S.F. _____ DIVISION I 1 ENHANCE IOWA 2 Section 1. Section 15F.101, subsection 2, Code 2016, is 3 amended to read as follows: 4 2. “Board” means the vision enhance Iowa board as created 5 in section 15F.102 . 6 Sec. 2. Section 15F.102, Code 2016, is amended by striking 7 the section and inserting in lieu thereof the following: 8 15F.102 Enhance Iowa board. 9 1. An enhance Iowa board is established consisting of the 10 members described in subsection 2. The board is located within 11 the authority for administrative purposes. The director of the 12 authority shall provide office space, staff assistance, and 13 necessary supplies and equipment for the board. The director 14 shall budget moneys to cover the compensation and expenses 15 of the board. In performing its functions, the board is 16 performing a public function on behalf of the state and is a 17 public instrumentality of the state. 18 2. The board shall consist of the following voting members 19 appointed by the governor: 20 a. Two members from each United States congressional 21 district in the state as established in section 40.1. 22 b. Three members from the state at large. 23 3. a. Of the voting members appointed pursuant to 24 subsection 2, the governor shall appoint the following: 25 (1) One person selected by the board of the Iowa natural 26 heritage foundation. 27 (2) One person with professional experience in finance or 28 investment banking. 29 (3) One person with professional experience in the tourism 30 industry. 31 (4) One person with professional experience in architecture 32 or historic preservation. 33 (5) One person with professional experience in cultural 34 attractions and programming. 35 -1- LSB 5814XC (7) 86 aw/sc 1/ 18
S.F. _____ (6) Six persons actively employed in the private, 1 for-profit sector of the economy who have substantial expertise 2 in economic development. 3 b. The governor shall appoint the voting members pursuant to 4 subsection 2, subject to sections 69.16, 69.16A, and 69.16C, 5 and subject to confirmation by the senate. 6 c. The members appointed pursuant to subsection 2 shall 7 be appointed to two-year staggered terms and the terms shall 8 commence and end as provided by section 69.19. If a vacancy 9 occurs, a successor shall be appointed to serve the unexpired 10 term. A successor shall be appointed in the same manner and 11 subject to the same qualifications as the original appointment 12 to serve the unexpired term. 13 4. In addition to the voting members, the membership of 14 the board shall include four members of the general assembly 15 with one member designated by each of the following: the 16 majority leader of the senate, the minority leader of the 17 senate, the speaker of the house of representatives, and the 18 minority leader of the house of representatives. A legislative 19 member serves for a term as provided in section 69.16B in an ex 20 officio, nonvoting capacity. 21 5. a. In addition to the voting members, the membership 22 of the board shall include the following ex officio, nonvoting 23 members: 24 (1) The director of the economic development authority or 25 the director’s designee. 26 (2) The director of the department of transportation or the 27 director’s designee. 28 (3) The director of the department of natural resources or 29 the director’s designee. 30 (4) The director of the department of cultural affairs or 31 the director’s designee. 32 b. A person serving as a designee pursuant to paragraph 33 “a” shall serve a one-year term as an ex officio, nonvoting 34 member of the board. A designee whose term has expired may be 35 -2- LSB 5814XC (7) 86 aw/sc 2/ 18
S.F. _____ redesignated. 1 6. The governor shall designate the chairperson and vice 2 chairperson of the board from the members appointed pursuant 3 to subsection 2. In the case of absence or disability of the 4 chairperson and vice chairperson, the members of the board 5 shall elect a temporary chairperson by a majority vote of those 6 members who are present and voting. 7 7. Each voting member of the board shall serve on one of the 8 two review committees described in sections 15F.203, subsection 9 2, and 15F.304, subsection 2. 10 8. A majority of the total voting membership of the board 11 constitutes a quorum. 12 Sec. 3. Section 15F.103, Code 2016, is amended by adding the 13 following new subsections: 14 NEW SUBSECTION . 3A. Oversee the administration by the 15 authority of the sports tourism program pursuant to this 16 chapter. 17 NEW SUBSECTION . 3B. Oversee the administration of the river 18 enhancement community attraction and tourism program pursuant 19 to this chapter. 20 Sec. 4. Section 15F.104, Code 2016, is amended to read as 21 follows: 22 15F.104 Authority duties. 23 The authority, subject to approval by the board, shall 24 adopt administrative rules pursuant to chapter 17A necessary 25 to administer the community attraction and tourism program 26 and the vision Iowa program the programs established pursuant 27 to this chapter . The authority shall provide the board with 28 assistance in implementing administrative functions, marketing 29 the programs, providing technical assistance and application 30 assistance to applicants under the programs, negotiating 31 contracts, and providing project follow-up. The authority, 32 in cooperation with the treasurer of state, may conduct 33 negotiations on behalf of the board with applicants regarding 34 terms and conditions applicable to awards under the programs. 35 -3- LSB 5814XC (7) 86 aw/sc 3/ 18
