The moneys appropriated in subsection 1 shall be used for 7 the public purpose of providing a grant to a national nonprofit 8 organization with over 80 years of experience in assisting 9 children and adults with disabilities and special needs. The 10 moneys shall be used to support a nationally recognized program 11 that began in 1986 and has been replicated in at least 30 other 12 states, but which is not available through any other entity 13 in this state, and that provides assistance to farmers with 14 disabilities in all 99 counties to allow the farmers to remain 15 in their own homes and be gainfully engaged in farming through 16 provision of agricultural worksite and home modification 17 consultations, peer support services, services to families, 18 information and referral, and equipment loan services. 19 3. Notwithstanding section 8.33 , moneys appropriated in 20 this section that remain unencumbered or unobligated at the 21 close of the fiscal year shall not revert but shall remain 22 available for expenditure for the purposes designated until the 23 close of the succeeding fiscal year. 24 DIVISION II 25 GENERAL FUND 26 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 27 WATER QUALITY INITIATIVE 28 APPROPRIATIONS FOR FY 2016-2017 29 Sec. 8. 2015 Iowa Acts, chapter 132, section 31, is amended 30 to read as follows: 31 SEC. 31. WATER QUALITY INITIATIVE —— GENERAL. 32 1. There is appropriated from the general fund of the state 33 to the department of agriculture and land stewardship for the 34 fiscal year beginning July 1, 2016, and ending June 30, 2017, 35 -5- LSB 5011JB (2) 86 da/rn 5/ 28

The moneys appropriated in subsection 1 shall be 10 used to support projects in subwatersheds as designated by the 11 division that are part of high-priority watersheds identified 12 by the water resources coordinating council established 13 pursuant to section 466B.3 . 14 b. The moneys appropriated in subsection 1 shall be used to 15 support projects in watersheds generally, including regional 16 watersheds, as designated by the division and high-priority 17 watersheds identified by the water resources coordinating 18 council established pursuant to section 466B.3 . 19 3. In supporting projects in subwatersheds and watersheds 20 as provided in subsection 2, all of the following shall apply: 21 a. The demonstration projects shall utilize water quality 22 practices as described in the latest revision of the document 23 entitled “Iowa Nutrient Reduction Strategy” initially presented 24 in November 2012 by the department of agriculture and land 25 stewardship, the department of natural resources, and Iowa 26 state university of science and technology. 27 b. The division shall implement demonstration projects as 28 provided in paragraph “a” by providing for participation by 29 persons who hold a legal interest in agricultural land used in 30 farming. To every extent practical, the division shall provide 31 for collaborative participation by such persons who hold a 32 legal interest in agricultural land located within the same 33 subwatershed. 34 c. The division shall implement a demonstration project on 35 -6- LSB 5011JB (2) 86 da/rn 6/ 28
S.F. _____ H.F. _____ a cost-share basis as determined by the division. However, the 1 state’s share of the amount shall not exceed 50 percent of the 2 estimated cost of establishing the practice as determined by 3 the division or 50 percent of the actual cost of establishing 4 the practice, whichever is less. 5 d. The demonstration projects shall be used to educate other 6 persons about the feasibility and value of establishing similar 7 water quality practices. The division shall promote field day 8 events for purposes of allowing interested persons to establish 9 water quality practices on their agricultural land. 10 e. The division shall conduct water quality evaluations 11 within supported subwatersheds. Within a reasonable period 12 after accumulating information from such evaluations, the 13 division shall create an aggregated database of water quality 14 practices. Any information identifying a person holding a 15 legal interest in agricultural land or specific agricultural 16 land shall be a confidential record under section 22.7 . 17 4. The moneys appropriated in subsection 1 shall be used 18 to support education and outreach in a manner that encourages 19 persons who hold a legal interest in agricultural land used for 20 farming to implement water quality practices, including the 21 establishment of such practices in watersheds generally, and 22 not limited to subwatersheds or high-priority watersheds. 23 5. The moneys appropriated in subsection 1 may be used 24 to contract with persons to coordinate the implementation of 25 efforts provided in this section. 26 6. The moneys appropriated in subsection 1 may be used by 27 the department to support urban soil and water conservation 28 efforts, which may include but are not limited to management 29 practices related to bioretention, landscaping, the use of 30 permeable or pervious pavement, and soil quality restoration. 31 The moneys shall be allocated on a cost-share basis as provided 32 in chapter 161A . 33 7. Notwithstanding any other provision of law to the 34 contrary, the department may use moneys appropriated in 35 -7- LSB 5011JB (2) 86 da/rn 7/ 28
