There is appropriated from the general fund of the state 5 to the department of justice for the fiscal year beginning July 6 1, 2015, and ending June 30, 2016, the following amounts, or 7 so much thereof as is necessary, to be used for the purposes 8 designated: 9 a. For victim assistance grants: 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 6,734,400 25 The moneys appropriated in this lettered paragraph shall be 26 used to provide grants to care providers providing services to 27 crime victims of domestic abuse or to crime victims of rape and 28 sexual assault. 29 The balance of the victim compensation fund established in 30 section 915.94 may be used to provide salary and support of not 31 more than 24 FTEs and to provide maintenance for the victim 32 compensation functions of the department of justice. 33 The department of justice shall transfer at least $150,000 34 from the victim compensation fund established in section 915.94 35 -1- LSB 1022SB (1) 86 jm/rn 1/ 39

The department of justice, in submitting budget 10 estimates for the fiscal year commencing July 1, 2016, pursuant 11 to section 8.23, shall include a report of funding from sources 12 other than amounts appropriated directly from the general fund 13 of the state to the department of justice or to the office of 14 consumer advocate. These funding sources shall include but 15 are not limited to reimbursements from other state agencies, 16 commissions, boards, or similar entities, and reimbursements 17 from special funds or internal accounts within the department 18 of justice. The department of justice shall also report actual 19 reimbursements for the fiscal year commencing July 1, 2014, 20 and actual and expected reimbursements for the fiscal year 21 commencing July 1, 2015. 22 b. The department of justice shall include the report 23 required under paragraph “a”, as well as information regarding 24 any revisions occurring as a result of reimbursements actually 25 received or expected at a later date, in a report to the 26 co-chairpersons and ranking members of the joint appropriations 27 subcommittee on the justice system and the legislative services 28 agency. Each lease negotiated by the department of corrections 9 with a private corporation for the purpose of providing private 10 industry employment of inmates in a correctional institution 11 shall prohibit the private corporation from utilizing inmate 12 labor for partisan political purposes for any person seeking 13 election to public office in this state and that a violation 14 of this requirement shall result in a termination of the lease 15 agreement. 16 b. As a condition of receiving the appropriation provided 17 in this subsection the department of corrections shall not 18 enter into a lease or contractual agreement pursuant to section 19 904.809 with a private corporation for the use of building 20 space for the purpose of providing inmate employment without 21 providing that the terms of the lease or contract establish 22 safeguards to restrict, to the greatest extent feasible, access 23 by inmates working for the private corporation to personal 24 identifying information of citizens. 25 c. As a condition of receiving the appropriation provided 26 in this subsection the department of corrections shall not, 27 except as otherwise provided in paragraph “b”, enter into a 28 new contract, unless the contract is a renewal of an existing 29 contract, for the expenditure of moneys in excess of $100,000 30 during the fiscal year beginning July 1, 2015, for the 31 privatization of services performed by the department using 32 state employees as of July 1, 2015, or for the privatization 33 of new services by the department without prior consultation 34 with any applicable state employee organization affected 35 -5- LSB 1022SB (1) 86 jm/rn 5/ 39
S.F. _____ by the proposed new contract and prior notification of the 1 co-chairpersons and ranking members of the joint appropriations 2 subcommittee on the justice system. 3 d. The department of corrections shall add additional 4 correctional officer positions to the current number of 5 correctional officer positions as of July 1, 2015. 6 2. To maximize the funding for educational programs, 10 the department shall establish guidelines and procedures to 11 prioritize the availability of educational and vocational 12 training for inmates based upon the goal of facilitating an 13 inmate’s successful release from the correctional institution. 14 b. The director of the department of corrections may 15 transfer moneys from Iowa prison industries and the canteen 16 operating funds established pursuant to section 904.310, for 17 use in educational programs for inmates. 18 c. Notwithstanding section 8.33, moneys appropriated in 19 this subsection that remain unobligated or unexpended at the 20 close of the fiscal year shall not revert but shall remain 21 available to be used only for the purposes designated in this 22 subsection until the close of the succeeding fiscal year. 23 3. For the fiscal year addressed by this section the 30 department of corrections shall continue to operate the 31 correctional farms under the control of the department at 32 the same or greater level of participation and involvement 33 as existed as of January 1, 2011; shall not enter into any 34 rental agreement or contract concerning any farmland under 35 -6- LSB 1022SB (1) 86 jm/rn 6/ 39