S.F. _____ Sec. 5. NEW SECTION . 15F.107 Enhance Iowa fund and 1 appropriation. 2 1. a. The authority shall establish a fund pursuant to 3 section 15.106A, subsection 1, paragraph “o” , for purposes of 4 allocating moneys to the programs described in this section. 5 A fund established for purposes of this section may be 6 administered as a revolving fund and may consist of any moneys 7 appropriated by the general assembly for purposes of this 8 section and any other moneys that are lawfully available to the 9 authority. 10 b. Notwithstanding section 8.33, at the end of each fiscal 11 year moneys in a fund established for purposes of this section 12 shall not revert to any other fund but shall remain in the fund 13 for expenditure for subsequent fiscal years. 14 c. Notwithstanding section 12C.7, subsection 2, interest or 15 earnings on moneys in the fund shall be credited to the fund. 16 Repayments and recaptures of program moneys shall be credited 17 to the fund. 18 2. Commencing with appropriations made by this section for 19 the fiscal year beginning July 1, 2016, and for each fiscal 20 year thereafter, not to exceed a total of ten fiscal years, 21 if moneys are transferred to the general fund of the state 22 pursuant to section 8.55, subsection 2, paragraph “b” , during 23 a fiscal year in an amount that exceeds one hundred million 24 dollars, there is appropriated from the general fund of the 25 state to the authority for deposit in the fund created pursuant 26 to subsection 1, for that fiscal year, twenty-five million 27 dollars to be used for the purposes designated in subsection 3. 28 3. For each fiscal year in which moneys are appropriated to 29 the fund pursuant to subsection 2, the authority shall allocate 30 the moneys in the fund for the following purposes and in the 31 following amounts: 32 a. For purposes of administration, marketing enhance Iowa 33 programs, expenses, and compensation of board members, two 34 hundred fifty thousand dollars. 35 -4- LSB 5814XC (7) 86 aw/sc 4/ 18
S.F. _____ b. For deposit in the sports program fund established 1 pursuant to section 15F.402, one million dollars. 2 c. For deposit in the community attraction and tourism fund 3 established pursuant to section 15F.204, two million dollars. 4 d. For deposit in the river enhancement community attraction 5 and tourism fund established pursuant to section 15F.205, two 6 million dollars. 7 e. For allocation as grants, at the discretion of the 8 board, to the department of natural resources, the department 9 of transportation, or the department of agriculture and land 10 stewardship as follows: 11 (1) For purposes of improving state parks infrastructure, 12 financing low head dam mitigation or removal projects, or 13 funding projects under the natural resources account created in 14 section 461.32 in the natural resources and outdoor recreation 15 trust fund, two million dollars. 16 (2) For purposes of funding projects under the watershed 17 protection account created in section 461.34 in the natural 18 resources and outdoor recreation trust fund, two million 19 dollars. 20 (3) For purposes of funding projects under the trails 21 account created in section 461.37 in the natural resources and 22 outdoor recreation trust fund, two million dollars. 23 (4) The departments of natural resources, transportation, 24 and agriculture and land stewardship shall submit applications 25 to the board for each project to be funded pursuant to this 26 paragraph “e” . The board shall prioritize the projects and 27 negotiate with the departments on which projects to fund 28 pursuant to this paragraph “e” . 29 f. For allocation to the funds, programs, and purposes 30 described in paragraphs “a” through “e” , at the discretion of 31 the board, thirteen million seven hundred fifty dollars. 32 4. If, at any point in a fiscal year, the board determines 33 that demand for any one of the purposes described in subsection 34 3 will not meet or exceed the amounts initially allocated, the 35 -5- LSB 5814XC (7) 86 aw/sc 5/ 18
