There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. (1) For deposit in the water quality initiative 14 fund created in section 466B.45 for purposes of supporting 15 the water quality initiative administered by the soil 16 conservation division as provided in section 466B.42, including 17 salaries, support, maintenance, and miscellaneous purposes, 18 notwithstanding section 8.57, subsection 5, paragraph “c”: 19 FY 2016-2017: 20 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,200,000 21 (2) (a) The moneys appropriated in this lettered 22 paragraph shall be used to support demonstration projects in 23 subwatersheds as designated by the department that are part 24 of high-priority watersheds identified by the water resources 25 coordinating council established pursuant to section 466B.3. 26 (b) The moneys appropriated in this lettered paragraph 27 shall be used to support demonstration projects in watersheds 28 generally, including regional watersheds, as designated by the 29 division and high-priority watersheds identified by the water 30 resources coordinating council established pursuant to section 31 466B.3. 32 (c) Of the moneys appropriated in this lettered paragraph, 33 $450,000 is allocated to the Iowa nutrient research center at 34 Iowa state university of science and technology for nutrient 35 -1- LSB 5028XG (8) 86 ec/tm 1/ 15

Of the 1 moneys allocated in this subparagraph division, not more than 2 $150,000 may be used for the operations and maintenance of the 3 nutrient water monitoring network. 4 (3) In supporting projects in subwatersheds and watersheds 5 as provided in subparagraph (2), subparagraph divisions (a) and 6 (b), all of the following shall apply: 7 (a) The demonstration projects shall utilize water quality 8 practices as described in the latest revision of the document 9 entitled “Iowa Nutrient Reduction Strategy” initially presented 10 in November 2012 by the department of agriculture and land 11 stewardship, the department of natural resources, and Iowa 12 state university of science and technology. 13 (b) The division shall implement demonstration projects 14 as provided in subparagraph division (a) by providing 15 for participation by persons who hold a legal interest in 16 agricultural land used in farming. To every extent practical, 17 the division shall provide for collaborative participation by 18 such persons who hold a legal interest in agricultural land 19 located within the same subwatershed. 20 (c) The division shall implement demonstration projects on 21 a cost-share basis as determined by the division. However, the 22 state’s share of the amount shall not exceed 50 percent of the 23 estimated cost of establishing the practice as determined by 24 the division or 50 percent of the actual cost of establishing 25 the practice, whichever is less. 26 (d) The demonstration projects shall be used to educate 27 other persons about the feasibility and value of establishing 28 similar water quality practices. The division shall promote 29 field day events for purposes of allowing interested persons to 30 establish water quality practices on their agricultural land. 31 (e) The division shall conduct water quality evaluations 32 within supported subwatersheds. Within a reasonable period 33 after accumulating information from such evaluations, the 34 division shall create an aggregated database of water quality 35 -2- LSB 5028XG (8) 86 ec/tm 2/ 15

Any information identifying a person holding a 1 legal interest in agricultural land or specific agricultural 2 land shall be a confidential record under section 22.7 . 3 (4) The moneys appropriated in this lettered paragraph 4 shall be used to support education and outreach in a manner 5 that encourages persons who hold a legal interest in 6 agricultural land used for farming to implement water quality 7 practices, including the establishment of such practices in 8 watersheds generally, and not limited to subwatersheds or 9 high-priority watersheds. 10 (5) The moneys appropriated in this lettered paragraph 11 may be used to contract with persons to coordinate the 12 implementation of efforts provided in this paragraph. 13 (6) The moneys appropriated in this lettered paragraph 14 may be used by the department to support urban soil and water 15 conservation efforts, which may include but are not limited 16 to management practices related to bioretention, landscaping, 17 the use of permeable or pervious pavement, and soil quality 18 restoration. The moneys shall be allocated on a cost-share 19 basis as provided in chapter 161A. 20 (7) Notwithstanding any other provision of law to the 21 contrary, the department may use moneys appropriated in 22 this lettered paragraph to carry out the provisions of this 23 paragraph on a cost-share basis in combination with other 24 moneys available to the department from a state or federal 25 source. 26 (8) Not more than 10 percent of the moneys appropriated in 27 this lettered paragraph may be used for costs of administration 28 and implementation of the water quality initiative administered 29 by the soil conservation division. 30 b. For purposes of section 8.33, unless specifically 12 provided otherwise, moneys appropriated in section 3, 13 subsection 8, paragraph “b”, of this division of this Act as 14 amended by 2012 Iowa Acts, chapter 1140, section 18 , that 15 remain unencumbered or unobligated at the close of the fiscal 16 year beginning July 1, 2014, shall not revert but shall remain 17 available for the purpose designated until the close of the 18 fiscal year that begins July 1, 2016, or until the project for 19 which the appropriation was made is completed, whichever is 20 earlier. 21 3. For purposes of section 8.33, unless specifically 22 provided otherwise, unencumbered or unobligated moneys 23 appropriated in section 3, subsection 5, paragraph “a”, of this 24 division of this 2011 Act as amended by 2012 Iowa Acts, chapter 25 1140, section 17, and 2013 Iowa Acts, chapter 142, section 47, 26 shall not revert but shall remain available for the purpose 27 designated until the close of the fiscal year that begins July 28 1, 2019, or until the projects for which the appropriations 29 were made are completed, whichever is earlier. 30 Sec. 7. 2014 Iowa Acts, chapter 1136, section 1, subsection 31 7, paragraph b, is amended to read as follows: 32 b. EFFECTIVE UPON ENACTMENT. This division of this 9 Act, being deemed of immediate importance, takes effect upon 10 enactment. 11 DIVISION V 12 MISCELLANEOUS PROVISIONS 13 Sec. 9. Section 8.57C, subsection 3, paragraph a, 14 subparagraph (2), Code 2016, is amended to read as follows: 15 (2) The fiscal year beginning July 1, 2016 2017 , and for 16 each subsequent fiscal year thereafter. 17 Sec. 10. Section 12.79, subsection 3, Code 2016, is amended 18 to read as follows: 19 3. Moneys in the fund in a fiscal year shall be used as 20 appropriated by the general assembly for prison improvement and 21 prison construction projects. However, for the fiscal year 22 beginning July 1, 2016, any unobligated and unencumbered moneys 23 in the fund from the previous fiscal year are appropriated to 24 the department of corrections for major maintenance projects. 25 Sec. 11. IOWA COMMUNICATIONS NETWORK —— AUTHORIZATION 26 FOR CONTRACTS. Pursuant to section 8D.11, subsection 1, 27 paragraph “a”, the general assembly authorizes the Iowa 28 telecommunications and technology commission to enter into a 29 contract or contracts in excess of the contract limitation 30 amount established in section 8D.11, subsection 1, paragraph 31 “c”, for purposes of the commission’s network core upgrade 32 project. This authorization applies for the duration of the 33 commission’s project and to all existing or future contracts 34 associated with the project, whether or not the award is made 35 -13- LSB 5028XG (8) 86 ec/tm 13/ 15

