From the moneys deposited in the school ready children 29 grants account for the fiscal year beginning July 1, 2015, and 30 ending June 30, 2016, not more than $265,950 is allocated for 31 the early childhood Iowa office and other technical assistance 32 activities. Moneys allocated under this lettered paragraph 33 may be used by the early childhood Iowa state board for the 34 purpose of skills development and support for ongoing training 35 -6- LSB 2651XC (6) 86 kh/tm 6/ 77
S.F. _____ of staff. However, except as otherwise provided in this 1 subsection, moneys shall not be used for additional staff or 2 for the reimbursement of staff. 3 b. Of the amount appropriated in this subsection for 4 deposit in the school ready children grants account of the 5 early childhood Iowa fund, $2,318,018 shall be used for efforts 6 to improve the quality of early care, health, and education 7 programs. Moneys allocated pursuant to this paragraph may be 8 used for additional staff and for the reimbursement of staff. 9 The early childhood Iowa state board may reserve a portion 10 of the allocation, not to exceed $88,650, for the technical 11 assistance expenses of the early childhood Iowa state office, 12 including the reimbursement of staff, and shall distribute 13 the remainder to early childhood Iowa areas for local quality 14 improvement efforts through a methodology identified by the 15 early childhood Iowa state board to make the most productive 16 use of the funding, which may include use of the distribution 17 formula, grants, or other means. 18 c. Of the amount appropriated in this subsection for 19 deposit in the school ready children grants account of 20 the early childhood Iowa fund, $825,030 shall be used for 21 support of professional development and training activities 22 for persons working in early care, health, and education by 23 the early childhood Iowa state board in collaboration with 24 the professional development component groups maintained by 25 the early childhood Iowa stakeholders alliance pursuant to 26 section 256I.12, subsection 7, paragraph “b”, and the early 27 childhood Iowa area boards. Expenditures shall be limited to 28 professional development and training activities agreed upon by 29 the parties participating in the collaboration. 30 10. The moneys appropriated in this subsection shall be 21 used for implementation and expansion of early head start 22 pilot projects addressing the comprehensive cognitive, social, 23 emotional, and developmental needs of children from birth to 24 age three, including prenatal support for qualified families. 25 The projects shall promote healthy prenatal outcomes and 26 healthy family functioning, and strengthen the development of 27 infants and toddlers in low-income families. Priority shall be 28 given to those organizations that have previously qualified for 29 and received state funding to administer an early head start 30 project. 31 14. TEXTBOOKS OF NONPUBLIC SCHOOL PUPILS 32 a. A list of English language learner programs not developed 25 by the district that are being utilized by the school district 26 for limited English proficient students. 27 20. Programs awarded grants under this 20 subsection shall meet the national association for the 21 education of young children program standards and accreditation 22 criteria, the Iowa quality preschool program standards and 23 criteria, or other approved program standards as determined by 24 the department of education. 25 Sec. 12. Section 256I.4, subsection 5, Code 2015, is amended 26 to read as follows: 27 5. Adopt common performance measures and data reporting 28 requirements, applicable statewide, for services, programs, 29 and activities provided by area boards. The data from common 30 performance measures and other data shall be posted on the 31 early childhood Iowa internet site and disseminated by other 32 means and shall also be aggregated to provide statewide 33 information. Section 256I.4, Code 2015, is amended by adding the 6 following new subsection: 7 NEW SUBSECTION . 19. Direct staff to work with the early 8 childhood stakeholders alliance created in section 256I.12 to 9 inventory technical assistance needs. 10 Sec. 14. Section 256I.8, subsection 1, paragraph d, Code 11 2015, is amended to read as follows: 12 d. Submit an annual report on the effectiveness of the 13 community plan in addressing school readiness and children’s 14 health and safety needs to the state board and to the local 15 government bodies in the area. The annual report shall 16 indicate the effectiveness of the area board in addressing 17 state and locally determined goals and the progress on each 18 of the community-wide indicators identified by the area board 19 under paragraph “c” , subparagraph (5) . The report shall include 20 an annual budget developed for the following fiscal year for 21 the area’s comprehensive school ready children grant for 22 providing services for children from birth through five years 23 of age, and provide other information specified by the state 24 board, including budget amendments, as needed. In addition, 25 each area board must comply with reporting provisions and other 26 requirements adopted by the state board in implementing section 27 256I.9. 