S.F. _____ board may reallocate amounts from one purpose to any of the 1 other purposes for that fiscal year or may carry the moneys 2 allocated to any one purpose over to a future fiscal year for 3 that same purpose in the next fiscal year. 4 5. The authority shall submit a report to the general 5 assembly and the governor’s office each year describing the use 6 of moneys appropriated pursuant to this section and the results 7 achieved under each of the programs receiving fund moneys. 8 Sec. 6. Section 15F.203, subsection 2, Code 2016, is amended 9 to read as follows: 10 2. A review committee composed of five members of the 11 board shall review community attraction and tourism program 12 applications submitted to the board and make recommendations 13 regarding the applications to the board. The review committee 14 shall consist of members of the board listed in , with one 15 member from each congressional district under section 15F.102, 16 subsection 2 , paragraphs paragraph “a” through “c” , and 17 one member from the state at large under section 15F.102, 18 subsection 2, paragraph “b” . 19 Sec. 7. Section 15F.204, subsection 8, Code 2016, is amended 20 by striking the subsection. 21 Sec. 8. Section 15F.304, subsection 2, Code 2016, is amended 22 to read as follows: 23 2. A review committee composed of eight six members of 24 the board shall review vision Iowa program applications and 25 river enhancement community attraction and tourism project 26 applications submitted to the board and make recommendations 27 regarding the applications to the board. The review committee 28 shall consist of members of the board listed in , with one 29 member from each congressional district under section 15F.102, 30 subsection 2 , paragraphs “d” through “h” paragraph “a” , and 31 two members from the state at large under section 15F.102, 32 subsection 2, paragraph “b” . 33 Sec. 9. NEW SECTION . 15F.401 Sports tourism program. 34 1. a. The authority shall establish, and, at the direction 35 -6- LSB 5814XC (7) 86 aw/sc 6/ 18
S.F. _____ of the board, shall administer a sports tourism program 1 to provide financial assistance for projects that promote 2 sporting events for accredited colleges and universities and 3 professional sporting events in the state. 4 b. For purposes of this section: 5 (1) “District” means a regional sports authority district 6 certified under section 15E.321. 7 (2) “Financial assistance” means assistance provided only 8 from the funds, rights, and assets legally available to the 9 authority or the board and includes but is not limited to 10 assistance in the form of grants, loans, and forgivable loans. 11 c. The authority, by rule, shall define “accredited colleges 12 and universities” , in consultation with the college student aid 13 commission. 14 2. a. A convention and visitors bureau or a district 15 may apply to the authority for financial assistance for a 16 project that actively and directly promotes sporting events for 17 accredited colleges and universities and professional sporting 18 events in the area served by the convention and visitors bureau 19 or the district. 20 b. A convention and visitors bureau or a district may apply 21 for and receive financial assistance for more than one project. 22 c. A convention and visitors bureau or a district may apply 23 for financial assistance for a project that spans multiple 24 fiscal years or may apply for renewal of financial assistance 25 awarded in a prior year if all applicable contractual 26 requirements are met. The decision as to whether to renew 27 an award shall be at the discretion of the board. The board 28 may adopt by rule certain metrics and return on investment 29 estimates for purposes of this paragraph. The authority may 30 include such metrics and estimates in a program agreement 31 executed pursuant to this section. 32 d. A convention and visitors bureau may apply to the 33 board for financial assistance pursuant to this section and 34 a district may apply to the authority for district financial 35 -7- LSB 5814XC (7) 86 aw/sc 7/ 18
S.F. _____ assistance, but a convention and visitors bureau shall not in 1 the same year receive financial assistance under the program 2 created in this section and financial assistance as part of a 3 district. 4 3. a. The authority shall forward all applications received 5 pursuant to this section to the board, and the board shall 6 review the applications and award financial assistance on a 7 competitive basis. 8 b. The board shall consider the following when awarding 9 financial assistance: 10 (1) Impact of the project on the local, regional, and state 11 economies. 12 (2) Potential to attract Iowans and out-of-state visitors. 13 (3) Amount of positive advertising or media coverage the 14 project generates. 15 (4) Quality, size, and scope of the project. 16 (5) Ratio of public-to-private investment. 17 4. An applicant shall demonstrate matching funds in order 18 to receive financial assistance pursuant to this section. The 19 amount of matching funds that may be required shall be at the 20 board’s discretion. The board may waive this requirement for 21 good cause shown. 