits
placing
tree
4
stands,
blinds,
or
any
other
permanent
hunting
shelters
or
5
stands
within
50
yards
of
a
mineral
site.
It
also
prohibits
6
hunting,
taking,
or
attempting
to
take
deer
within
50
yards
7
of
a
mineral
site.
The
bill
prohibits
all
baiting
on
public
8
property
and
prohibits
placing
of
minerals
on
public
property.

For
purposes
of
this
bill,
“feed”
includes
grains,
fruits,
10
vegetables,
nuts,
hay,
or
any
other
natural
or
artificial
11
products
containing
food
additives
or
materials,
but
does
not
12
include
minerals
unless
those
minerals
contain
feed
or
food
13
by-products.
A
person
who
violates
the
provisions
of
the
bill
14
is
subject
to
penalties
pursuant
to
Code
section
481A.135.
