H.F. 2090 Section 1. Section 910.3B, Code 2018, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4. An award under this section shall not 3 be reduced by any third-party payment including any insurance 4 payment made to the victim’s estate or heirs at law. 5 EXPLANATION 6 The inclusion of this explanation does not constitute agreement with 7 the explanation’s substance by the members of the general assembly. 8 This bill relates to restitution paid to the estate or heirs 9 at law of a crime victim. 10 The bill provides that restitution awarded under Code 11 section 910.3B, after an offender causes the death of another, 12 shall not be reduced by any third-party payment including any 13 insurance payment made to the victim’s estate or heirs at law. 14 Currently, restitution awarded under Code section 910.3B 15 shall not be an amount less than $150,000. 16 -1- LSB 5625YH (2) 87 jm/rh 1/ 1