22 5. The board shall make final funding decisions on 23 each application and may approve, deny, defer, or modify 24 applications for financial assistance under the program, in 25 its discretion, in order to fund as many projects with the 26 moneys available as possible. The board and the authority may 27 negotiate with applicants regarding the details of projects and 28 the amount and terms of any award. In making final funding 29 decisions pursuant to this subsection, the board and the 30 authority are exempt from chapter 17A. 31 6. a. A convention and visitors bureau or district may use 32 financial assistance received under the program for marketing, 33 promotions, infrastructure, and other purposes directly related 34 to the promotion and operation of the sporting event. S.F. _____ an activity or individual cost item is directly related to the 1 promotion and operation of the sporting event shall be within 2 the discretion of the authority. 3 b. All applications to the board for financial assistance 4 shall be made at least ninety days prior to an event’s 5 scheduled date. A convention and visitors bureau or district 6 shall not use financial assistance received under the program 7 as reimbursement for completed projects. 8 7. A convention and visitors bureau or district receiving 9 financial assistance shall provide an annual report to the 10 authority for years in which it receives financial assistance 11 under this section. The report shall include the information 12 the authority deems relevant. 13 8. Each applicant receiving an award of financial 14 assistance from the board shall enter into an agreement with 15 the authority. The agreement shall contain such terms and 16 conditions as the board may place on the award or the authority 17 may deem necessary for the efficient administration of the 18 program established in this subchapter. 19 9. The authority, with the approval of the board, may adopt 20 rules for the administration of this subchapter. 21 Sec. 10. NEW SECTION . 15F.402 Sports program fund. 22 1. a. The authority shall establish a fund pursuant to 23 section 15.106A, subsection 1, paragraph “o” , for purposes 24 of financing sports tourism projects as described in this 25 subchapter. The fund established for purposes of this section 26 may be administered as a revolving fund and may consist of any 27 moneys appropriated by the general assembly for purposes of 28 this section and any other moneys that are lawfully available 29 to the authority. 30 b. Notwithstanding section 8.33, moneys in a fund 31 established for purposes of this section at the end of each 32 fiscal year shall not revert to any other fund but shall remain 33 in the fund for expenditure for subsequent fiscal years. 34 c. Notwithstanding section 12C.7, subsection 2, interest or 35 -9- LSB 5814XC (7) 86 aw/sc 9/ 18
S.F. _____ earnings on moneys in the fund shall be credited to the fund. 1 2. a. Moneys in the fund are appropriated to the authority 2 for purposes of providing financial assistance to convention 3 and visitors bureaus and districts under the sports tourism 4 program established and administered pursuant to this 5 subchapter. 6 b. The board in its discretion shall allocate the available 7 moneys in the fund among the programs described in paragraph “a” 8 in the amounts determined by the board. 9 DIVISION II 10 CONFORMING PROVISIONS 11 Sec. 11. Section 12.71, subsection 1, Code 2016, is amended 12 to read as follows: 13 1. The treasurer of state may issue bonds upon the request 14 of the vision enhance Iowa board created in section 15F.102 and 15 do all things necessary with respect to the purposes of the 16 vision Iowa fund. The treasurer of state shall have all of 17 the powers which are necessary to issue and secure bonds and 18 carry out the purposes of the fund. The treasurer of state may 19 issue bonds in principal amounts which, in the opinion of the 20 board, are necessary to provide sufficient funds for the vision 21 Iowa fund created in section 12.72 , the payment of interest 22 on the bonds, the establishment of reserves to secure the 23 bonds, the costs of issuance of the bonds, other expenditures 24 of the treasurer of state incident to and necessary or 25 convenient to carry out the bond issue for the fund, and all 26 other expenditures of the board necessary or convenient to 27 administer the fund; provided, however, excluding the issuance 28 of refunding bonds, bonds issued pursuant to this section shall 29 not be issued in an aggregate principal amount which exceeds 30 three hundred million dollars. The bonds are investment 31 securities and negotiable instruments within the meaning of and 32 for purposes of the uniform commercial code, chapter 554 . 33 Sec. 12. Section 12.72, subsection 1, Code 2016, is amended 34 to read as follows: 35 -10- LSB 5814XC (7) 86 aw/sc 10/ 18