28 Sec. 15. Section 256I.11, subsection 2, Code 2015, is 29 amended to read as follows: 30 2. A school ready children grants account is created in 31 the fund under the authority of the director of the department 32 of education. Moneys credited to the account are appropriated 33 to and shall be distributed by the department in the form 34 of grants to early childhood Iowa areas pursuant to criteria 35 -22- LSB 2651XC (6) 86 kh/tm 22/ 77
S.F. _____ established by the state board in accordance with law. 1 a. Moneys appropriated for deposit in the school ready 2 children grants account for purposes of preschool tuition 3 assistance shall be used for early care, health, and education 4 programs to assist low-income parents with tuition for 5 preschool and other supportive services for children ages 6 three, four, and five who are not attending kindergarten 7 in order to increase the basic family income eligibility 8 requirement to not more than two hundred percent of the federal 9 poverty level. In addition, if sufficient funding is available 10 after addressing the needs of those who meet the basic income 11 eligibility requirement, an early childhood Iowa area board 12 may provide for eligibility for those with a family income in 13 excess of the basic income eligibility requirement through use 14 of a sliding scale or other copayment provisions. 15 b. Moneys appropriated for deposit in the school ready 16 children grants account for purposes of family support services 17 and parent education programs shall be targeted to families 18 expecting a child or with newborn and infant children through 19 age five and shall be distributed using the distribution 20 formula approved by the early childhood Iowa state board and 21 shall be used by an early childhood Iowa area board only for 22 family support services and parent education programs targeted 23 to families expecting a child or with newborn and infant 24 children through age five. 25 Sec. 16. Section 284.11, subsection 2, paragraph b, Code 26 2015, is amended to read as follows: 27 b. Develop a standardized process for distributing moneys 28 appropriated for supplemental assistance for high-need schools 29 under section 284.13, subsection 1 , paragraph “f” , to school 30 districts. In determining the process for distribution of such 31 moneys, the department shall take into consideration the amount 32 of moneys appropriated for supplemental assistance in high-need 33 schools for the given year and the minimal amount of moneys 34 needed to increase the academic achievement of students. S.F. _____ school district receiving moneys pursuant to this section shall 1 certify annually to the department how the moneys distributed 2 to the school district pursuant to this section were used by 3 the school district. 4 Sec. 17. Section 284.11, subsections 4 and 5, Code 2015, are 5 amended to read as follows: 6 4. Moneys received and miscellaneous income. The 7 distribution of moneys allocated pursuant to section 284.13, 8 subsection 1 , paragraph “f” , appropriated for purposes of this 9 section to a school district shall be made in one payment on or 10 about October 15 of the fiscal year for which the appropriation 11 is made, taking into consideration the relative budget and cash 12 position of the state resources. Such moneys shall not be 13 commingled with state aid payments made under section 257.16 14 to a school district and shall be accounted for by the local 15 school district separately from state aid payments. Payments 16 made to school districts under this section are miscellaneous 17 income for purposes of chapter 257 . A school district shall 18 maintain a separate listing within its budget for payments 19 received and expenditures made pursuant to this section . 20 5. Moneys received to supplement salaries. Moneys State 21 moneys received by a school district pursuant to section 22 284.13, subsection 1 , paragraph “f” , for purposes of this 23 section shall be used to supplement and not supplant the 24 salary being received by a teacher in a high-need school, and 25 shall not be considered under chapter 20 by an arbitrator or 26 other third party in determining a comparison of the wages of 27 teachers in that high-need school with the wages of teachers in 28 other buildings or in another school district. 29 Sec. 18. Section 284.13, subsection 1, paragraphs a, b, c, 30 and d, Code 2015, are amended to read as follows: 31 a. For the fiscal year beginning July 1, 2014 2015 , and 32 ending June 30, 2015 2016 , to the department of education, the 33 amount of eight hundred forty-six thousand two hundred fifty 34 dollars for the issuance of national board certification awards 35 -24- LSB 2651XC (6) 86 kh/tm 24/ 77