S.F. _____ the control of the department that is not subject to a rental 1 agreement or contract as of January 1, 2011, without prior 2 legislative approval; and shall further attempt to provide 3 job opportunities at the farms for inmates. The department 4 shall attempt to provide job opportunities at the farms for 5 inmates by encouraging labor-intensive farming or gardening 6 where appropriate; using inmates to grow produce and meat for 7 institutional consumption; researching the possibility of 8 instituting food canning and cook-and-chill operations; and 9 exploring opportunities for organic farming and gardening, 10 livestock ventures, horticulture, and specialized crops. 11 Sec. 5. JUDICIAL DISTRICT DEPARTMENTS OF CORRECTIONAL 12 SERVICES. 13 1. There is appropriated from the general fund of the state 14 to the department of corrections for the fiscal year beginning 15 July 1, 2015, and ending June 30, 2016, for salaries, support, 16 maintenance, and miscellaneous purposes, the following amounts, 17 or so much thereof as is necessary, to be used for the purposes 18 designated: 19 a. Each judicial district department of correctional 26 services, within the funding available, shall continue programs 27 and plans established within that district to provide for 28 intensive supervision, sex offender treatment, diversion of 29 low-risk offenders to the least restrictive sanction available, 30 job development, and expanded use of intermediate criminal 31 sanctions. 32 3. Each judicial district department of correctional 33 services shall provide alternatives to prison consistent with 34 chapter 901B. The alternatives to prison shall ensure public 35 -8- LSB 1022SB (1) 86 jm/rn 8/ 39
S.F. _____ safety while providing maximum rehabilitation to the offender. 1 A judicial district department of correctional services may 2 also establish a day program. 3 4. The governor’s office of drug control policy shall 4 consider federal grants made to the department of corrections 5 for the benefit of each of the eight judicial district 6 departments of correctional services as local government 7 grants, as defined pursuant to federal regulations. 8 5. The department of corrections shall continue to contract 9 with a judicial district department of correctional services to 10 provide for the rental of electronic monitoring equipment which 11 shall be available statewide. 12 Sec. 6. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 13 APPROPRIATIONS. Notwithstanding section 8.39, within the 14 moneys appropriated in this division of this Act to the 15 department of corrections, the department may reallocate the 16 moneys appropriated and allocated as necessary to best fulfill 17 the needs of the correctional institutions, administration 18 of the department, and the judicial district departments of 19 correctional services. However, in addition to complying with 20 the requirements of sections 904.116 and 905.8 and providing 21 notice to the legislative services agency, the department 22 of corrections shall also provide notice to the department 23 of management, prior to the effective date of the revision 24 or reallocation of an appropriation made pursuant to this 25 section. The department of corrections shall not reallocate an 26 appropriation or allocation for the purpose of eliminating any 27 program. 28 Sec. 7. INTENT —— REPORTS. 29 1. The department of corrections in cooperation with 30 townships, the Iowa cemetery associations, and other nonprofit 31 or governmental entities may use inmate labor during the 32 fiscal year beginning July 1, 2015, to restore or preserve 33 rural cemeteries and historical landmarks. The department in 34 cooperation with the counties may also use inmate labor to 35 -9- LSB 1022SB (1) 86 jm/rn 9/ 39
