S.F. _____ H.F. _____ Section 1. Section 272.10, subsection 2, Code 2016, is 1 amended to read as follows: 2 2. Licensing fees are payable to the treasurer of state and 3 shall be deposited with the executive director of the board. 4 The executive director shall deposit twenty-five percent of 5 the fees collected annually with the treasurer of state and 6 the fees shall be credited to the general fund of the state. 7 The remaining licensing fees collected during the fiscal year 8 shall be retained by and are appropriated to the board for 9 the purposes related to the board’s duties. Notwithstanding 10 section 8.33 , licensing fees retained by and appropriated to 11 the board pursuant to this section that remain unencumbered or 12 unobligated at the close of the fiscal year shall not revert 13 but shall remain available for expenditure for the activities 14 of the board as provided in this chapter until the close of the 15 succeeding fiscal year. 16 Sec. 2. Section 272.10, Code 2016, is amended by adding the 17 following new subsections: 18 NEW SUBSECTION . 2A. Notwithstanding subsection 2, one 19 hundred percent of the funds received annually resulting from a 20 licensing fee increase adopted by rule on or after December 16, 21 2015, by the board of educational examiners shall be retained 22 by the board and are appropriated to the board for the purposes 23 related to the board’s duties. 24 NEW SUBSECTION . 2B. Notwithstanding section 8.33 , 25 licensing fees retained by and appropriated to the board 26 pursuant to this section that remain unencumbered or 27 unobligated at the close of the fiscal year shall not revert 28 but shall remain available for expenditure for the activities 29 of the board as provided in this chapter until the close of the 30 succeeding fiscal year. 31 Sec. 3. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 32 immediate importance, takes effect upon enactment. 33 Sec. 4. RETROACTIVE APPLICABILITY.