The following provision 2 of this division of this Act, being deemed of immediate 3 importance, takes effect upon enactment: 4 1. The section of this division of this Act authorizing the 5 Iowa telecommunications and technology commission to enter into 6 a contract or contracts. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill relates to and makes appropriations to state 11 departments and agencies from the rebuild Iowa infrastructure 12 fund and the state bond repayment fund, and provides for 13 related matters. The bill is organized by divisions. 14 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 15 division appropriates project funding for FY 2016-2017 16 from the rebuild Iowa infrastructure fund for projects for 17 the departments of administrative services, agriculture 18 and land stewardship, cultural affairs, natural resources, 19 public defense, and transportation, and for the economic 20 development authority, treasurer of state, and the board of 21 regents. The division appropriates project funding for FY 22 2016-2017, FY 2017-2018, and FY 2018-2019 from the rebuild 23 Iowa infrastructure fund for projects for the judicial branch 24 and state fair authority. The division appropriates project 25 funding for FY 2016-2017, FY 2017-2018, FY 2018-2019, FY 26 2019-2020, and FY 2020-2021 for projects for the department of 27 cultural affairs. 28 DIVISION II —— REBUILD IOWA INFRASTRUCTURE FUND —— 29 TECHNOLOGY APPROPRIATIONS. This division appropriates project 30 funding for FY 2016-2017 from the rebuild Iowa infrastructure 31 fund for technology projects for the departments of education, 32 human rights, management, public health, homeland security and 33 emergency management, and public safety, and for the office 34 of chief information officer, Iowa telecommunications and 35 -14- LSB 5028XG (8) 86 ec/tm 14/ 15
S.F. _____ H.F. _____ technology commission, and secretary of state. 1 DIVISION III —— MISCELLANEOUS APPROPRIATIONS. This division 2 appropriates project funding for FY 2016-2017 from the state 3 bond repayment fund for the state board of regents. 4 DIVISION IV —— CHANGES TO PRIOR APPROPRIATIONS. This 5 division provides for the reversion of certain unencumbered 6 or unobligated moneys appropriated from the technology 7 reinvestment fund to the department of human services 8 for FY 2011-2012 through FY 2014-2015. The division also 9 makes a change to moneys appropriated from the rebuild Iowa 10 infrastructure fund to the board of regents for a project at 11 the state university of Iowa for FY 2016-2017 and FY 2017-2018. 12 The division takes effect upon enactment. 13 DIVISION V —— MISCELLANEOUS PROVISIONS. Code section 8.57C, 14 concerning the technology reinvestment fund, is amended to 15 provide that the appropriation to the fund from the general 16 fund for fiscal years beginning on or after July 1, 2016, is 17 changed to fiscal years beginning on or after July 1, 2017. 18 Code section 12.79, concerning the FY 2009 prison bonding 19 fund, is amended to provide that for FY 2016-2017, any 20 unobligated and unencumbered moneys in the fund from the 21 previous fiscal year are appropriated to the department of 22 corrections for major maintenance projects. 23 The division also authorizes the Iowa telecommunications and 24 technology commission to enter into a contract or contracts 25 in excess of the statutory contract limitation amount for 26 purposes of the commission’s network core upgrade project. 27 This provision of this division of the bill takes effect upon 28 enactment. 29 -15- LSB 5028XG (8) 86 ec/tm 15/ 15
