There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. S.F. _____ conservation division as provided in section 466B.42, including 1 salaries, support, maintenance, and miscellaneous purposes, 2 notwithstanding section 8.57, subsection 5, paragraph “c”: 3 FY 2016-2017: 4 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,100,000 5 (2) (a) The moneys appropriated in this lettered 6 paragraph shall be used to support demonstration projects in 7 subwatersheds as designated by the department that are part 8 of high-priority watersheds identified by the water resources 9 coordinating council established pursuant to section 466B.3. 10 (b) The moneys appropriated in this lettered paragraph 11 shall be used to support demonstration projects in watersheds 12 generally, including regional watersheds, as designated by the 13 division and high-priority watersheds identified by the water 14 resources coordinating council established pursuant to section 15 466B.3. 16 (c) Of the moneys appropriated in this lettered paragraph, 17 $450,000 is allocated to the Iowa nutrient research center at 18 Iowa state university of science and technology for nutrient 19 water monitoring network technology and equipment. Of the 20 moneys allocated in this subparagraph division, not more than 21 $150,000 may be used for the operations and maintenance of the 22 nutrient water monitoring network. 23 (3) In supporting projects in watersheds and subwatersheds 24 as provided in subparagraph (2), subparagraph divisions (a) and 25 (b), all of the following shall apply: 26 (a) The demonstration projects shall utilize water quality 27 practices as described in the latest revision of the document 28 entitled “Iowa Nutrient Reduction Strategy” initially presented 29 in November 2012 by the department of agriculture and land 30 stewardship, the department of natural resources, and Iowa 31 state university of science and technology. 32 (b) The division shall implement demonstration projects 33 as provided in subparagraph division (a) by providing 34 for participation by persons who hold a legal interest in 35 -2- LSB 5018SB (1) 86 ec/tm 2/ 24
S.F. _____ agricultural land used in farming. To every extent practical, 1 the division shall provide for collaborative participation by 2 such persons who hold a legal interest in agricultural land 3 located within the same subwatershed. 4 (c) The division shall implement demonstration projects on 5 a cost-share basis as determined by the division. However, the 6 state’s share of the amount shall not exceed 50 percent of the 7 estimated cost of establishing the practice as determined by 8 the division or 50 percent of the actual cost of establishing 9 the practice, whichever is less. 10 (d) The demonstration projects shall be used to educate 11 other persons about the feasibility and value of establishing 12 similar water quality practices. The division shall promote 13 field day events for purposes of allowing interested persons to 14 establish water quality practices on their agricultural land. 15 (e) The division shall conduct water quality evaluations 16 within supported subwatersheds. Within a reasonable period 17 after accumulating information from such evaluations, the 18 division shall create an aggregated database of water quality 19 practices. Any information identifying a person holding a 20 legal interest in agricultural land or specific agricultural 21 land shall be a confidential record. 22 (4) The moneys appropriated in this lettered paragraph 23 shall be used to support education and outreach in a manner 24 that encourages persons who hold a legal interest in 25 agricultural land used for farming to implement water quality 26 practices, including the establishment of such practices in 27 watersheds generally, and not limited to subwatersheds or 28 high-priority watersheds. 29 (5) The moneys appropriated in this lettered paragraph 30 may be used to contract with persons to coordinate the 31 implementation of efforts provided in this paragraph. 32 (6) The moneys appropriated in this lettered paragraph 33 may be used by the department to support urban soil and water 34 conservation efforts, which may include but are not limited 35 -3- LSB 5018SB (1) 86 ec/tm 3/ 24
S.F. _____ to management practices related to bioretention, landscaping, 1 the use of permeable or pervious pavement, and soil quality 2 restoration. The moneys shall be allocated on a cost-share 3 basis as provided in chapter 161A. 4 (7) Notwithstanding any other provision of law to the 5 contrary, the department may use moneys appropriated in 6 this lettered paragraph to carry out the provisions of this 7 paragraph on a cost-share basis in combination with other 8 moneys available to the department from a state or federal 9 source. 10 (8) Not more than 10 percent of the moneys appropriated in 11 this lettered paragraph may be used for costs of administration 12 and implementation of the water quality initiative administered 13 by the soil conservation division. 14 b. S.F. _____ Sec. 15. Section 456A.33B, Code 2016, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 01. For purposes of this section, unless 3 the context otherwise requires: 4 a. “Lake” includes a significant public lake and a public 5 shallow lake or wetland. 