Notwithstanding section 8.33 , moneys appropriated in 22 this section that remain unencumbered or unobligated at the 23 close of the fiscal year shall not revert but shall remain 24 available to be used for the purposes designated until the 25 close of the succeeding fiscal year. 26 Sec. 6. AGRICULTURAL EDUCATION. 27 1. There is appropriated from the general fund of the state 28 to the department of agriculture and land stewardship for the 29 fiscal year beginning July 1, 2015, and ending June 30, 2016, 30 the following amount, or so much thereof as is necessary, to be 31 used for the purposes designated: 32 For purposes of allocating moneys to an Iowa association 33 affiliated with a national organization which promotes 34 agricultural education providing for future farmers: 35 -3- LSB 2649XC (7) 86 da/rn 3/ 44

FARMERS WITH DISABILITIES PROGRAM. 8 1. There is appropriated from the general fund of the state 9 to the department of agriculture and land stewardship for the 10 fiscal year beginning July 1, 2015, and ending June 30, 2016, 11 the following amount, or so much thereof as is necessary, to be 12 used for the purposes designated: 13 For purposes of supporting a program for farmers with 14 disabilities: 15 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 130,000 16 2. The moneys appropriated in subsection 1 shall be used for 17 the public purpose of providing a grant to a national nonprofit 18 organization with over 80 years of experience in assisting 19 children and adults with disabilities and special needs. The 20 moneys shall be used to support a nationally recognized program 21 that began in 1986 and has been replicated in at least 30 other 22 states, but which is not available through any other entity 23 in this state, and that provides assistance to farmers with 24 disabilities in all 99 counties to allow the farmers to remain 25 in their own homes and be gainfully engaged in farming through 26 provision of agricultural worksite and home modification 27 consultations, peer support services, services to families, 28 information and referral, and equipment loan services. 29 3. Notwithstanding section 8.33 , moneys appropriated in 30 this section that remain unencumbered or unobligated at the 31 close of the fiscal year shall not revert but shall remain 32 available for expenditure for the purposes designated until the 33 close of the succeeding fiscal year. 34 DIVISION II 35 -4- LSB 2649XC (7) 86 da/rn 4/ 44
S.F. _____ GENERAL FUND 1 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 2 WATER QUALITY INITIATIVE 3 APPROPRIATIONS FOR FY 2015-2016 4 Sec. 8. WATER QUALITY INITIATIVE —— GENERAL. 5 1. There is appropriated from the general fund of the state 6 to the department of agriculture and land stewardship for the 7 fiscal year beginning July 1, 2015, and ending June 30, 2016, 8 the following amount, or so much thereof as is necessary, to be 9 used for the purposes designated: 10 For deposit in the water quality initiative fund created in 11 section 466B.45 , for purposes of supporting the water quality 12 initiative administered by the soil conservation division as 13 provided in section 466B.42 , including salaries, support, 14 maintenance, and miscellaneous purposes, and for not more than 15 the following full-time equivalent positions: 16 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 4,400,000 17 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . The moneys appropriated in subsection 1 shall be 19 used to support projects in subwatersheds as designated by the 20 division that are part of high-priority watersheds identified 21 by the water resources coordinating council established 22 pursuant to section 466B.3 . 23 b. The moneys appropriated in subsection 1 shall be used to 24 support projects in watersheds generally, including regional 25 watersheds, as designated by the division and high-priority 26 watersheds identified by the water resources coordinating 27 council established pursuant to section 466B.3. 28 3. In supporting projects in subwatersheds and watersheds 29 as provided in subsection 2, all of the following shall apply: 30 a. The demonstration projects shall utilize water quality 31 practices as described in the latest revision of the document 32 entitled “Iowa Nutrient Reduction Strategy” initially presented 33 in November 2012 by the department of agriculture and land 34 stewardship, the department of natural resources, and Iowa 35 -5- LSB 2649XC (7) 86 da/rn 5/ 44