S.F. _____ in accordance with section 256.44 . Of the amount allocated 1 under this paragraph, not less than eighty-five thousand 2 dollars shall be used to administer the ambassador to education 3 position in accordance with section 256.45 . 4 b. For the fiscal year beginning July 1, 2014 2015 , 5 and ending June 30, 2015 2016 , an amount up to four three 6 million twenty-one two hundred twenty thousand eight hundred 7 seventy-five dollars for first-year and second-year beginning 8 teachers, to the department of education for distribution to 9 school districts and area education agencies for purposes 10 of the beginning teacher mentoring and induction programs. 11 A school district or area education agency shall receive 12 one thousand three hundred dollars per beginning teacher 13 participating in the program. If the funds appropriated for 14 the program are insufficient to pay mentors, school districts, 15 and area education agencies as provided in this paragraph, 16 the department shall prorate the amount distributed to 17 school districts and area education agencies based upon the 18 amount appropriated. Moneys received by a school district 19 or area education agency pursuant to this paragraph shall be 20 expended to provide each mentor with an award of five hundred 21 dollars per semester, at a minimum, for participation in 22 the school district’s or area education agency’s beginning 23 teacher mentoring and induction program; to implement the 24 plan; and to pay any applicable costs of the employer’s share 25 of contributions to federal social security and the Iowa 26 public employees’ retirement system or a pension and annuity 27 retirement system established under chapter 294 , for such 28 amounts paid by the district or area education agency. 29 c. For the fiscal year beginning July 1, 2014 2015 , and 30 ending June 30, 2015 2016 , up to seven hundred eighty-six 31 thousand eight hundred sixteen dollars to the department for 32 purposes of implementing the professional development program 33 requirements of section 284.6 , assistance in developing model 34 evidence for teacher quality committees established pursuant to 35 -25- LSB 2651XC (6) 86 kh/tm 25/ 77
S.F. _____ section 284.4, subsection 1 , paragraph “c” , and the evaluator 1 training program in section 284.10 . A portion of the funds 2 allocated to the department for purposes of this paragraph may 3 be used by the department for administrative purposes and for 4 not more than four full-time equivalent positions. 5 d. For the fiscal year beginning July 1, 2014 2015 , and 6 ending June 30, 2015 2016 , an amount up to one million one 7 hundred thirty-six thousand four hundred ten dollars to 8 the department for the establishment of teacher development 9 academies in accordance with section 284.6, subsection 10 . A 10 portion of the funds allocated to the department for purposes 11 of this paragraph may be used for administrative purposes. 12 Sec. 19. Section 284.13, subsection 1, paragraph e, 13 subparagraph (1), subparagraph divisions (a) and (b), Code 14 2015, are amended to read as follows: 15 (a) For the fiscal year beginning July 1, 2014, and ending 16 June 30, 2015, fifty million dollars. 17 (b) For the fiscal year beginning July 1, 2015, and ending 18 June 30, 2016, fifty forty-nine million six hundred fifty 19 thousand dollars. 20 Sec. 20. Section 284.13, subsection 1, paragraph e, 21 subparagraph (3), Code 2015, is amended to read as follows: 22 (3) Of the moneys allocated to the department for the 23 purposes of this paragraph “e” , for each fiscal year included 24 in subparagraph (1), not more than seven three hundred fifty 25 thousand dollars shall be used by the department for the 26 development of a delivery system, in collaboration with area 27 education agencies, to assist in implementing the career paths 28 and leadership roles considered pursuant to sections 284.15 , 29 284.16 , and 284.17 , including but not limited to planning 30 grants to school districts and area education agencies, 31 technical assistance for the department, technical assistance 32 for districts and area education agencies, training and staff 33 development, and the contracting of external expertise and 34 services. In using moneys allocated for purposes of this 35 -26- LSB 2651XC (6) 86 kh/tm 26/ 77