S.F. _____ clean up roads, major water sources, and other water sources 1 around the state. 2 2. On a quarterly basis the department shall provide a 3 status report regarding private-sector employment to the 4 legislative services agency beginning on July 1, 2015. The 5 report shall include the number of offenders employed in the 6 private sector, the combined number of hours worked by the 7 offenders, the total amount of allowances, and the distribution 8 of allowances pursuant to section 904.702, including any moneys 9 deposited in the general fund of the state. 10 Sec. 8. ELECTRONIC MONITORING REPORT. The department of 11 corrections shall submit a report on electronic monitoring to 12 the general assembly, to the co-chairpersons and the ranking 13 members of the joint appropriations subcommittee on the justice 14 system, and to the legislative services agency by January 15 15, 2016. The report shall specifically address the number 16 of persons being electronically monitored and break down the 17 number of persons being electronically monitored by offense 18 committed. The report shall also include a comparison of any 19 data from the prior fiscal year with the current year. 20 Sec. 9. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 21 1. As used in this section, unless the context otherwise 22 requires, “state agency” means the government of the state 23 of Iowa, including but not limited to all executive branch 24 departments, agencies, boards, bureaus, and commissions, the 25 judicial branch, the general assembly and all legislative 26 agencies, institutions within the purview of the state board of 27 regents, and any corporation whose primary function is to act 28 as an instrumentality of the state. 29 2. State agencies are encouraged to purchase products from 30 Iowa state industries, as defined in section 904.802, when 31 purchases are required and the products are available from 32 Iowa state industries. State agencies shall obtain bids from 33 Iowa state industries for purchases of office furniture during 34 the fiscal year beginning July 1, 2015, exceeding $5,000 or 35 -10- LSB 1022SB (1) 86 jm/rn 10/ 39
S.F. _____ in accordance with applicable administrative rules related to 1 purchases for the agency. 2 Sec. 10. IOWA LAW ENFORCEMENT ACADEMY. 3 1. FTEs 24.00 14 The Iowa law enforcement academy shall provide training 15 of state and local law enforcement personnel concerning 16 the recognition of and response to persons with Alzheimer’s 17 disease. 18 The Iowa law enforcement academy may temporarily exceed and 19 draw more than the amount appropriated in this subsection and 20 incur a negative cash balance as long as there are receivables 21 equal to or greater than the negative balance and the amount 22 appropriated in this subsection is not exceeded at the close 23 of the fiscal year. 24 2. The Iowa law enforcement academy may select at least 25 five automobiles of the department of public safety, division 26 of state patrol, prior to turning over the automobiles to 27 the department of administrative services to be disposed 28 of by public auction, and the Iowa law enforcement academy 29 may exchange any automobile owned by the academy for each 30 automobile selected if the selected automobile is used in 31 training law enforcement officers at the academy. However, any 32 automobile exchanged by the academy shall be substituted for 33 the selected vehicle of the department of public safety and 34 sold by public auction with the receipts being deposited in the 35 -11- LSB 1022SB (1) 86 jm/rn 11/ 39

Section 915.80, Code 2015, is amended by adding the 15 following new subsections: 16 NEW SUBSECTION . 4A. “Emergency relocation” means a 17 relocation that takes place within thirty days of the date of a 18 crime or the discovery of a crime, or within thirty days after 19 a crime could reasonably be reported. “Emergency relocation” 20 also includes a relocation that takes place within the thirty 21 days before or after an offender related to the crime is 22 released from incarceration. 23 NEW SUBSECTION . 4B. “Housing assistance” means living 24 expenses associated with owning or renting housing, including 25 essential utilities, intended to maintain or reestablish the 26 living arrangement, health, and safety of a victim impacted by 27 a crime. 28 Sec. 21. Section 915.84, Code 2015, is amended by adding the 29 following new subsection: 30 NEW SUBSECTION . 1A. The department may waive, for good 31 cause shown, the requirement that an emergency relocation must 32 take place within thirty days of the date or discovery of a 33 crime or within thirty days before or after the offender is 34 released from incarceration. 35 -18- LSB 1022SB (1) 86 jm/rn 18/ 39
