amended
by
adding
the
following
new
paragraph:

e.
Agrees
that
the
tenant
pay
the
landlord

for
utilities,
electrical
services,
gas,
cable
television,
4
internet,
water,
or
sewer
or
septic,
on
the
basis
of
the
number
5
of
bedrooms
or
square
footage
of
the
mobile
home.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
8
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Currently,
a
landlord
of
a
manufactured
home
community
or
10
mobile
home
park
may
include
in
a
rental
agreement
a
method
of
11
charging
a
tenant
for
utilities
or
services
initially
charged
12
to
the
landlord
directly,
including
on
the
basis
of
the
number
13
of
bedrooms
within
or
square
footage
of
the
manufactured
or
14
mobile
home.

This
bill
prohibits
a
landlord
and
tenant
from
agreeing
in
16
the
rental
agreement
that
the
landlord
will
charge
a
tenant
17
for
utilities
or
services
based
on
the
number
of
bedrooms
in
18
or
the
square
footage
of
the
manufactured
or
mobile
home.
If
19
a
landlord
or
tenant
knowingly
uses
a
rental
agreement
that
20
causes
the
landlord
to
charge
the
tenant
for
utilities
or
21
services
based
on
the
number
of
bedrooms
or
square
footage,
22
such
provision
is
unenforceable
and
the
other
party
may
recover
23
actual
damages
sustained.