S.F. _____ state university of science and technology. 1 b. The division shall implement demonstration projects as 2 provided in paragraph “a” by providing for participation by 3 persons who hold a legal interest in agricultural land used in 4 farming. To every extent practical, the division shall provide 5 for collaborative participation by such persons who hold a 6 legal interest in agricultural land located within the same 7 subwatershed. 8 c. The division shall implement a demonstration project on 9 a cost-share basis as determined by the division. However, the 10 state’s share of the amount shall not exceed 50 percent of the 11 estimated cost of establishing the practice as determined by 12 the division or 50 percent of the actual cost of establishing 13 the practice, whichever is less. 14 d. The demonstration projects shall be used to educate other 15 persons about the feasibility and value of establishing similar 16 water quality practices. The division shall promote field day 17 events for purposes of allowing interested persons to establish 18 water quality practices on their agricultural land. 19 e. The division shall conduct water quality evaluations 20 within supported subwatersheds. Within a reasonable period 21 after accumulating information from such evaluations, the 22 division shall create an aggregated database of water quality 23 practices. Any information identifying a person holding a 24 legal interest in agricultural land or specific agricultural 25 land shall be a confidential record under section 22.7 . 26 4. The moneys appropriated in subsection 1 shall be used 27 to support education and outreach in a manner that encourages 28 persons who hold a legal interest in agricultural land used for 29 farming to implement water quality practices, including the 30 establishment of such practices in watersheds generally, and 31 not limited to subwatersheds or high-priority watersheds. 32 5. The moneys appropriated in subsection 1 may be used 33 to contract with persons to coordinate the implementation of 34 efforts provided in this section. 35 -6- LSB 2649XC (7) 86 da/rn 6/ 44

The moneys appropriated in subsection 1 may be used by 1 the department to support urban soil and water conservation 2 efforts, which may include but are not limited to management 3 practices related to bioretention, landscaping, the use of 4 permeable or pervious pavement, and soil quality restoration. 5 The moneys shall be allocated on a cost-share basis as provided 6 in chapter 161A. 7 7. Notwithstanding any other provision of law to the 8 contrary, the department may use moneys appropriated in 9 subsection 1 to carry out the provisions of this section on a 10 cost-share basis in combination with other moneys available to 11 the department from a state or federal source. 12 Sec. 9. WATER QUALITY INITIATIVE APPROPRIATIONS —— FEDERAL 13 MONEYS. The department of agriculture and land stewardship, 14 and its soil conservation division, may use moneys appropriated 15 in this division of this Act to support the water quality 16 initiative, including its projects, as provided in this 17 division of this Act, in combination with other moneys provided 18 by the United States government. 19 DIVISION III 20 DEPARTMENT OF NATURAL RESOURCES 21 GENERAL APPROPRIATIONS FOR FY 2015-2016 22 Sec. 10. GENERAL FUND —— DEPARTMENT. 23 1. S.F. _____ authorized to the department pursuant to subsection 1, 50.00 1 full-time equivalent positions shall be allocated by the 2 department for seasonal employees for purposes of providing 3 maintenance, upkeep, and sanitary services at state parks. 4 This subsection shall not impact park ranger positions within 5 the department. 6 3. The department shall submit a report each quarter of the 7 fiscal year to the legislative services agency, the department 8 of management, the members of the joint appropriations 9 subcommittee on agriculture and natural resources, and the 10 chairpersons and ranking members of the senate and house 11 committees on appropriations. The report shall describe in 12 detail the expenditure of moneys appropriated under this 13 section to support the department’s administration, regulation, 14 and programs. 