S.F. _____ H.F. _____ subsection 1 to carry out the provisions of this section on a 1 cost-share basis in combination with other moneys available to 2 the department from a state or federal source. 3 8. Not more than 10 percent of the moneys appropriated in 4 this section may be used to pay for the costs of administering 5 and implementing the water quality initiative by the 6 department’s division of soil conservation and water quality as 7 provided in section 466B.42 and this section. 8 DIVISION III 9 DEPARTMENT OF NATURAL RESOURCES 10 GENERAL APPROPRIATIONS FOR FY 2016-2017 11 Sec. 9. 2015 Iowa Acts, chapter 132, section 32, is amended 12 to read as follows: 13 SEC. 32. STATE FORESTRY NURSERIES. The department of 25 natural resources shall conduct a study of the long-term 26 viability of maintaining the state forest nurseries. Pursuant 27 to section 455A.13, the nurseries must establish by rule sale 28 prices offered for plants that cover all expenses related to 29 the growing of the plants. The department shall submit a 30 report, including findings, recommendations, and any proposed 31 legislation, to the governor and the joint appropriations 32 subcommittee on agriculture and natural resources not later 33 than December 1, 2016. 34 Sec. 23. FEASIBILITY OF ELECTRONIC SYSTEMS AT STATE PARKS. 35 -20- LSB 5011JB (2) 86 da/rn 20/ 28

The department of natural resources shall conduct a study 1 of the feasibility of installing electronic systems at the 2 entrances of areas located within the department’s jurisdiction 3 for the exclusive purpose of allowing the department to more 4 efficiently collect user fees from individuals who enter 5 those areas by motor vehicle. The department shall consider 6 different types of electronic systems that are practical to 7 install and provide a cost-savings to the state during the 8 lifespan of the electronic system. 9 2. As part of the study, the department shall also solicit 10 input from state park users and state park supporter groups 11 regarding their willingness to pay additional fees to provide 12 funding for the maintenance and operations of state parks. 13 3. The department shall submit a report regarding the 14 study, including findings, recommendations, and any proposed 15 legislation, to the governor and the joint appropriations 16 subcommittee on agriculture and natural resources not later 17 than January 15, 2017. 18 Sec. 24. EFFECTIVE UPON ENACTMENT. This division of this 19 Act, being deemed of immediate importance, takes effect upon 20 enactment. 21 DIVISION VIII 22 STATUTORY CHANGES —— ANIMAL AGRICULTURE —— CIVIL PENALTIES 23 Sec. 25. Section 455B.109, subsection 5, paragraph b, Code 24 2016, is amended to read as follows: 25 b. Civil penalties assessed and collected by or on behalf of 26 the department and interest on the civil penalties as provided 27 in sections 459.602 , 459.603 , 459.604 , 459A.502 , and 459B.402 28 shall be deposited into credited to the watershed improvement 29 Iowa nutrient research fund created in section 466A.2 466B.46 . 30 Sec. 26. Section 459.603, Code 2016, is amended to read as 6 follows: 7 459.603 Water quality violations —— civil penalty. 8 A person who violates subchapter III shall be subject to 9 a civil penalty which shall be established, assessed, and 10 collected in the same manner as provided in section 455B.109 or 11 455B.191 . Any collected civil penalty collected and interest 12 on a civil penalty shall be deposited into credited to the 13 watershed improvement Iowa nutrient research fund created in 14 section 466A.2 466B.46 . 15 Sec. 28. Section 459.604, subsection 2, Code 2016, is 16 amended to read as follows: 17 2. Moneys assessed and collected in civil penalties and 18 interest earned on civil penalties, arising out of a violation 19 involving an animal feeding operation, shall be deposited into 20 credited to the watershed improvement Iowa nutrient research 21 fund created in section 466A.2 466B.46 . 22 Sec. 29. Section 459A.502, Code 2016, is amended to read as 23 follows: 24 459A.502 Violations —— civil penalty. 25 A person who violates this chapter shall be subject to 26 a civil penalty which shall be established, assessed, and 27 collected in the same manner as provided in section 455B.191 . 28 Any collected civil penalty collected and interest on a civil 29 penalty and interest on a civil penalty shall be deposited into 30 credited to the watershed improvement Iowa nutrient research 31 fund created in section 466A.2 466B.46 . A person shall not be 32 subject to a penalty under this section and a penalty under 33 section 459.603 for the same violation. 