S.F. _____ 1. A vision Iowa fund is created and established as a 1 separate and distinct fund in the state treasury. The moneys 2 in the fund are appropriated to the vision enhance Iowa 3 board for purposes of the vision Iowa program established in 4 section 15F.302 . Moneys in the fund shall not be subject to 5 appropriation for any other purpose by the general assembly, 6 but shall be used only for the purposes of the vision Iowa 7 fund. The treasurer of state shall act as custodian of the 8 fund and disburse moneys contained in the fund as directed 9 by the vision enhance Iowa board, including automatic 10 disbursements of funds received pursuant to the terms of bond 11 indentures and documents and security provisions to trustees. 12 The fund shall be administered by the vision enhance Iowa 13 board which shall make expenditures from the fund consistent 14 with the purposes of the vision Iowa program without further 15 appropriation. An applicant under the vision Iowa program 16 shall not receive more than seventy-five million dollars in 17 financial assistance from the fund. 18 Sec. 13. Section 12.75, subsection 1, Code 2016, is amended 19 to read as follows: 20 1. The vision enhance Iowa board may undertake a project 21 for two or more applicants jointly or for any combination 22 of applicants, and may combine for financing purposes, with 23 the consent of all of the applicants which are involved, the 24 project and some or all future projects of any applicant, and 25 sections 12.71 , 12.72 , and 12.74 , this section , and sections 26 12.76 and 12.77 apply to and for the benefit of the vision 27 enhance Iowa board and the joint applicants. However, the 28 money set aside in a fund or funds pledged for any series or 29 issue of bonds or notes shall be held for the sole benefit 30 of the series or issue separate and apart from money pledged 31 for another series or issue of bonds or notes of the treasurer 32 of state. To facilitate the combining of projects, bonds or 33 notes may be issued in series under one or more resolutions or 34 trust agreements and may be fully open-ended, thus providing 35 -11- LSB 5814XC (7) 86 aw/sc 11/ 18
S.F. _____ for the unlimited issuance of additional series, or partially 1 open-ended, limited as to additional series. 2 Sec. 14. Section 15.108, subsection 5, paragraph c, Code 3 2016, is amended to read as follows: 4 c. Coordinate and develop with the department of 5 transportation, the department of natural resources, the 6 department of cultural affairs, the vision enhance Iowa 7 board, other state agencies, and local and regional entities 8 public interpretation, marketing, and education programs that 9 encourage Iowans and out-of-state visitors to participate in 10 the recreational and leisure opportunities available in Iowa. 11 The authority shall establish and administer a program that 12 helps connect both Iowa residents and residents of other states 13 to new and existing Iowa experiences as a means to enhance the 14 economic, social, and cultural well-being of the state. The 15 program shall include a broad range of new opportunities, both 16 rural and urban, including main street destinations, green 17 space initiatives, and artistic and cultural attractions. 18 Sec. 15. Section 15E.321, Code 2016, is amended by adding 19 the following new subsection: 20 NEW SUBSECTION . 3A. Each district may apply for and 21 receive financial assistance under the sports tourism program 22 established by the authority pursuant to section 15F.401. 23 DIVISION III 24 TRANSITION PROVISIONS 25 Sec. 16. BOARD COOPERATION —— TRANSITION PROVISIONS. The 26 economic development authority shall ensure the effective 27 transition of powers and duties from the vision Iowa board 28 to the enhance Iowa board in implementing this Act. The 29 initial members of the enhance Iowa board shall be appointed by 30 September 1, 2016. 31 EXPLANATION 32 The inclusion of this explanation does not constitute agreement with 33 the explanation’s substance by the members of the general assembly. 34 This bill relates to economic development by establishing 35 -12- LSB 5814XC (7) 86 aw/sc 12/ 18
S.F. _____ an enhance Iowa board to assume the powers and duties of 1 the vision Iowa board and additional powers and duties, 2 establishing an enhance Iowa fund, establishing a sports 3 tourism program and fund, and making appropriations. 4 Under the bill, the current vision Iowa board is replaced 5 with a new enhance Iowa board (board) to direct community 6 attraction and tourism development. The board is required 7 to be located within the Iowa economic development authority 8 (authority) for administrative purposes. The board is required 9 to consist of two members from each of the state’s four 10 congressional districts and three statewide members, appointed 11 by the governor and subject to confirmation by the senate. Of 12 these voting members, one person is required to be selected by 13 the board of the Iowa natural heritage foundation, one person 14 is required to have professional experience in finance or 15 investment banking, one person is required to have professional 16 experience in the tourism industry, one person is required 17 to have professional experience in architecture or historic 18 preservation, one person is required to have professional 19 experience in cultural attractions and programming, and six 20 persons are required to be actively employed in the private, 21 for-profit sector of the economy and each possess substantial 22 expertise in economic development. The bill requires that 23 each voting member of the board serve on one of two review 24 committees: the community attraction and tourism program 25 application review committee or the vision Iowa program and 26 river enhancement community attraction and tourism project 27 application review committee. 