15 Sec. 11. STATE FISH AND GAME PROTECTION FUND —— REGULATION 16 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 17 1. There is appropriated from the state fish and game 18 protection fund to the department of natural resources for the 19 fiscal year beginning July 1, 2015, and ending June 30, 2016, 20 the following amount, or so much thereof as is necessary, to be 21 used for the purposes designated: 22 For purposes of supporting the regulation or advancement of 23 hunting, fishing, or trapping, or the protection, propagation, 24 restoration, management, or harvest of fish or wildlife, 25 including for administration, regulation, law enforcement, and 26 programs; and for salaries, support, maintenance, equipment, 27 and miscellaneous purposes: 28 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 41,223,225 29 2. Notwithstanding section 455A.10 , the department may use 30 the unappropriated balance remaining in the state fish and game 31 protection fund to provide for the funding of health and life 32 insurance premium payments from unused sick leave balances of 33 conservation peace officers employed in a protection occupation 34 who retire, pursuant to section 97B.49B . 35 -8- LSB 2649XC (7) 86 da/rn 8/ 44

Notwithstanding section 455A.10 , the department of 1 natural resources may use the unappropriated balance remaining 2 in the state fish and game protection fund for the fiscal 3 year beginning July 1, 2015, and ending June 30, 2016, as is 4 necessary to fund salary adjustments for departmental employees 5 for which the general assembly has made an operating budget 6 appropriation in subsection 1. 7 Sec. 12. GROUNDWATER PROTECTION FUND —— WATER 8 QUALITY. VETERINARY DIAGNOSTIC LABORATORY. 13 1. Paragraph “a” does not apply to a reduction made to 29 support the college of veterinary medicine, if the same 30 percentage of reduction imposed on the college of veterinary 31 medicine is also imposed on all of Iowa state university of 32 science and technology’s budget units. 33 3. If by June 30, 2016, Iowa state university of science and 34 technology fails to allocate the moneys appropriated in this 35 -11- LSB 2649XC (7) 86 da/rn 11/ 44

DATA COLLECTION OF IN-FIELD AGRICULTURAL PRACTICES 19 —— THREE-YEAR PILOT PROJECT. 20 1. Notwithstanding section 455E.11, subsection 2, 21 paragraph b, subparagraph (3), subparagraph division (b), 22 of the unobligated and unencumbered moneys remaining in the 23 agriculture management account of the groundwater protection 24 fund that would otherwise be required to be transferred to 25 the Iowa department of public health under that subparagraph 26 division, there is appropriated to Iowa state university of 27 science and technology for the fiscal year beginning July 1, 28 2015, and ending June 30, 2016, the following amount, or so 29 much thereof as is necessary, to be used for the purposes 30 designated: 31 a. Enhance this state’s ability to track its progress in 8 reducing the transport of nutrients to water from nonpoint 9 sources within watersheds in accordance with the latest 10 revision of the document entitled “Iowa Nutrient Reduction 11 Strategy” initially presented in November 2012 by the 12 department of agriculture and land stewardship, the department 13 of natural resources, and Iowa state university of science and 14 technology. 15 b. Develop a database of in-field agricultural practices 16 and analyze the impact of those practices in the aggregate. 17 An agricultural practice includes but is not limited to soil 18 and water conservation practices, structures, technologies, 19 and agricultural inputs and outputs. The college may also 20 provide for the measurement of other impacts associated with 21 agricultural production. The finding of the pilot project 22 shall be used to develop a system to be implemented within a 23 broader range of watersheds that measures existing agricultural 24 practices and the impact of different nutrient management 25 decisions. 26 3. The college shall enter into a private-public 27 partnership with one or more persons responsible for receiving, 28 collecting, or holding data described in subsection 2. The 29 college shall provide for the terms and conditions of any legal 30 or financial arrangement that it enters into with such person. 31 Any information received, collected, or held by the person 32 shall be confidential in the same manner as provided in section 33 466B.49, subsection 2. The college shall only enter into an 34 arrangement with a person if the college is satisfied that the 35 -13- LSB 2649XC (7) 86 da/rn 13/ 44