S.F. _____ subparagraph (3), the department shall give priority to school 1 districts with certified enrollments of fewer than six hundred 2 students. A portion of the moneys allocated annually to the 3 department for purposes of this subparagraph (3) may be used 4 by the department for administrative purposes and for not more 5 than five full-time equivalent positions. 6 Sec. 21. S.F. _____ (3) From the moneys appropriated in this lettered paragraph 1 “b”, not more than $1,467,000 shall be distributed as grants 2 to community colleges for the purpose of adult basic education 3 programs for students requiring instruction in English 4 as a second language. The department shall establish an 5 application process and criteria to award grants pursuant to 6 this subparagraph to community colleges. The criteria shall be 7 based on need for instruction in English as a second language 8 in the region served by each community college as determined by 9 factors including data from the latest federal decennial census 10 and outreach efforts to determine regional needs. 11 (4) From the moneys appropriated in this lettered paragraph 12 “b”, $210,000 shall be transferred to the department of human 13 services for purposes of administering a pilot project to 14 provide access to international resources to Iowans and new 15 Iowans to provide economic and leadership development resulting 16 in Iowa being a more inclusive and welcoming place to live, 17 work, and raise a family. The pilot project shall provide 18 supplemental support services for international refugees 19 to improve learning, literacy, cultural competencies, and 20 assimilation in 10 locations within a county with a population 21 over 350,000 as determined by the 2010 federal decennial 22 census. The department of human services shall utilize a 23 request for proposals process to identify the entity best 24 qualified to implement the pilot project. The request for 25 proposals shall specify that a qualified entity must be 26 utilizing more than 100 interpreters and translators fluent 27 in over 50 languages and dialects to help medical clinics, 28 government agencies, nonprofit organizations, businesses, 29 and individuals overcome language barriers so that limited 30 English proficient individuals can receive essential services; 31 working with the United States department of state, the United 32 States agency for international development, and a family 33 foundation center for international visitors that facilitates 34 visits from international leaders to build personal and lasting 35 -28- LSB 2651XC (6) 86 kh/tm 28/ 77

Notwithstanding section 8.33, moneys appropriated 16 in this section of this Act that remain unencumbered or 17 unobligated at the close of the fiscal year shall not revert 18 but shall remain available for expenditure for the purposes 19 designated until the close of the succeeding fiscal year. 20 DIVISION V 21 STATEWIDE PRESCHOOL PROGRAM COSTS 22 Sec. 33. Section 256C.3, subsection 3, paragraph h, Code 23 2015, is amended to read as follows: 24 h. Provision for ensuring that children receiving care from 25 other child care arrangements can participate in the preschool 26 program with minimal disruption due to transportation and 27 movement from one site to another. The children participating 28 in the preschool program may be transported by the school 29 district to activities associated with the program along with 30 other children. 31 Sec. 34. Section 256C.4, subsection 1, paragraphs g and h, 32 Code 2015, are amended to read as follows: 33 g. For the fiscal year beginning July 1, 2011 2014 , and each 34 succeeding fiscal year, of the amount of preschool foundation 35 -52- LSB 2651XC (6) 86 kh/tm 52/ 77
S.F. _____ aid received by a school district for a fiscal year in 1 accordance with section 257.16 , not more than five percent may 2 be used by the school district for administering the district’s 3 approved local program. Outreach activities and rent for 4 facilities not owned by the school district are permissive uses 5 of the administrative funds. 6 h. For the fiscal year beginning July 1, 2012 2014 , and 7 each succeeding fiscal year, of the amount of preschool 8 foundation aid received by a school district for a fiscal year 9 in accordance with section 257.16 , not less than ninety-five 10 percent of the per pupil amount shall be passed through to 11 a community-based provider for each pupil enrolled in the 12 district’s approved local program. For the fiscal year 13 beginning July 1, 2011 2014 , and each succeeding fiscal year, 14 not more than five ten percent of the amount of preschool 15 foundation aid passed through to a community-based provider 16 may be used by the community-based provider for administrative 17 costs. The costs of outreach activities and rent for 18 facilities not owned by the school district are permissive 19 administrative costs. The costs of transportation involving 20 children participating in the preschool program and other 21 children may be prorated. 22 Sec. 35. EFFECTIVE UPON ENACTMENT. This division of this 23 Act, being deemed of immediate importance, takes effect upon 24 enactment. 25 Sec. 36. RETROACTIVE APPLICABILITY. This division of this 26 Act applies retroactively to July 1, 2014. 27 DIVISION VI 28 STATEWIDE PRESCHOOL PROGRAM —— ADDITIONAL WEIGHTING FOR LIMITED 29 ENGLISH PROFICIENT 30 Sec. 37. Section 256C.5, subsection 1, Code 2015, is amended 31 by adding the following new paragraph: 32 NEW PARAGRAPH . 0d. “Preschool budget weighted enrollment” 33 means the sum of the preschool budget enrollment plus the 34 supplementary weighting received under section 280.4, 35 -53- LSB 2651XC (6) 86 kh/tm 53/ 77