S.F. _____ Sec. 22. Section 915.86, Code 2015, is amended by adding the 1 following new subsections: 2 NEW SUBSECTION . 16. Reasonable charges incurred by a 3 victim, a secondary victim, the survivor of a homicide victim 4 as described in subsection 9, or by a victim service program on 5 behalf of a victim, for emergency relocation expenses, not to 6 exceed one thousand dollars per person per state fiscal year. 7 NEW SUBSECTION . 17. Reasonable expenses incurred by a 8 victim, or by a victim service program on behalf of a victim, 9 for up to three months of housing assistance, not to exceed two 10 thousand dollars per person per state fiscal year. 11 Sec. 23. 2012 Iowa Acts, chapter 1138, section 7, subsection 12 1, is amended to read as follows: 13 1. A mortgage servicing settlement fund is established, 14 separate and apart from all other public moneys or funds of 15 the state, under the control of the department of justice. 16 The department of justice shall deposit moneys received 17 by the department from the joint state-federal mortgage 18 servicing settlement into the fund. The department of 19 justice is authorized to make expenditures of moneys in the 20 fund consistent with the terms of the consent decree signed 21 in federal court on April 5, 2012. Any unencumbered or 22 unobligated moneys remaining in the fund on June 30, 2015, 23 shall be transferred to the general fund of the state human 24 trafficking enforcement fund as established by this 2015 Act . 25 Sec. 24. HUMAN TRAFFICKING ENFORCEMENT FUND. A human 26 trafficking enforcement fund is established, separate and apart 27 from all other public moneys or funds of the state, under 28 the control of the department of justice. The department 29 of justice shall deposit unencumbered or unobligated moneys 30 transferred from the mortgage servicing settlement fund 31 into the fund. Moneys in the fund are appropriated to the 32 department of justice for purposes of training local law 33 enforcement and county attorneys about recognizing human 34 trafficking and aiding the victims of human trafficking, and 35 -19- LSB 1022SB (1) 86 jm/rn 19/ 39
S.F. _____ providing grants to local law enforcement agencies for overtime 1 costs incurred investigating human trafficking offenses and 2 making arrests. Any moneys remaining in the fund on June 30, 3 2020, shall be transferred to the general fund of the state. 4 Sec. 25. EFFECTIVE UPON ENACTMENT. The following provision 5 of this division, being deemed of immediate importance, takes 6 effect upon enactment: 7 1. As a condition of receiving the appropriation provided 25 in this subsection the department of corrections shall not 26 enter into a lease or contractual agreement pursuant to section 27 904.809 with a private corporation for the use of building 28 space for the purpose of providing inmate employment without 29 providing that the terms of the lease or contract establish 30 safeguards to restrict, to the greatest extent feasible, access 31 by inmates working for the private corporation to personal 32 identifying information of citizens. 33 c. Each judicial district department of correctional 6 services shall provide alternatives to prison consistent with 7 chapter 901B. The alternatives to prison shall ensure public 8 safety while providing maximum rehabilitation to the offender. 9 A judicial district department of correctional services may 10 also establish a day program. 11 4. The governor’s office of drug control policy shall 12 consider federal grants made to the department of corrections 13 for the benefit of each of the eight judicial district 14 departments of correctional services as local government 15 grants, as defined pursuant to federal regulations. 16 5. The department of corrections shall continue to contract 17 with a judicial district department of correctional services to 18 provide for the rental of electronic monitoring equipment which 19 shall be available statewide. 20 Sec. 31. DEPARTMENT OF CORRECTIONS —— REALLOCATION OF 21 APPROPRIATIONS. Notwithstanding section 8.39, within the 22 moneys appropriated in this division of this Act to the 23 department of corrections, the department may reallocate the 24 moneys appropriated and allocated as necessary to best fulfill 25 the needs of the correctional institutions, administration 26 of the department, and the judicial district departments of 27 correctional services. However, in addition to complying with 28 the requirements of sections 904.116 and 905.8 and providing 29 notice to the legislative services agency, the department 30 of corrections shall also provide notice to the department 31 of management, prior to the effective date of the revision 32 or reallocation of an appropriation made pursuant to this 33 section. The department of corrections shall not reallocate an 34 appropriation or allocation for the purpose of eliminating any 35 -28- LSB 1022SB (1) 86 jm/rn 28/ 39