S.F. _____ person will protect the confidentiality of the information. 1 Any information including aggregate data transmitted to the 2 college by the person shall be available for public examination 3 and copying under chapter 22, except for the same type of 4 information described in section 466B.49, subsection 2, which 5 shall remain confidential. 6 4. The college shall submit interim reports to the general 7 assembly by March 1, 2016, and March 1, 2017, and a final 8 report to the general assembly by March 1, 2018. The final 9 report shall include its findings and recommendations. 10 DIVISION V 11 ENVIRONMENT FIRST FUND 12 GENERAL APPROPRIATIONS FOR FY 2015-2016 13 Sec. 20. Not more than 5 percent of the moneys appropriated in 22 paragraph “a” may be allocated for cost sharing to address 23 complaints filed under section 161A.47 . 24 d. Of the moneys appropriated in paragraph “a”, 5 percent 25 shall be allocated for financial incentives to establish 26 practices to protect watersheds above publicly owned lakes of 27 the state from soil erosion and sediment as provided in section 28 161A.73 . 29 e. The state soil conservation committee established by 30 section 161A.4 may allocate moneys appropriated in paragraph 31 “a” to conduct research and demonstration projects to promote 32 conservation tillage and nonpoint source pollution control 33 practices. 34 f. The 12 moneys shall be used to support a nationally recognized program 13 that began in 1986 and has been replicated in at least 30 other 14 states, but which is not available through any other entity 15 in this state, and that provides assistance to farmers with 16 disabilities in all 99 counties to allow the farmers to remain 17 in their own homes and be gainfully engaged in farming through 18 provision of agricultural worksite and home modification 19 consultations, peer support services, services to families, 20 information and referral, and equipment loan services. 21 3. The moneys appropriated in subsection 1 shall be used to 16 support projects in watersheds generally, including regional 17 watersheds, as designated by the division and high-priority 18 watersheds identified by the water resources coordinating 19 council established pursuant to section 466B.3. 20 3. In supporting projects in subwatersheds and watersheds 21 as provided in subsection 2, all of the following shall apply: 22 a. The demonstration projects shall utilize water quality 23 practices as described in the latest revision of the document 24 entitled “Iowa Nutrient Reduction Strategy” initially presented 25 in November 2012 by the department of agriculture and land 26 stewardship, the department of natural resources, and Iowa 27 state university of science and technology. 28 b. The division shall implement demonstration projects as 29 provided in paragraph “a” by providing for participation by 30 persons who hold a legal interest in agricultural land used in 31 farming. To every extent practical, the division shall provide 32 for collaborative participation by such persons who hold a 33 legal interest in agricultural land located within the same 34 subwatershed. 35 -25- LSB 2649XC (7) 86 da/rn 25/ 44
S.F. _____ c. The division shall implement a demonstration project on 1 a cost-share basis as determined by the division. However, the 2 state’s share of the amount shall not exceed 50 percent of the 3 estimated cost of establishing the practice as determined by 4 the division or 50 percent of the actual cost of establishing 5 the practice, whichever is less. 6 d. The demonstration projects shall be used to educate other 7 persons about the feasibility and value of establishing similar 8 water quality practices. The division shall promote field day 9 events for purposes of allowing interested persons to establish 10 water quality practices on their agricultural land. 11 e. The division shall conduct water quality evaluations 12 within supported subwatersheds. Within a reasonable period 13 after accumulating information from such evaluations, the 14 division shall create an aggregated database of water quality 15 practices. Any information identifying a person holding a 16 legal interest in agricultural land or specific agricultural 17 land shall be a confidential record under section 22.7 . 18 4. The moneys appropriated in subsection 1 shall be used 19 to support education and outreach in a manner that encourages 20 persons who hold a legal interest in agricultural land used for 21 farming to implement water quality practices, including the 22 establishment of such practices in watersheds generally, and 23 not limited to subwatersheds or high-priority watersheds. 