34 Sec. 30. Section 466A.2, subsection 1, paragraph b, 11 subparagraph (2), Code 2016, is amended to read as follows: 12 (2) The special account shall exclusively include moneys 13 that prior to the effective date of this division of this Act 14 were assessed and collected by or on behalf of the department 15 of natural resources as provided in sections 455B.109 , 459.602 , 16 459.603 , 459.604 , 459A.502 , and 459B.402 . Additionally, 17 payments of interest, recaptures of awards, and other 18 repayments to the account shall be deposited in the account. 19 Sec. 32. NEW SECTION . 466B.46 Iowa nutrient research fund 20 —— creation and purpose. 21 1. An Iowa nutrient research fund is created in the state 22 treasury under the management and control of the center. 23 2. The fund shall include all of the following: 24 a. Moneys appropriated by the general assembly. 25 b. Moneys assessed and collected by or on behalf of the 26 department of natural resources to be credited to the fund 27 as provided in sections 455B.109, 459.602, 459.603, 459.604, 28 459A.502, and 459B.402. 29 c. Moneys accepted by the center from public or private 30 sources. 31 3. Moneys in the fund are appropriated to the center and 32 shall be used exclusively by the center to carry out its 33 purpose as described in section 466B.47. 34 4. a. Notwithstanding section 12C.7, interest or earnings 35 -23- LSB 5011JB (2) 86 da/rn 23/ 28

EFFECTIVE UPON ENACTMENT. This division of this 6 Act, being deemed of immediate importance, takes effect upon 7 enactment. 8 DIVISION IX 9 STATUTORY CHANGES —— WATERSHED IMPROVEMENT REVIEW BOARD 10 SUSPENSION OF NEW ACTIVITIES 11 Sec. 34. WATERSHED IMPROVEMENT REVIEW BOARD. 12 1. The watershed improvement review board as established in 13 section 466A.3 and the division of soil conservation and water 14 quality of the department of agriculture and land stewardship 15 shall not establish any new activity, including a project, 16 on or after the effective date of this division of this Act, 17 that otherwise could be conducted under chapter 466A. The 18 board and the division shall administer ongoing activities, 19 including projects, established prior to the effective date of 20 this division of this Act until the activities are concluded 21 by their own terms. 22 2. Any unobligated and unexpended moneys in the watershed 23 improvement fund created in section 466A.2 shall not be 24 expended for any purpose, except as necessary to administer 25 ongoing activities, including projects, conducted under chapter 26 466A, by the board and the division as described in subsection 27 1. The board may expend moneys in the fund as necessary to 28 pay for any reasonable overrun associated with an activity, 29 including a project, established prior to the effective date 30 of this division of this Act. 31 Sec. 35. EFFECTIVE UPON ENACTMENT. This division of this 32 Act, being deemed of immediate importance, takes effect upon 33 enactment. 34 DIVISION X 35 -24- LSB 5011JB (2) 86 da/rn 24/ 28
S.F. _____ H.F. _____ STATUTORY CHANGES —— DEPARTMENT OF AGRICULTURE AND LAND 1 STEWARDSHIP —— NUTRIENT REDUCTION PILOT PROJECT 2 Sec. 36. REVERSE AUCTION. The department of agriculture and 3 land stewardship shall establish a pilot project to determine 4 the feasibility and cost-effectiveness of conducting reverse 5 auctions when allocating financial assistance to persons 6 seeking to establish practices that reduce the transport 7 of nutrients to surface water from nonpoint sources within 8 watersheds. The department shall advertise for bids, analyze 9 accepted bids, and award cost-share moneys to one or more 10 successful bidders based on a ranking that computes the 11 greatest benefit-to-cost ratio for all accepted bids. The 12 department shall prepare and submit a report regarding its 13 findings and recommendations to the governor and general 14 assembly not later than January 13, 2017. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 GENERAL. This bill relates to agriculture and natural 19 resources by making appropriations for the fiscal year 20 2016-2017 to support related entities, including the department 21 of agriculture and land stewardship (DALS), the department of 22 natural resources (DNR), and Iowa state university of science 23 and technology (ISU). 24 The bill primarily appropriates moneys to DALS and DNR. 25 The appropriations are made to support those departments for 26 administration, regulation, and support of programs. The bill 27 requires the departments to submit quarterly reports to the 28 general assembly and department of management regarding the 29 expenditure of appropriated moneys. The bill also provides 30 moneys to support specific programs or projects administered by 31 those departments. The bill appropriates moneys from a number 32 of sources, including the general fund of the state, the state 33 fish and game protection fund, the groundwater protection fund 34 (Code section 455E.11), and the environment first fund (Code 35 -25- LSB 5011JB (2) 86 da/rn 25/ 28