S.F. _____ subsection 4. 1 Sec. 38. Section 256C.5, subsection 1, paragraph d, Code 2 2015, is amended to read as follows: 3 d. “Preschool foundation aid” means the product of the 4 regular program state cost per pupil for the budget year 5 multiplied by the school district’s preschool budget weighted 6 enrollment. 7 Sec. 39. Section 280.4, subsection 3, paragraph b, Code 8 2015, is amended to read as follows: 9 b. For students enrolled in kindergarten through grade 10 twelve who are first determined to be limited English 11 proficient for a budget year beginning on or after July 1, 12 2010, the additional weighting provided under paragraph “a” 13 shall be included in the weighted enrollment of the school 14 district of residence for a cumulative period of time not 15 exceeding five years beginning with the budget year for 16 which the student was first determined to be limited English 17 proficient. The five years of eligibility for the additional 18 weighting need not be consecutive , does not include additional 19 weighting received for all or part of a year under subsection 20 4, and a student’s eligibility for the additional weighting is 21 transferable to another district of residence. 22 Sec. 40. Section 280.4, Code 2015, is amended by adding the 23 following new subsection: 24 NEW SUBSECTION . 4. For a budget year beginning on or after 25 July 1, 2016, in order to provide funds for the excess costs of 26 instruction of limited English proficient students, eligible 27 students, as defined in section 256C.5, who are enrolled in 28 the statewide preschool program under chapter 256C and who 29 have been identified as limited English proficient shall be 30 assigned an additional weighting equivalent to one-half of the 31 additional weighting specified in subsection 3, paragraph “a” , 32 and that weighting shall be included in the preschool budget 33 weighted enrollment, as defined in section 256C.5, of the 34 school district of residence for the period of time the child 35 -54- LSB 2651XC (6) 86 kh/tm 54/ 77
S.F. _____ is an eligible student as defined in section 256C.5. 1 Sec. 41. APPLICABILITY. The sections of this division of 2 this Act apply to school budget years beginning on or after 3 July 1, 2016. 4 DIVISION VII 5 AT-RISK, ALTERNATIVE, AND DROPOUT PROGRAMS AND FUNDING 6 Sec. 42. Section 257.10, subsection 5, Code 2015, is amended 7 to read as follows: 8 5. Combined district cost per pupil. The combined district 9 cost per pupil for a school district is the sum of the regular 10 program district cost per pupil and the special education 11 support services district cost per pupil. Combined district 12 cost per pupil does not include a modified supplemental amount 13 added for school districts that have a negative balance of 14 funds raised for special education instruction programs, a 15 modified supplemental amount granted by the school budget 16 review committee for a single school year, or a modified 17 supplemental amount added for programs for dropout prevention 18 established pursuant to sections 257.38 through 257.41 . 19 Sec. 43. Section 257.11, subsection 4, paragraph a, Code 20 2015, is amended to read as follows: 21 a. In order to provide additional funding to school 22 districts for programs serving at-risk pupils , alternative 23 program and alternative school pupils in secondary schools, and 24 pupils identified as potential dropouts or returning dropouts 25 as defined in section 257.39, a supplementary weighting plan 26 for at-risk such pupils is adopted. A supplementary weighting 27 of forty-eight ten-thousandths per pupil shall be assigned 28 to the percentage of pupils in a school district enrolled in 29 grades one through six, as reported by the school district on 30 the basic educational data survey for the base year, who are 31 eligible for free and reduced price meals under the federal 32 National School Lunch Act and the federal Child Nutrition 33 Act of 1966, 42 U.S.C. §1751-1785, multiplied by the budget 34 enrollment in the school district; and a supplementary 35 -55- LSB 2651XC (6) 86 kh/tm 55/ 77
