Section
356.15,
Code
2016,
is
amended
to
read
as
1
follows:

356.15
Expenses.
3
1.
All
charges
Charges
and
expenses
for
the
safekeeping
4
and
maintenance
of
prisoners
shall
be
allowed
by
the
board
of
5
supervisors,
except
those
for
the
following:
6
a.
A
person
committed
or
detained
by
the
authority
of
the
7
courts
of
the
United
States,
in
which
cases
case
the
United
8
States
must
pay
such
expenses
to
the
county
,
or
those
.
9
b.
A
person
committed
for
violation
of
a
city
ordinance,
in
10
which
case
the
city
shall
pay
expenses
to
the
county
,
or
those
.
11
c.
A
person
committed
or
detained
from
another
state,
in
12
which
case
the
governmental
entity
from
the
other
state
sending
13
the
prisoners
shall
pay
expenses
to
the
county.

2.
a.
Charges
and
expenses
for
the
safekeeping
and
15
maintenance
of
prisoners
shall
not
include
the
cost
of
16
providing
inpatient
or
outpatient
medical
care
when
a
prisoner
17
receives
such
care
prior
to
sentencing
at
an
off-site
hospital
18
or
other
off-site
medical
facility.

b.
The
medical
care
costs
incurred
by
a
prisoner
prior
to
20
sentencing
at
an
off-site
hospital
or
other
off-site
medical
21
facility
shall
remain
with
the
prisoner
or
other
responsible
22
party.
For
the
purposes
of
this
subsection,
“responsible
23
party”
includes
but
is
not
limited
to,
as
applicable,
a
private
24
insurer,
Medicaid,
or
any
other
party
legally
responsible
for
25
the
medical
care
costs.
If
no
other
responsible
party
exists,
26
the
off-site
hospital
or
other
off-site
medical
facility
shall,
27
through
all
reasonable
means,
attempt
to
collect
such
medical
28
care
costs
from
the
prisoner.

inclusion

does
not
constitute

This
bill
relates
to
the
charges
and
expenses
incurred
by
a

prisoners.

The
bill
modifies
Code
section
356.15
by
prohibiting
the

by
a
county
on
behalf
of
a

prisoner
who
receives
inpatient
or
outpatient
medical
care

prior
to
sentencing
at
an
off-site
hospital

off-site
medical

facility.

The
bill
provides
that
the
medical
care
costs
incurred
by
a
5
prisoner
prior
to
sentencing
at
an
off-site
hospital
or
other
6
off-site
medical
facility
shall
remain
with
the
prisoner
or
7
other
responsible
party.
The
bill
defines
“responsible
party”
8
as
including
but
not
limited
to
a
private
insurer,
Medicaid,
9
or
any
other
party
legally
responsible
for
the
medical
care
10
costs.
The
bill
further
provides
that
if
no
other
responsible
11
party
exists,
the
off-site
hospital
or
other
off-site
medical

bill
also
makes
changes
to
Code
section
356.15
to