28 The board is also required to include four ex officio, 29 nonvoting legislative members and four ex officio, nonvoting 30 executive branch representatives. The ex officio executive 31 branch members are to include the director of the economic 32 development authority, the director of the department of 33 transportation, the director of the department of natural 34 resources, the director of the department of cultural affairs, 35 -13- LSB 5814XC (7) 86 aw/sc 13/ 18
S.F. _____ or the designees of those directors. The bill provides for the 1 terms of all voting and nonvoting members, for the compensation 2 of members for expenses, for the filling of vacancies on the 3 board, and sets a quorum for the operation of the board. The 4 bill requires that the governor designate a chairperson and 5 vice chairperson of the board and makes provisions for the 6 election of a temporary chairperson in case of absence or 7 disability of the chairperson and vice chairperson. 8 Under the bill, the board assumes responsibility for 9 overseeing programs previously under the vision Iowa board. 10 The bill also requires that the board oversee a sports tourism 11 program and fund and oversee the community attraction and 12 tourism program and community attraction and tourism fund and 13 the river enhancement community attraction and tourism fund. 14 The bill requires the authority to establish an enhance Iowa 15 fund and provides for a contingent fiscal year appropriation of 16 $25 million from the general fund of the state to the enhance 17 Iowa fund. The bill provides for appropriations in that amount 18 for 10 fiscal years, beginning with the 2016-2017 fiscal year. 19 Under the bill, the $25 million appropriation occurs only if 20 the general fund receives a transfer of over $100 million 21 in that fiscal year from the Iowa economic emergency fund, 22 pursuant to Code section 8.55. Moneys in the fund shall not 23 revert to the general fund and interest and earnings on the 24 fund are required to be credited to the fund. 25 The bill requires that the authority allocate moneys in 26 the fund to specified funds or for specified purposes and 27 to provide an annual report to the general assembly and the 28 governor. The bill provides the board with discretion to 29 reallocate amounts from one purpose to other purposes, if it 30 determines that demand for one purpose will not meet or exceed 31 the amounts allocated for that purpose. The bill provides for 32 the following allocations in years when the fund receives an 33 allocation: 34 1. $250,000 for administration, expenses, and compensation 35 -14- LSB 5814XC (7) 86 aw/sc 14/ 18
S.F. _____ of board members, and marketing enhance Iowa programs. 1 2. $1 million for deposit in the sports program fund. 2 3. $2 million for deposit in the community attraction and 3 tourism fund. 4 4. $2 million for deposit in the river enhancement community 5 attraction and tourism fund. 6 5. $6 million for allocation as grants, at the discretion 7 of the board, to the department of natural resources, the 8 department of transportation, or the department of agriculture 9 and land stewardship. Of the $6 million, $2 million is 10 allocated for improving state parks infrastructure, financing 11 low head dam mitigation or removal projects, or funding 12 projects under the natural resources account in the natural 13 resources and outdoor recreation trust fund. Of the $6 14 million, $2 million is allocated for funding projects under 15 the watershed protection account in the natural resources and 16 outdoor recreation trust fund. Of the $6 million, the final 17 $2 million is allocated for funding projects under the trails 18 account in the natural resources and outdoor recreation trust 19 fund. Under the bill, the departments of natural resources, 20 transportation, and agriculture and land stewardship are 21 required to submit applications to the board for each project 22 to be funded from the $6 million allocation and the board is 23 required to prioritize the projects and negotiate with the 24 departments on which projects to fund. 25 6. $13.75 million for allocation, at the discretion of the 26 board, to the above-listed funds, programs, and purposes. 27 The bill requires the authority to establish a sports 28 tourism program, at the direction of the board. The program’s 29 purpose is to provide financial assistance for projects 30 that promote sporting events for accredited colleges and 31 universities and professional sporting events in the state. 32 The bill provides that the term “financial assistance” includes 33 assistance in the form of grants, loans, and forgivable loans. 34 The bill requires the authority to define the term “accredited 35 -15- LSB 5814XC (7) 86 aw/sc 15/ 18
