1.
Section
309.57,
subsection
5,
Code
2018,
is

amended
to
read
as
follows:

5.
A
road
with
an
area
service
“C”
classification
shall
3
retain
the
classification
until
such
time
as
a
petition
for
4
reclassification
is
submitted
to
the
board
of
supervisors.

The
petition
shall
be
signed
by
one
or
more
all
adjoining
6
landowners.
The
board
of
supervisors
shall
approve
or
deny
the
7
request
for
reclassification
within
sixty
days
of
receipt
of
8
the
petition.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
11
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Under
current
law,
a
county
board
of
supervisors,
after
13
consultation
with
the
county
engineer,
and
for
purposes
14
of
specifying
levels
of
maintenance
effort
and
access,
may
15
classify
an
area
service
system
into
three
classifications
16
termed
area
service
“A”,
area
service
“B”,
and
area
service
17
“C”.
The
area
service
“C”
classification
roads
may
have
18
restricted
access
and
a
minimal
level
of
maintenance
as
19
specified
by
the
county
board
of
supervisors
after
consultation
20
with
the
county
engineer.
A
road
with
an
area
service
“C”
21
classification
retains
the
classification
until
such
time
as
a
22
petition
for
reclassification
is
submitted
to
the
county
board
23
of
supervisors.
The
petition
must
be
signed
by
one
or
more
24
adjoining
landowners.
This
bill
amends
current
law
to
require
25
the
petition
to
be
signed
by
all
adjoining
landowners.