For DALS, moneys are 2 appropriated from the general fund in order to support its 3 administrative divisions. Moneys are transferred to ISU to 4 support its midwest grape and wine institute. 5 Moneys are appropriated from a number of other sources to 6 DALS in order to support designated purposes, including moneys 7 derived from unclaimed winnings from horse and dog races, for 8 administration and enforcement of racing regulations (Code 9 section 99D.22); and moneys credited to the renewable fuel 10 infrastructure fund (Code section 159A.16), for purposes of 11 motor fuel inspection and auditing biofuel processing and 12 production (Code chapter 214A). 13 Moneys are appropriated from the general fund of the state 14 to DALS in order to support specific purposes including 15 milk inspection (Code section 192.109), the local food and 16 farm program (Code chapter 267A), an agricultural education 17 organization, and assistance to farmers with disabilities. 18 DALS —— GENERAL FUND APPROPRIATIONS —— WATER QUALITY 19 INITIATIVE. Moneys are appropriated from the general fund of 20 the state to DALS for deposit in the water quality initiative 21 fund (Code section 466B.45), including to support high-priority 22 watershed projects. 23 DNR —— GENERAL FUND AND OTHER MAJOR FUNDS APPROPRIATIONS. 24 Moneys are appropriated from a number of funds to DNR in order 25 to support its administrative divisions involving natural 26 resources and environmental protection, including from the 27 general fund of the state, the state fish and game protection 28 fund, and the groundwater protection fund. 29 Moneys are appropriated from a number of sources to support 30 designated purposes, including moneys deposited in the 31 special snowmobile fund (Code section 321G.7) to provide for 32 administering and enforcing the state snowmobile programs; and 33 moneys deposited in the unassigned revenue fund for purposes 34 of paying for administration of the department’s underground 35 -26- LSB 5011JB (2) 86 da/rn 26/ 28
S.F. _____ H.F. _____ storage tanks section. 1 Moneys are appropriated from the general fund of the state to 2 DNR in order to support specific purposes including floodplain 3 management and dam safety and forestry health management 4 programs. 5 ISU —— SPECIAL GENERAL FUND AND OTHER FUNDS APPROPRIATIONS. 6 Moneys are appropriated from the general fund of the state 7 to ISU to support the operation of its veterinary diagnostic 8 laboratory. Moneys are also appropriated to ISU to support the 9 Iowa nutrient research center (Code section 466B.47). 10 DALS AND DNR —— ENVIRONMENT FIRST FUND APPROPRIATIONS. 11 Moneys are appropriated from the environment first fund (Code 12 section 8.57A) to support a number of programs administered by 13 DALS and DNR. For DALS, the moneys are appropriated to support 14 programs involving soil and water conservation, watershed 15 protection and nutrient management, and the loess hills 16 development and conservation fund (Code section 161D.2); and 17 for DNR, moneys are appropriated to support programs involving 18 state parks, geographic information system data, water quality, 19 public water supplies, regulation of animal feeding operations, 20 air quality, and a geological and water survey. 21 REAP —— ENVIRONMENT FIRST FUND IN LIEU OF GENERAL FUND 22 APPROPRIATION. Moneys are appropriated from the environment 23 first fund (Code section 8.57A) to the Iowa resources 24 enhancement and protection fund in lieu of the standing limited 25 appropriation of $20 million (Code section 455A.18). 26 STATUTORY CHANGES —— DNR STUDIES. DNR must conduct a study 27 of the long-term viability of maintaining the state forest 28 nurseries. It must also conduct a study of the feasibility of 29 installing electronic systems to allow it to collect user fees 30 from individuals to enter into state lands. As part of that 31 study, DNR must solicit input from state park users and state 32 park supporter groups regarding their willingness to provide 33 additional funding for the maintenance and operations of state 34 parks. S.F. _____ H.F. _____ STATUTORY CHANGES —— ANIMAL AGRICULTURE —— CIVIL PENALTIES. 1 Civil penalties that are assessed and collected by DNR are 2 to be credited to an Iowa nutrient research fund to support 3 the Iowa nutrient research center. Moneys from those civil 4 penalties are currently credited to the watershed improvement 5 fund to support the watershed improvement review board (Code 6 chapter 466A). The provisions take effect upon enactment. 7 STATUTORY CHANGES —— WATERSHED IMPROVEMENT REVIEW BOARD 8 SUSPENSION OF NEW ACTIVITIES. The watershed improvement review 9 board and DALS’ division of soil conservation and water quality 10 cannot establish any new activity, including a project, under 11 Code chapter 466A. The board and division must continue to 12 administer ongoing activities. The provisions take effect upon 13 enactment. 14 STATUTORY CHANGES —— NUTRIENT REDUCTION PILOT PROJECT 15 —— REVERSE AUCTION. DALS is required to establish a pilot 16 project to determine the feasibility and cost-effectiveness 17 of conducting reverse auctions when allocating financial 18 assistance to persons seeking to establish practices to reduce 19 the transport of nutrients from nonpoint sources. 20 -28- LSB 5011JB (2) 86 da/rn 28/ 28