S.F. _____ colleges and universities” by rule, in consultation with the 1 college student aid commission. 2 The bill establishes a sports tourism program. Under 3 the bill, a convention and visitors bureau (bureau) or a 4 regional sports authority district (district) may apply to the 5 authority for financial assistance for a project that actively 6 and directly promotes sporting events in the area served by 7 the bureau or district. The bill specifies that a bureau or 8 district may apply for and receive financial assistance for 9 more than one project, but a bureau shall not receive financial 10 assistance under the program and financial assistance under 11 the program as part of a district in the same year. The bill 12 specifies that a bureau or district may apply for financial 13 assistance for a project that spans multiple fiscal years or 14 may apply for renewal of financial assistance awarded in a 15 prior year. Under the bill, the board has the discretion as to 16 whether to renew an award. The bill provides that the board 17 may adopt certain metrics and return on investment estimates 18 for purposes of multiyear awards and renewal decisions. Under 19 the bill, a bureau may apply to the board for financial 20 assistance under the sports tourism program and a district, 21 under Code section 15E.321, may apply to the authority for 22 district financial assistance. 23 The bill requires the board to review the applications under 24 the sports tourism program and award financial assistance on a 25 competitive basis. The board is required to consider project 26 impacts, potential to attract Iowans and visitors, advertising 27 and media coverage, investment ratios, and the quality, size, 28 and scope of the project in awarding financial assistance 29 under the program. The bill requires that program applicants 30 demonstrate matching funds, but permits the board to waive this 31 requirement. 32 The bill requires that the board make final funding 33 decisions on each application and allows the board to approve, 34 deny, defer, or modify applications for financial assistance 35 -16- LSB 5814XC (7) 86 aw/sc 16/ 18
S.F. _____ under the program. The bill allows the board and the authority 1 to negotiate with applicants regarding the details of projects 2 and the amount and terms of any award. The bill specifies that 3 the board and the authority are exempt from Code chapter 17A in 4 making final funding decisions under the program. 5 Under the bill, a bureau or district receiving a sports 6 tourism program award may use financial assistance received 7 for marketing, promotions, infrastructure, and other purposes 8 directly related to the promotion and operation of the sporting 9 event. The bill requires that all applications for financial 10 assistance under the program be made at least 90 days prior to 11 an event’s scheduled date and prohibits a bureau or district 12 from using financial assistance received under the program as 13 reimbursement for completed projects. The bill requires that a 14 bureau or district receiving financial assistance provide an 15 annual report to the authority for years in which it receives 16 financial assistance under the program and requires that each 17 applicant receiving an award from the board enter into an 18 agreement with the authority. The bill provides that such an 19 agreement shall contain such terms and conditions as the board 20 may place on the award or as the authority may deem necessary 21 for the efficient administration of the sports tourism program. 22 The bill requires the authority to establish a fund for 23 the purposes of financing sports tourism projects. The bill 24 specifies that the authority may administer the fund as a 25 revolving fund. Moneys in the fund shall not revert to the 26 general fund of the state and interest and earnings on the fund 27 are required to be credited to the fund. Moneys in the fund are 28 appropriated to the authority to provide financial assistance 29 to the bureaus and districts under the sports tourism program. 30 The bill strikes Code language that provided annual fiscal 31 year appropriations from the rebuild Iowa infrastructure fund 32 to the community attraction and tourism fund for fiscal years 33 beginning on July 1, 2004, and ending on June 30, 2015. 34 The bill makes conforming changes related to transitioning 35 -17- LSB 5814XC (7) 86 aw/sc 17/ 18
