H.F. 165 Section 1. Section 692A.101, subsection 1, paragraph a, 1 subparagraph (5), Code 2017, is amended to read as follows: 2 (5) Assault with intent to commit sexual abuse in violation 3 of section 709.11 , subsection 1 or 2 . 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 This bill relates to sex offender registration for an 8 assault with intent to commit sexual abuse that does not result 9 in a bodily or serious injury to any person. 10 Currently, assault with intent to commit sexual abuse is 11 punishable as an aggravated misdemeanor if no injury results, 12 and that offense is defined as an aggravated offense under Code 13 chapter 692A. A person who commits an aggravated offense is 14 required to register as a sex offender for life pursuant to 15 Code section 692A.106(5). 16 The bill strikes the criminal offense of assault with intent 17 to commit sexual abuse punishable as an aggravated misdemeanor 18 from the definition of an aggravated offense under Code chapter 19 692A. Thus, a person who commits such an offense is required 20 to register as a sex offender for 10 years as required in Code 21 section 692A.106(1) and not for life. 22 A person who commits such an offense is also subject to a 23 10-year special sentence under Code section 903B.2. 24 -1- LSB 1787HH (7) 87 jm/rj 1/ 1