6 b. Public shallow lake or wetland” means a water body that 7 meets the following criteria: 8 (1) Is owned by the federal government, the state of 9 Iowa, a county, or a municipal government, and is maintained 10 principally for public use. 11 (2) Is a multi-use system capable of supporting diverse 12 wildlife, fish, or recreational opportunities. 13 (3) Has a surface water area of at least ten acres. 14 (4) Does not have a watershed-to-lake surface area ratio of 15 greater than two hundred to one. 16 (5) Is an open freshwater system where maximum depth is 17 typically less than six to eight feet at its deepest spot and 18 is under four and one-half feet mean depth. 19 (6) Is typically fringed by a border of emergent vegetation 20 in water depth less than six feet and when clear is dominated 21 by both emergent and submergent vegetation and provides 22 important wildlife and fish habitat. 23 c. “Significant public lake” means a lake that meets all of 24 the following criteria: 25 (1) Is owned by the federal government, the state of 26 Iowa, a county, or a municipal government, and is maintained 27 principally for public use. 28 (2) Is a multi-use system capable of supporting diverse 29 wildlife, fish, or recreational opportunities. 30 (3) Has a surface water area of at least ten acres. 31 (4) Does not have a watershed-to-lake surface area ratio of 32 greater than two hundred to one. 33 (5) Is not an on-stream impoundment that emulates riverine 34 habitat rather than a lake environment. 35 -17- LSB 5018SB (1) 86 ec/tm 17/ 24
S.F. _____ (6) Is not used solely as a water supply reservoir. 1 Sec. 16. Section 456A.33B, subsection 1, paragraph b, Code 2 2016, is amended by adding the following new subparagraph: 3 NEW SUBPARAGRAPH . (6) When restored, will contribute to the 4 department’s fish and wildlife conservation plans. 5 Sec. 17. Section 456A.33B, subsection 2, paragraphs a and b, 6 Code 2016, are amended to read as follows: 7 a. The department , with input from stakeholders, shall 8 develop maintain an initial annual list of not more than 9 thirty-five significant public lakes and not more than five 10 public shallow lakes or wetlands to be considered for funding 11 based on the feasibility of restoring each lake and the use or 12 potential use of the lake, if restored. The list shall include 13 lake projects under active development that the department 14 shall recommend be given priority for funding so long as 15 progress toward completion of the projects remains consistent 16 with the goals of this section . 17 b. The department shall meet with stakeholders and 18 representatives of communities where lakes on the initial 19 annual list are located to provide an initial annual lake 20 restoration assessment and to explain the process and criteria 21 for receiving lake restoration funding. Communities with 22 lakes not included on the initial annual list may petition the 23 director of the department for a preliminary lake restoration 24 assessment and explanation of the funding process and criteria. 25 The department shall work with stakeholders and representatives 26 of each community to develop a joint lake restoration action 27 plan. At a minimum, each joint action plan shall document the 28 causes, sources, and magnitude of lake impairment, evaluate 29 the feasibility of the lake and watershed restoration options, 30 establish water quality and fishery and wildlife goals and a 31 schedule for attainment, describe long-term management actions, 32 assess the economic benefits of the project, identify the 33 sources and amounts of any leveraged funds, and describe the 34 community’s commitment to the project, including local funding. 35 -18- LSB 5018SB (1) 86 ec/tm 18/ 24
S.F. _____ The stakeholders’ and community’s commitment to the project may 1 include moneys to fund a lake diagnostic study and watershed 2 assessment, including development of a TMDL (total maximum 3 daily load). 4 Sec. 18. Section 456A.33B, subsection 2, paragraph c, 5 subparagraph (2), Code 2016, is amended to read as follows: 6 (2) If proposed, dredging of the lake will be conducted to 7 a mean depth of at least ten eight feet to gain water quality 8 benefits unless a combination of biologic and structural 9 controls is sufficient to assure water quality targets will be 10 achieved at a shallower average water depth. 11 Sec. 19. Section 456A.33B, subsection 2, paragraph d, Code 12 2016, is amended to read as follows: 13 d. The department shall evaluate the joint action plans 14 and prioritize the plans based on the criteria required in 15 this section . The department’s annual lake restoration plan 16 and report shall include the prioritized list and the amounts 17 of state and other funding the department recommends for each 18 lake restoration project. The department may shall seek public 19 comment on its recommendations prior to submitting the plan and 20 report to the general assembly. 21 Sec. 20. Section 456A.33B, subsection 2, Code 2016, is 22 amended by adding the following new paragraph: 23 NEW PARAGRAPH . e. The department shall ensure that at least 24 eight percent, but no more than twelve percent, of the annual 25 appropriation for lake restoration projects in accordance with 26 the department’s annual lake restoration plan and report shall 27 be invested in public shallow lakes or wetlands restoration 28 projects. 29 DIVISION VI 30 MISCELLANEOUS PROVISIONS 31 Sec. 21. Section 8.57C, subsection 3, paragraph a, 32 subparagraph (2), Code 2016, is amended to read as follows: 33 (2) The fiscal year beginning July 1, 2016 2017 , and for 34 each subsequent fiscal year thereafter. 35 -19- LSB 5018SB (1) 86 ec/tm 19/ 24