24 5. The moneys appropriated in subsection 1 may be used 25 to contract with persons to coordinate the implementation of 26 efforts provided in this section. 27 6. The moneys appropriated in subsection 1 may be used by 28 the department to support urban soil and water conservation 29 efforts, which may include but are not limited to management 30 practices related to bioretention, landscaping, the use of 31 permeable or pervious pavement, and soil quality restoration. 32 The moneys shall be allocated on a cost-share basis as provided 33 in chapter 161A. 34 7. Notwithstanding any other provision of law to the 35 -26- LSB 2649XC (7) 86 da/rn 26/ 44
S.F. _____ contrary, the department may use moneys appropriated in 1 subsection 1 to carry out the provisions of this section on a 2 cost-share basis in combination with other moneys available to 3 the department from a state or federal source. 4 Sec. 33. WATER QUALITY INITIATIVE APPROPRIATIONS —— FEDERAL 5 MONEYS. The department of agriculture and land stewardship, 6 and its soil conservation division, may use moneys appropriated 7 in this division of this Act to support the water quality 8 initiative, including its projects, as provided in this 9 division of this Act, in combination with other moneys provided 10 by the United States government. 11 DIVISION X 12 DEPARTMENT OF NATURAL RESOURCES 13 GENERAL APPROPRIATIONS FOR FY 2016-2017 14 Sec. 34. GENERAL FUND —— DEPARTMENT. 15 1. STATE FISH AND GAME PROTECTION FUND —— REGULATION 8 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 9 1. Of moneys 16 allocated to a soil and water conservation district in addition 17 to the first $1,500,000 appropriated in paragraph “a”, up 18 to 30 percent may also be used to establish such management 19 practices. 20 c. Not more than 5 percent of the moneys appropriated in 21 paragraph “a” may be allocated for cost sharing to address 22 complaints filed under section 161A.47 . 23 d. Of the moneys appropriated in paragraph “a”, 5 percent 24 shall be allocated for financial incentives to establish 25 practices to protect watersheds above publicly owned lakes of 26 the state from soil erosion and sediment as provided in section 27 161A.73 . 28 e. The state soil conservation committee established by 29 section 161A.4 may allocate moneys appropriated in paragraph 30 “a” to conduct research and demonstration projects to promote 31 conservation tillage and nonpoint source pollution control 32 practices. 33 f. The allocation of moneys as financial incentives as 34 provided in section 161A.73 may be used in combination with 35 -34- LSB 2649XC (7) 86 da/rn 34/ 44

Notwithstanding section 8.33, moneys appropriated for 24 the fiscal year beginning July 1, 2016, in this division of 25 this Act to the department of agriculture and land stewardship 26 to provide financial assistance for the establishment of 27 permanent soil and water conservation practices that remain 28 unencumbered or unobligated at the close of the fiscal year 29 shall not revert but shall remain available for expenditure 30 for the purposes designated until the close of the fiscal year 31 beginning July 1, 2019. 32 DIVISION XIII 33 PERSONNEL SETTLEMENT AGREEMENT PAYMENTS 34 Sec. 46. S.F. _____ a condition made to any appropriation to the department of 1 agriculture and land stewardship, the department of natural 2 resources, or Iowa state university of science and technology 3 for the fiscal year beginning July 1, 2016, and ending June 30, 4 2017, as provided in this Act, the moneys appropriated and any 5 other moneys available for use by that entity for that fiscal 6 year under this Act shall not be used for the payment of a 7 personnel settlement agreement between that entity and a state 8 employee that contains a confidentiality provision intended to 9 prevent public disclosure of the agreement or any terms of the 10 agreement. 11 DIVISION XIV 12 RELATED STATUTORY CHANGES FOR CODIFICATION IN 2015 BLUFFLANDS 13 PROTECTION PROGRAM AND REVOLVING FUND 14 Sec. 47. Section 161A.80, subsection 2, paragraphs a and b, 15 Code 2015, are amended by striking the paragraphs. 16 Sec. 48. Section 161A.80, Code 2015, is amended by adding 17 the following new subsection: 18 NEW SUBSECTION . 3. This section is repealed on July 1, 19 2025. 