2016,
is
amended
to
read
as
follows:

risk
assessment
has
been
completed
and
the

(1)
The
sex
offender
was
has
been
classified
as
a
low
risk
5
to
reoffend
if
the
offender
was
eighteen
years
of
age
or
older

when
the
sex
offense
was
committed
.

(2)
The
risk
assessment
used
to
assess
an
offender
as
a
low
8
risk
to
reoffend
shall
be
a
validated
risk
assessment
approved
9
by
the
department
of
corrections.

692A.128,
subsection
3,
Code
2016,
is

amended
to
read
as
follows:

The
application
shall
be
filed
in
the
sex
offender’s

county
of
principal
residence
,
or
in
the
county
where
the
14
conviction
occurred
if
the
sex
offender
no
longer
resides
in
15
this
state
and
has
been
placed
on
inactive
status
.

This
bill
relates
to
the
modification
of
the
sex
offender
20
registration
requirements.

Current
law
provides
that
if
a
sex
offender
applies
to
modify
22
the
sex
offender
registration
requirements
pursuant
to
Code
23
section
692A.128,
the
offender
is
required
to
be
assessed
a
low
24
risk
to
reoffend.
The
bill
modifies
the
low
risk
to
reoffend
25
requirement
by
specifying
that
a
person
is
required
to
be
26
assessed
a
low
risk
to
reoffend
if
the
person
was
18
years
of
27
age
or
older
when
the
sex
offense
requiring
registration
was
28
committed.
29
The
bill
provides
that
a
sex
offender
applying
to
modify
the
30
sex
offender
registry
requirements
pursuant
to
Code
section
31
692A.128
may
file
the
application
in
the
county
where
the
32
conviction
for
the
sex
offense
occurred
if
the
offender
has
33
been
placed
on
inactive
status
under
Code
section
692A.106(7)
34
and
no
longer
resides
in
this
state.