S.F. _____ Sec. 22. Section 12.79, subsection 3, Code 2016, is amended 1 to read as follows: 2 3. Moneys in the fund in a fiscal year shall be used as 3 appropriated by the general assembly for prison improvement and 4 prison construction projects. However, for the fiscal year 5 beginning July 1, 2016, any unobligated and unencumbered moneys 6 in the fund from the previous fiscal year are appropriated to 7 the department of corrections for major maintenance projects. 8 Sec. 23. IOWA COMMUNICATIONS NETWORK —— AUTHORIZATION 9 FOR CONTRACTS. Pursuant to section 8D.11, subsection 1, 10 paragraph “a”, the general assembly authorizes the Iowa 11 telecommunications and technology commission to enter into a 12 contract or contracts in excess of the contract limitation 13 amount established in section 8D.11, subsection 1, paragraph 14 “c”, for purposes of the commission’s network core upgrade 15 project. This authorization applies for the duration of the 16 commission’s project and to all existing or future contracts 17 associated with the project, whether or not the award is made 18 to a single vendor or multiple vendors. 19 Sec. 24. REBUILD IOWA INFRASTRUCTURE FUND —— LIMITATION ON 20 EXPENDITURES. 21 1. For purposes of this section, “restricted employee” 22 means an elective constitutional or statutory officer, a state 23 employee whose salary is set by the governor within a range set 24 by the general assembly, or a president of a state board of 25 regents institution. 26 2. Beginning July 1, 2016, moneys appropriated from the 27 rebuild Iowa infrastructure fund and used for public vertical 28 infrastructure projects as defined in section 8.57, subsection 29 5, paragraph “c”, shall not be used for salary or other 30 compensation costs of a restricted employee. 31 Sec. 25. REBUILD IOWA INFRASTRUCTURE FUND —— FY 2017-2018 32 BUDGET REQUEST INFORMATION. Finalized agency budget requests 33 submitted to the governor for the fiscal year beginning 34 July 1, 2017, that include a request for an appropriation 35 -20- LSB 5018SB (1) 86 ec/tm 20/ 24
S.F. _____ from the rebuild Iowa infrastructure fund to be used for a 1 public vertical infrastructure project as defined in section 2 8.57, subsection 5, paragraph “c”, shall include salary cost 3 information as required by this section. The salary cost 4 information shall include the number of full-time equivalent 5 positions to be utilized for the requested project and that 6 portion, in dollars, of salaries and any compensation costs 7 attributable to these full-time equivalent positions that will 8 be paid from the requested appropriation from the rebuild Iowa 9 infrastructure fund. 10 Sec. 26. EXECUTIVE COUNCIL —— PROPERTY ACQUISITION 11 AUTHORIZATION. For the fiscal year beginning July 1, 2016, the 12 executive council may, in its sole discretion, expend moneys 13 as a performance of duty expense pursuant to section 7D.29 to 14 provide funding for the acquisition of property located at 525 15 East 9th street in the vicinity of the capitol complex. 16 Sec. 27. EFFECTIVE UPON ENACTMENT. The following provision 17 of this division of this Act, being deemed of immediate 18 importance, takes effect upon enactment: 19 1. The section of this division of this Act authorizing the 20 Iowa telecommunications and technology commission to enter into 21 a contract or contracts. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 This bill relates to and makes appropriations to state 26 departments and agencies from the rebuild Iowa infrastructure 27 fund, the technology reinvestment fund, the state bond 28 repayment fund, and the FY 2009 prison bonding fund, and 29 provides for related matters. The bill is organized by 30 divisions. 31 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 32 division appropriates project funding for FY 2016-2017 from 33 the rebuild Iowa infrastructure fund for projects for the 34 departments of administrative services, agriculture and land 35 -21- LSB 5018SB (1) 86 ec/tm 21/ 24