20 Sec. 49. NEW SECTION . 161A.80A Outstanding bluffland 21 protection loans. 22 1. The principal and interest from any blufflands 23 protection loan made pursuant to section 161A.80 remaining 24 outstanding on July 1, 2025, that would have been payable to 25 the blufflands protection revolving fund created in section 26 161A.80, shall instead be paid to the division on or after July 27 1, 2015, pursuant to the terms of the loan agreement. The 28 moneys paid to the division shall be credited to the rebuild 29 Iowa infrastructure fund created in section 8.57. 30 2. This section is repealed on July 1, 2030. 31 EXPLANATION 32 The inclusion of this explanation does not constitute agreement with 33 the explanation’s substance by the members of the general assembly. 34 GENERAL. S.F. _____ resources by making appropriations for the fiscal years 1 2015-2016 and 2016-2017 to support related entities, including 2 the department of agriculture and land stewardship (DALS), 3 the department of natural resources (DNR), and Iowa state 4 university (ISU). 5 The bill primarily appropriates moneys to DALS and DNR. 6 The appropriations are made to support those departments for 7 administration, regulation, and support of programs. The bill 8 requires the departments to submit quarterly reports to the 9 general assembly and department of management regarding the 10 expenditure of appropriated moneys. The bill also provides 11 moneys to support specific programs or projects administered by 12 those departments. The bill appropriates moneys from a number 13 of sources, including the general fund of the state, the state 14 fish and game protection fund, the groundwater protection fund 15 (Code section 455E.11), and the environment first fund (Code 16 section 8.57A). The bill is organized into divisions. 17 DALS —— GENERAL FUND APPROPRIATIONS —— FY 2015-2016. For 18 DALS, moneys are appropriated from the general fund of the 19 state for FY 2015-2016 in order to support its administrative 20 divisions, including consumer protection and industry services, 21 soil conservation, and food safety and animal health. Moneys 22 are transferred to ISU to support its midwest grape and wine 23 institute. 24 DALS —— MISCELLANEOUS FUNDS APPROPRIATIONS —— FY 2015-2016. 25 The bill appropriates moneys from a number of sources for 26 FY 2015-2016 to support DALS in order to support designated 27 purposes, including moneys derived from unclaimed winnings from 28 horse and dog races, for administration and enforcement of 29 racing regulations (Code section 99D.22); and moneys credited 30 to the renewable fuel infrastructure fund (Code section 31 159A.16), for purposes of motor fuel inspection and auditing 32 biofuel processing and production (Code chapter 214A). 33 DALS —— SPECIAL GENERAL FUND APPROPRIATIONS —— FY 2015-2016. 34 The bill also makes special appropriations from the general 35 -39- LSB 2649XC (7) 86 da/rn 39/ 44

The bill 7 appropriates moneys from the general fund of the state for FY 8 2015-2016 to DALS for deposit in the water quality initiative 9 fund (Code section 466B.45), including to support high-priority 10 watershed projects. 11 DNR —— GENERAL FUND AND OTHER MAJOR FUNDS APPROPRIATIONS 12 —— FY 2015-2016. The bill makes appropriations from a number 13 of funds for FY 2015-2016 to DNR in order to support its 14 administrative divisions involving natural resources and 15 environmental protection from the general fund of the state, 16 the state fish and game protection fund, and the groundwater 17 protection fund. 18 DNR —— DESIGNATED MISCELLANEOUS FUNDS APPROPRIATIONS —— FY 19 2015-2016. The bill appropriates moneys for FY 2015-2016 to 20 DNR from a number of sources to support designated purposes, 21 including moneys deposited in the special snowmobile fund 22 (Code section 321G.7) to provide for administering and 23 enforcing the state snowmobile programs; and moneys deposited 24 in the unassigned revenue fund for purposes of paying for 25 administration of the department’s underground storage tanks 26 section. 27 DNR —— SPECIAL GENERAL FUND APPROPRIATIONS —— FY 2015-2016. 28 The bill also makes special appropriations from the general 29 fund of the state for FY 2015-2016 to DNR in order to support 30 specific purposes including floodplain management and dam 31 safety and forestry health management programs. 32 ISU —— SPECIAL GENERAL FUND AND GROUNDWATER PROTECTION 33 FUND APPROPRIATIONS —— FY 2015-2016.