S.F. _____ program. 1 Sec. 32. INTENT —— REPORTS. 2 1. The department of corrections in cooperation with 3 townships, the Iowa cemetery associations, and other nonprofit 4 or governmental entities may use inmate labor during the 5 fiscal year beginning July 1, 2016, to restore or preserve 6 rural cemeteries and historical landmarks. The department in 7 cooperation with the counties may also use inmate labor to 8 clean up roads, major water sources, and other water sources 9 around the state. 10 2. On a quarterly basis the department shall provide a 11 status report regarding private-sector employment to the 12 legislative services agency beginning on July 1, 2016. The 13 report shall include the number of offenders employed in the 14 private sector, the combined number of hours worked by the 15 offenders, the total amount of allowances, and the distribution 16 of allowances pursuant to section 904.702, including any moneys 17 deposited in the general fund of the state. 18 Sec. 33. ELECTRONIC MONITORING REPORT. The department of 19 corrections shall submit a report on electronic monitoring to 20 the general assembly, to the co-chairpersons and the ranking 21 members of the joint appropriations subcommittee on the justice 22 system, and to the legislative services agency by January 23 15, 2017. The report shall specifically address the number 24 of persons being electronically monitored and break down the 25 number of persons being electronically monitored by offense 26 committed. The report shall also include a comparison of any 27 data from the prior fiscal year with the current year. 28 Sec. 34. STATE AGENCY PURCHASES FROM PRISON INDUSTRIES. 29 1. As used in this section, unless the context otherwise 30 requires, “state agency” means the government of the state 31 of Iowa, including but not limited to all executive branch 32 departments, agencies, boards, bureaus, and commissions, the 33 judicial branch, the general assembly and all legislative 34 agencies, institutions within the purview of the state board of 35 -29- LSB 1022SB (1) 86 jm/rn 29/ 39
S.F. _____ regents, and any corporation whose primary function is to act 1 as an instrumentality of the state. 2 2. State agencies are encouraged to purchase products from 3 Iowa state industries, as defined in section 904.802, when 4 purchases are required and the products are available from 5 Iowa state industries. State agencies shall obtain bids from 6 Iowa state industries for purchases of office furniture during 7 the fiscal year beginning July 1, 2016, exceeding $5,000 or 8 in accordance with applicable administrative rules related to 9 purchases for the agency. 10 Sec. 35. The bill specifies that the department 27 of justice administering the crime victim compensation program 28 may award reasonable charges incurred by a victim, a secondary 29 victim, or the survivor of a homicide victim, or by a victim 30 service program on behalf of a victim, for emergency relocation 31 expenses, not to exceed $1,000, per person, per state fiscal 32 year. To claim emergency relocation compensation under the 33 bill, the relocation shall have occurred within 30 days of the 34 date of a crime or the discovery of a crime, within 30 days 35 -38- LSB 1022SB (1) 86 jm/rn 38/ 39
S.F. _____ after a crime could reasonably be reported, or within 30 days 1 before or after the date the offender related to the crime is 2 released from incarceration. The 30-day limitation to conduct 3 an emergency relocation required by the bill may be waived by 4 the department of justice upon a showing of good cause. The 5 bill specifies that the 30-day time period to request emergency 6 relocation compensation may be waived by the department of 7 justice upon a showing of good cause. 8 The bill specifies that the department of justice may also 9 award reasonable expenses for up to three months of housing 10 assistance incurred by a victim or by a victim service program 11 on behalf of a victim, not to exceed $2,000 per person per 12 state fiscal year. 13 HUMAN TRAFFICKING ENFORCEMENT FUND. The bill creates a 14 human trafficking enforcement fund under the control of the 15 department of justice. The bill transfers any unencumbered 16 or unobligated moneys remaining in the mortgage servicing 17 settlement fund on June 30, 2015, to the human trafficking 18 fund. Moneys in the human trafficking fund are appropriated 19 to the department of justice for purposes of training local 20 law enforcement and county attorneys about recognizing human 21 trafficking, and providing grants to local law enforcement 22 agencies for human trafficking investigations. The bill 23 specifies that any moneys remaining in the fund on June 30, 24 2020, be transferred to the general fund of the state. Current 25 law provides that any unencumbered or unobligated moneys 26 remaining in the mortgage servicing settlement fund on June 30, 27 2015, be transferred to the general fund of the state. The 28 provision transferring the moneys from the mortgage servicing 29 settlement fund takes effect upon enactment. 30 -39- LSB 1022SB (1) 86 jm/rn 39/ 39