S.F. _____ stewardship, corrections, cultural affairs, human services, 1 natural resources, public defense, and transportation, and for 2 the economic development authority, treasurer of state, the 3 Iowa law enforcement academy, and the board of regents. The 4 division appropriates project funding for FY 2016-2017 and 5 FY 2017-2018 from the rebuild Iowa infrastructure fund for 6 projects for the department of cultural affairs and the state 7 fair authority. The division appropriates project funding for 8 FY 2016-2017, FY 2017-2018, and FY 2018-2019 from the rebuild 9 Iowa infrastructure fund for projects for the judicial branch. 10 DIVISION II —— REBUILD IOWA INFRASTRUCTURE FUND —— 11 TECHNOLOGY APPROPRIATIONS. This division appropriates project 12 funding for FY 2016-2017 from the rebuild Iowa infrastructure 13 fund for technology projects for the departments of education, 14 human rights, management, public defense, public health, 15 homeland security and emergency management, and public safety, 16 and for the Iowa telecommunications and technology commission 17 and secretary of state. The division appropriates project 18 funding for FY 2016-2017 and FY 2017-2018 from the rebuild Iowa 19 infrastructure fund for technology projects for the department 20 of cultural affairs. 21 DIVISION III —— MISCELLANEOUS APPROPRIATIONS. This division 22 appropriates project funding for FY 2016-2017 from the 23 technology reinvestment fund for the department of education. 24 This division also appropriates project funding for FY 25 2016-2017 from the state bond repayment fund for the department 26 of administrative services, the Iowa finance authority, the 27 board of regents, and the Iowa veterans home. 28 DIVISION IV —— CHANGES TO PRIOR APPROPRIATIONS. This 29 division provides for the reversion of certain unencumbered or 30 unobligated moneys from the technology reinvestment fund to the 31 department of education for FY 2012-2013. 32 The division also makes a change to moneys appropriated from 33 the rebuild Iowa infrastructure fund to the board of regents 34 for a project at the state university of Iowa for FY 2016-2017 35 -22- LSB 5018SB (1) 86 ec/tm 22/ 24
S.F. _____ and FY 2017-2018. 1 This division also strikes funding from the rebuild Iowa 2 infrastructure fund for project funding to the board of regents 3 and the Iowa veterans home for FY 2016-2017. The bill provides 4 funding for these projects through the state bond repayment 5 fund. 6 The bill makes a change to the funding match requirements 7 for moneys appropriated from the rebuild Iowa infrastructure 8 fund for project funding to the department of human services 9 for FY 2015-2016. This provision applies retroactively to July 10 1, 2015. 11 This division takes effect upon enactment. 12 DIVISION V —— SHALLOW LAKES. This division amends Code 13 section 456A.33B concerning the requirement of the department 14 of natural resources to develop a lake restoration plan and 15 report. The division adds definitions to the Code section and 16 provides that “lake” includes both significant public lakes 17 and public shallow lakes or wetlands. The division further 18 defines “significant public lake” and “public shallow lake or 19 wetland”. The division adds the department’s fish and wildlife 20 conservation plans as a goal for lake restoration projects 21 and provides that the annual report include not more than 22 five public shallow lakes or wetlands to be considered for 23 funding. In addition, the bill provides for stakeholder input 24 in developing the annual plan and report and requires that the 25 department seek public comment prior to submitting the plan and 26 report to the general assembly. Finally, the division provides 27 that not less than 8 percent, nor more than 12 percent, of the 28 annual appropriation for lake restoration projects be invested 29 in public shallow lakes or wetlands restoration projects. 30 DIVISION VI —— MISCELLANEOUS PROVISIONS. Code section 31 8.57C, concerning the technology reinvestment fund, is amended 32 to provide that the appropriation to the fund from the general 33 fund for fiscal years beginning on or after July 1, 2016, is 34 changed to fiscal years beginning on or after July 1, 2017. 35 -23- LSB 5018SB (1) 86 ec/tm 23/ 24
S.F. _____ Code section 12.79, concerning the FY 2009 prison bonding 1 fund, is amended to provide that for FY 2016-2017, any 2 unobligated and unencumbered moneys in the fund from the 3 previous fiscal year are appropriated to the department of 4 corrections for major maintenance projects. 5 The division also authorizes the Iowa telecommunications and 6 technology commission to enter into a contract or contracts 7 in excess of the statutory contract limitation amount for 8 purposes of the commission’s network core upgrade project. 9 This provision of this division of the bill takes effect upon 10 enactment. 11 The division further provides that beginning July 1, 2016, 12 moneys appropriated from the rebuild Iowa infrastructure fund 13 and used for vertical infrastructure projects shall not be 14 used for salary and other compensation costs of a restricted 15 employee. The division defines “restricted employee” as an 16 elective constitutional or statutory officer, a state employee 17 whose salary is set by the governor within a range set by the 18 general assembly, or a president of a state board of regents 19 institution. 20 The division also provides that finalized agency budget 21 requests submitted to the governor for FY 2017-2018 for an 22 appropriation from the rebuild Iowa infrastructure fund shall 23 include salary cost information relative to that requested 24 appropriation. 25 The division also authorizes, for FY 2016-2017, the 26 executive council to expend moneys, in its sole discretion, as 27 a performance of duty expense for the acquisition of property 28 located in the vicinity of the capitol complex. 29 -24- LSB 5018SB (1) 86 ec/tm 24/ 24