S.F. _____ weighting of one hundred fifty-six one-hundred-thousandths 1 per pupil shall be assigned to pupils included in the 2 budget enrollment of the school district. Amounts received 3 as supplementary weighting for at-risk pupils under this 4 subsection shall be utilized by a school district to develop 5 or maintain at-risk pupils’ programs, which may include 6 alternative programs and alternative school programs , and 7 returning dropout and dropout prevention programs approved 8 pursuant to section 257.40 . 9 Sec. 44. Section 257.11, subsection 4, Code 2015, is amended 10 by adding the following new paragraphs: 11 NEW PARAGRAPH . d. Up to five percent of the total amount 12 that a school district receives as supplementary weighting 13 pursuant to this subsection or as a modified supplemental 14 amount received under section 257.41, may be used in the budget 15 year for purposes of providing district-wide or building-wide 16 at-risk and dropout prevention programming targeted to pupils 17 who are not deemed at risk. 18 NEW PARAGRAPH . e. Notwithstanding paragraph “d” and section 19 282.24, if a pupil has been determined by the school district 20 to be likely to inflict self-harm or likely to harm another 21 pupil and all of the following apply, the school district may 22 use amounts received pursuant to paragraph “a” to pay the 23 instructional costs necessary to address the pupil’s behavior 24 during instructional time when those services are not otherwise 25 provided to pupils who do not require special education and the 26 costs exceed the costs of instruction of pupils in a regular 27 curriculum: 28 (1) The pupil does not require special education. 29 (2) The pupil is not in a court-ordered placement under 30 chapter 232 under the care and custody of the department of 31 human services or juvenile court services. 32 (3) The pupil is not in the state training school or the 33 Iowa juvenile home pursuant to a court order entered under 34 chapter 232 under the care and custody of the department of 35 -56- LSB 2651XC (6) 86 kh/tm 56/ 77

Boards of school districts, individually or jointly with 8 boards of other school districts, requesting to use a modified 9 supplemental amount for costs in excess of the amount received 10 under section 257.11, subsection 4, for programs for at-risk 11 students, secondary students who attend alternative programs 12 and alternative schools, and returning dropouts and dropout 13 prevention, shall submit comprehensive program plans for the 14 programs and budget costs, including annual requests for a 15 modified supplemental amount for funding the programs, to the 16 department of education as a component of the comprehensive 17 school improvement plan submitted to the department pursuant to 18 section 256.7, subsection 21 . The program plans shall include: 19 a. Program goals, objectives, and activities to meet 20 the needs of children who may drop out of school students 21 identified as at risk, secondary students who attend 22 alternative programs and alternative schools, or potential 23 dropouts or returning dropouts . 24 b. Student identification criteria and procedures. 25 c. Staff in-service education design. 26 d. Staff utilization plans. 27 e. Evaluation criteria and procedures and performance 28 measures. 29 f. Program budget. 30 g. Qualifications required of personnel delivering the 31 program. 32 h. A provision for dropout prevention and integration of 33 dropouts into the educational program of the district for 34 at-risk students . 35 -57- LSB 2651XC (6) 86 kh/tm 57/ 77
S.F. _____ i. A provision for identifying dropouts at-risk students . 1 j. A program for returning dropouts. 2 k. j. Other factors the department requires. 3 2. Program plans shall identify the parts of the plan that 4 will be implemented first upon approval of the request. If a 5 district is requesting to use a modified supplemental amount 6 to finance the program, the school district shall not identify 7 more than five percent of its budget enrollment for the budget 8 year as returning dropouts and potential dropouts. 9 Sec. 46. Section 257.40, Code 2015, is amended to read as 10 follows: 11 257.40 Approval of programs for at-risk pupils, alternative 12 programs and schools, and returning dropouts and dropout 13 prevention —— annual report . 14 1. The board of directors of a school district requesting 15 to use a modified supplemental amount for costs in excess of 16 the funding received under section 257.11, subsection 4, for 17 programs for at-risk students, secondary students who attend 18 alternative programs and alternative schools, or returning 19 dropouts and dropout prevention shall submit requests for a 20 modified at-risk supplemental amount, including budget costs, 21 to the department not later than December 15 of the year 22 preceding the budget year during which the program will be 23 offered. The department shall review the request and shall 24 prior to January 15 either grant approval for the request 25 or return the request for approval with comments of the 26 department included. An unapproved request for a program may 27 be resubmitted with modifications to the department not later 28 than February 1. Not later than February 15, the department 29 shall notify the department of management and the school budget 30 review committee of the names of the school districts for which 31 programs using a modified supplemental amount for funding have 32 been approved and the approved budget of each program listed 33 separately for each school district having an approved request. 34 2. Beginning January 15, 2007, the department shall submit 35 -58- LSB 2651XC (6) 86 kh/tm 58/ 77
