S.F. _____ H.F. _____ Section 1. Section 602.3101, Code 2016, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 3. The supreme court shall supervise 3 the board and may review, approve, modify, or reject any 4 board action, procedure, or decision. The supreme court may 5 adopt rules to implement this subsection and the rules shall 6 prevail over any other laws or court rules relating to actions, 7 activities, procedures, or decisions of the board. 8 Sec. 2. Section 602.3201, Code 2016, is amended to read as 9 follows: 10 602.3201 Requirement of certification —— use of title —— 11 exempt status . 12 1. A person shall not engage in the profession of shorthand 13 reporting unless the person is certified pursuant to this 14 chapter , or otherwise exempted pursuant to section 602.6603, 15 subsection 4 . Only a person who is certified by the board 16 may assume the title of certified shorthand reporter, or use 17 the abbreviation C.S.R., or any words, letters, or figures to 18 indicate that the person is a certified shorthand reporter. 19 2. If a person’s certification as a shorthand reporter is 20 placed in exempt status, the person nonetheless may transcribe 21 or certify a proceeding the person reported while certified 22 as an active shorthand reporter. A person transcribing or 23 certifying a proceeding pursuant to this subsection shall 24 remain subject to the jurisdiction of the board of examiners 25 of shorthand reporters. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This bill relates to the placement of shorthand reporters in 30 exempt status and to the supervision of the board of examiners 31 of shorthand reporters. 32 The bill provides that the supreme court shall supervise the 33 board of examiners of shorthand reporters and have authority to 34 review, approve, modify, or reject a board action, procedure, 35 -1- LSB 5236XD (4) 86 jm/nh 1/ 2

The bill also provides that the supreme court 1 may adopt rules relating to the supervision of the board of 2 examiners of shorthand reporters and the bill specifies that 3 the rules shall prevail over any other laws or court rules 4 relating to actions, activities, procedures, or decisions of 5 the board. 6 The bill provides that if a shorthand reporter’s 7 certification is placed in exempt status, the reporter 8 may nonetheless transcribe or certify a proceeding that 9 was reported while the reporter was certified as an active 10 shorthand reporter. A reporter transcribing or certifying a 11 proceeding while in exempt status shall remain subject to the 12 jurisdiction of the board of examiners of shorthand reporters. 13 -2- LSB 5236XD (4) 86 jm/nh 2/ 2
