Section 29.1, Code 2016, is amended to read as 1 follows: 2 29.1 Department of public defense. 3 The department of public defense is composed of the office 4 of the adjutant general and , the military forces of the state 5 of Iowa , and the Iowa gold star military museum as established 6 in section 29.4 . The adjutant general is the director of the 7 department of public defense and shall perform all functions, 8 responsibilities, powers, and duties concerning the military 9 forces of the state of Iowa and the Iowa gold star military 10 museum as provided in the laws of the state. 11 Sec. 2. NEW SECTION . 29.4 Iowa gold star military museum. 12 1. The department of public defense shall establish a 13 military historical museum located at Camp Dodge which shall 14 be known as the “Iowa gold star military museum”. The museum 15 shall be administered by the adjutant general. 16 2. The adjutant general may appoint a museum director and 17 such other personnel from the full-time equivalent positions 18 authorized the department for the purposes of maintaining and 19 operating the Iowa gold star military museum. The museum 20 director shall have such responsibilities as may be assigned 21 by the adjutant general. 22 Sec. 3. Section 261.86, subsection 6, Code 2016, is amended 23 to read as follows: 24 6. Notwithstanding section 8.33 , until one year after the 25 date the president of the United States or the Congress of 26 the United States declares a cessation of hostilities ending 27 operation Iraqi freedom, operation new dawn, and operation 28 enduring freedom, funds appropriated for purposes of this 29 section which remain unencumbered or unobligated at the close 30 of the fiscal year for which the funds were appropriated shall 31 not revert but shall be available for expenditure for the 32 following fiscal year for purposes of this section . 33 Sec. 4. Section 261.86, Code 2016, is amended by adding the 34 following new subsection: 35 -1- LSB 5221DP (3) 86 ec/nh 1/ 3

Not more than one percent of the moneys 1 appropriated for purposes of this section may be used by the 2 college student aid commission for purposes of administering 3 this section. 4 Sec. 5. EFFECTIVE UPON ENACTMENT. The following provision 5 of this Act, being deemed of immediate importance, takes effect 6 upon enactment: 7 1. The section of this Act amending section 261.86, 8 subsection 6. 9 Sec. 6. RETROACTIVE APPLICABILITY. The following provision 10 of this Act applies retroactively to June 30, 2015: 11 1. The section of this Act amending section 261.86, 12 subsection 6. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill concerns the department of public defense. 17 Code section 29.1 is amended to provide that the department 18 of public defense is also composed of the Iowa gold star 19 military museum and that the adjutant general shall perform all 20 functions, responsibilities, powers, and duties concerning the 21 museum. 22 New Code section 29.4 provides that the department of public 23 defense shall establish a military museum located at Camp Dodge 24 which shall be known as the Iowa gold star military museum. 25 The bill provides that the adjutant general shall administer 26 the museum and may appoint a museum director and such other 27 personnel for the purposes of maintaining and operating the 28 museum. 29 Code section 261.86, concerning the national guard education 30 assistance program, is amended. The bill eliminates the 31 provision that moneys appropriated for purposes of this program 32 shall not revert for the following fiscal year only until one 33 year after operation Iraqi freedom, operation new dawn, and 34 operation enduring freedom are concluded.
