H.F. 161 Section 1. Section 256.9, subsection 46, paragraph a, Code 1 2017, is amended to read as follows: 2 a. Develop and make available to school districts, 3 examples of age-appropriate , developmentally appropriate, and 4 research-based materials and lists of resources which parents 5 may use to teach their children to recognize unwanted physical 6 and verbal sexual advances, to not make unwanted physical and 7 verbal sexual advances, to effectively reject unwanted sexual 8 advances, that it is wrong to take advantage of or exploit 9 another person, about the dangers of sexual exploitation by 10 means of the internet including specific strategies to help 11 students protect themselves and their personally identifiable 12 information from such exploitation, and about counseling, 13 medical, and legal resources available to survivors of sexual 14 abuse and sexual assault, including resources for escaping 15 violent relationships. The materials and resources shall cover 16 child sexual abuse and sexual assault awareness and prevention, 17 verbal, physical, and visual sexual harassment, including 18 nonconsensual sexual advances, and nonconsensual physical 19 sexual contact. In developing the materials and resource list, 20 the director shall consult with entities that shall include 21 but not be limited to the departments of human services, 22 public health, and public safety, education stakeholders, 23 and parent-teacher organizations. School districts shall 24 provide age-appropriate , developmentally appropriate, and 25 research-based materials and a list of available community and 26 internet-based resources to parents at registration and shall 27 also include the age-appropriate , developmentally appropriate, 28 and research-based materials and resource list in the student 29 handbook. School districts are encouraged to work with their 30 communities to provide voluntary parent education sessions to 31 provide parents with the skills and appropriate strategies 32 to teach their children as described in this subsection . 33 School districts shall incorporate the age-appropriate , 34 developmentally appropriate, and research-based materials 35 -1- LSB 1824YH (4) 87 kh/sc 1/ 4
H.F. 161 into relevant curricula and shall reinforce with parents and 1 students the importance of preventive measures when reasonable 2 with parents and students . 3 Sec. 2. Section 256.9, subsection 46, Code 2017, is amended 4 by adding the following new paragraph: 5 NEW PARAGRAPH . c. Seek and use funds available to the 6 department under the federal Elementary and Secondary Education 7 Act of 1965, 20 U.S.C. §6301 et seq., as amended by the federal 8 Every Student Succeeds Act, Pub. L. No. 114-95, Tit. II, 9 §§2001-2104, and Tit. IV, §§4001-4101, to provide to school 10 districts with approved applications for allocations from 11 such funds training for school district personnel, including 12 teachers, principals, other school leaders, specialized 13 instructional support personnel, and para-educators, regarding 14 how to prevent and recognize child sexual abuse and regarding 15 child sexual abuse awareness and prevention programs or 16 activities, such as programs or activities designed to provide 17 age-appropriate and developmentally appropriate instruction 18 for students in child sexual abuse awareness and prevention, 19 including how to recognize child sexual abuse and how to safely 20 report child sexual abuse, and to provide information for 21 parents and guardians of students about child sexual abuse 22 awareness and prevention, including how to recognize child 23 sexual abuse and how to discuss child sexual abuse with a 24 child. 25 Sec. 3. Section 272.2, Code 2017, is amended by adding the 26 following new subsection: 27 NEW SUBSECTION . 20. Adopt rules establishing that 28 continuing education requirements for issuance, renewal, or 29 upgrade of a license may include participating in or presenting 30 at in-service training programs on child sexual abuse and 31 sexual assault awareness and prevention. 32 Sec. 4. Section 279.50, Code 2017, is amended by adding the 33 following new subsection: 34 NEW SUBSECTION . 2A. The human growth and development 35 -2- LSB 1824YH (4) 87 kh/sc 2/ 4
H.F. 161 curriculum shall include age-appropriate, developmentally 1 appropriate, and research-based instruction for students in 2 child sexual abuse and sexual assault awareness and prevention, 3 including how to recognize child sexual abuse and sexual 4 assault and how to safely report child sexual abuse and sexual 5 assault. 6 Sec. 5. STATE MANDATE FUNDING SPECIFIED. In accordance 7 with section 25B.2, subsection 3, the state cost of requiring 8 compliance with any state mandate included in this Act shall 9 be paid by a school district from state school foundation aid 10 received by the school district under section 257.16. This 11 specification of the payment of the state cost shall be deemed 12 to meet all of the state funding-related requirements of 13 section 25B.2, subsection 3, and no additional state funding 14 shall be necessary for the full implementation of this Act 15 by and enforcement of this Act against all affected school 16 districts. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill relates to child sexual abuse and sexual assault 21 awareness and prevention by directing the board of educational 22 examiners to adopt rules establishing that continuing education 23 requirements for issuing, renewing, or upgrading of a license 24 may include but are not limited to participating in or 25 presenting at in-service training programs on child sexual 26 abuse and sexual assault awareness and prevention. The bill 27 also requires school districts to provide instruction in child 28 sexual abuse and sexual assault awareness and prevention 29 as part of its human growth and development curriculum in 30 kindergarten through grade 12. 31 Currently, the director of the department of education has a 32 duty to develop and make available to school districts examples 33 of age-appropriate and research-based materials. The bill 34 specifies that the materials and resources shall also cover 35 -3- LSB 1824YH (4) 87 kh/sc 3/ 4
H.F. 161 child sexual abuse and sexual assault awareness and prevention. 1 The director is also directed to seek and use funds available 2 to the department under the federal Elementary and Secondary 3 Education Act of 1965, as amended by the federal Every 4 Student Succeeds Act, Pub. L. No. 114-95, to provide to school 5 districts with approved applications for allocations from such 6 funds training for school district personnel regarding child 7 sexual abuse and sexual assault awareness. 8 The bill may include a state mandate as defined in Code 9 section 25B.3. The bill requires that the state cost of 10 any state mandate included in the bill be paid by a school 11 district from state school foundation aid received by the 12 school district under Code section 257.16. The specification 13 is deemed to constitute state compliance with any state mandate 14 funding-related requirements of Code section 25B.2. The 15 inclusion of this specification is intended to reinstate the 16 requirement of political subdivisions to comply with any state 17 mandates included in the bill. 18 -4- LSB 1824YH (4) 87 kh/sc 4/ 4
