H.F. 2038 Section 1. Section 8.33, Code 2018, is amended by adding the 1 following new unnumbered paragraph: 2 NEW UNNUMBERED PARAGRAPH . Notwithstanding this section, 3 up to ten percent of the moneys appropriated to a state 4 department, institution, or agency that remain unencumbered or 5 unobligated at the close of the fiscal year shall not revert 6 to the general fund but shall remain available for expenditure 7 by the state department, institution, or agency in succeeding 8 fiscal years unless the governing board or head of the state 9 department, institution, or agency, as applicable, reallocates 10 the unencumbered or unobligated moneys for other duties, 11 functions, or purposes. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill relates to the nonreversion or reallocation of 16 moneys appropriated to state departments, institutions, or 17 agencies. 18 Under the bill, up to 10 percent of the moneys appropriated 19 to a state department, institution, or agency that remain 20 unencumbered or unobligated at the close of the fiscal year 21 shall not revert to the general fund but shall remain available 22 for expenditure by the state department, institution, or agency 23 in succeeding fiscal years unless the governing board or head 24 of the state department, institution, or agency, as applicable, 25 reallocates the unencumbered or unobligated moneys for other 26 duties, functions, or purposes. 27 -1- LSB 5160YH (6) 87 jm/rn 1/ 1
