H.F. 2026 Section 1. Section 22.7, subsection 18, Code 2018, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . d. Information contained in the 3 communication is a public record if any of the following apply: 4 (1) The communication is made to the office of the 5 governor or to a state agency as defined in chapter 17A and the 6 information pertains to any provision of legislation introduced 7 in the general assembly. 8 (2) The communication is made to the office of the governor 9 or to a state agency and pertains to any provision of an 10 administrative rule for which a rulemaking document has been 11 published in the Iowa administrative bulletin. 12 (3) The communication is made to the office of the governor 13 as it pertains to agency action as defined in section 17A.2. 14 EXPLANATION 15 The inclusion of this explanation does not constitute agreement with 16 the explanation’s substance by the members of the general assembly. 17 Code section 22.7(18) provides that certain communications 18 made to a government body from persons outside of government 19 are considered confidential records for purposes of Code 20 chapter 22. This bill provides that certain information 21 contained in a communication that would otherwise be 22 confidential pursuant to this subsection is considered a public 23 record. The bill provides that information communicated to 24 the office of the governor or a state agency pertaining to 25 introduced legislation or an administrative rule for which 26 a rulemaking document has been published shall be a public 27 record. In addition, the bill provides that any information 28 in a communication to the office of the governor relative to 29 agency action, as defined in Code section 17A.2, shall be a 30 public record. 31 -1- LSB 5234HH (2) 87 ec/rh 1/ 1
