Medical
specialty
board

recertification
not
required.

1.
Maintenance
of
certification
or
osteopathic
continuous
3
certification
shall
not
be
required
for
a
physician
as
a
4
condition
of
licensure,
admitting
privileges
at
a
hospital
in
5
this
state,
reimbursement,
malpractice
insurance
coverage,
or
6
employment.

For
the
purposes
of
this
section:
8
a.
“Maintenance
of
certification”
and
“osteopathic
continuous
9
certification”
refer
to
proprietary
programs,
sponsored
by
10
one
or
more
of
the
medical
specialty
boards
recognized
by
11
the
American
board
of
medical
specialties
or
the
American
12
osteopathic
association,
that
require
periodic
medical
13
specialty
recertification
examinations,
self-assessments,
14
peer
evaluations,
and
other
activities,
necessary
to
maintain
15
medical
specialty
board
certification.

b.
“Physician”
means
a
person
licensed
to
practice
medicine
17
and
surgery
or
osteopathic
medicine
and
surgery
under
this
18
chapter.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
21
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
the
state,
hospitals
in
the
state,
23
employers,
and
insurers
from
requiring
physicians
to
24
participate
in
a
maintenance
of
certification
or
osteopathic
25
continuous
certification
program
in
order
to
maintain
a
26
license,
admitting
privileges,
malpractice
insurance,
or
27
employment,
or
to
receive
reimbursement.
The
bill
does
not
28
alter
the
current
continuing
medical
education
requirements
for
29
physicians
established
by
the
board
of
medicine.
