On or before September 15 of each year, the county 17 engineer of each county in the state shall certify and file 18 a report with the department, as part of the annual report 19 required under section 309.22 , detailing the manner in which 20 moneys received by the county that originated from the road use 21 tax fund were used to replace or repair structurally deficient 22 bridges in the county. H.F. 2079 description of the timeline of each replacement or repair 1 project. 2 d. 4. The number of bridges under the county’s jurisdiction 3 that remain structurally deficient and a description of the 4 timeline for replacement or repair of each bridge, if any. 5 2. This section is repealed June 30, 2019. 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 In 2016, the general assembly passed legislation requiring, 10 on or before September 15 of each year, the county engineer of 11 each county to certify and file a report with the department 12 of transportation (DOT), as part of the annual report required 13 under Code section 309.22, detailing the manner in which moneys 14 received by the county from the road use tax fund were used to 15 replace or repair structurally deficient bridges in the county. 16 The legislation also required, on or before February 15 of each 17 year, the DOT, in collaboration with the Iowa county engineers 18 association, to compile the annual reports into a cumulative 19 report and submit the cumulative report in electronic format 20 to the chairpersons of the senate and house of representatives 21 standing committees on transportation and the legislative 22 services agency. These provisions are set to be repealed 23 effective June 30, 2019. 24 This bill strikes the future repeal provisions. Because 25 counties generally do not receive moneys directly from the 26 road use tax fund, the bill also clarifies that the reporting 27 requirements apply to moneys that originated from the road use 28 tax fund. 29 -2- LSB 5691YH (3) 87 ns/rh 2/ 2