S.F. _____ an annual report to the chairpersons and ranking members 1 of the senate and house education committees that includes 2 the ways school districts in the previous school year used 3 modified supplemental amounts approved under subsection 4 1 ; identifies, by grade level, age, and district size, the 5 students in the dropout and dropout prevention programs for 6 which the department approves a request; describes school 7 district progress toward increasing student achievement and 8 attendance for the students in the programs; and describes how 9 the school districts are using the revenues from the modified 10 supplemental amounts to improve student achievement among 11 minority subgroups. 12 Sec. 47. Section 257.41, subsections 1 and 2, Code 2015, are 13 amended to read as follows: 14 1. Budget. The budget of an approved program for at-risk 15 students, secondary students who attend alternative programs 16 or alternative schools, or returning dropouts and dropout 17 prevention for a school district, after subtracting funds 18 received under section 257.11, subsection 4, paragraphs “a” 19 through “c” , and from other sources for that purpose, including 20 any previous carryover, shall be funded annually on a basis 21 of one-fourth or more from the district cost of the school 22 district and up to three-fourths through establishment of a 23 modified supplemental amount. Annually, the department of 24 management shall establish a modified supplemental amount for 25 each such school district equal to the difference between the 26 approved budget for the program for returning dropouts and 27 dropout prevention for that district and the sum of the amount 28 funded from the district cost of the school district plus funds 29 received under section 257.11, subsection 4, and from other 30 sources for that purpose, including any previous carryover . 31 2. Appropriate uses of funding. Appropriate uses of the 32 returning dropout and dropout prevention program funding for an 33 approved program include but are not limited to the following: 34 a. Salary and benefits for instructional staff, 35 -59- LSB 2651XC (6) 86 kh/tm 59/ 77
S.F. _____ instructional support staff, and school-based youth services 1 staff who are working with students who are participating in 2 at-risk or dropout prevention programs, alternative programs, 3 and alternative schools, in a traditional or alternative 4 setting, if the staff person’s time is dedicated to working 5 with returning dropouts or such students who are deemed, at any 6 time during the school year, to be at risk of dropping out, 7 in order to provide services beyond those which are provided 8 by the school district to students who are not identified 9 as at risk of dropping out participating in such programs 10 or alternative schools . However, if the staff person works 11 part-time with students who are participating in returning 12 dropout and dropout prevention programs, alternative programs, 13 and alternative schools a program or alternative school and 14 the staff person has another unrelated staff assignment, 15 only the portion of the staff person’s time that is related 16 to the returning dropout and dropout prevention program , 17 alternative program, or alternative school may be charged to 18 the program or school . For purposes of this paragraph, if 19 an alternative setting is necessary to provide for a program 20 which is offered at a location off school grounds and which 21 is intended to serve student needs by improving relationships 22 and connections to school, decreasing truancy and tardiness, 23 providing opportunities for course credit recovery, or helping 24 students identified as at risk of dropping out to accelerate 25 through multiple grade levels of achievement within a shortened 26 time frame, the tuition costs for a student identified as at 27 risk of dropping out shall be considered an appropriate use of 28 the returning dropout and dropout prevention program funding 29 under this section . 30 b. Professional development for all teachers and staff 31 working with at-risk students and programs involving dropout 32 prevention strategies under a program or an alternative school 33 setting . 34 c. Research-based resources, materials, software, supplies, 35 -60- LSB 2651XC (6) 86 kh/tm 60/ 77
S.F. _____ and purchased services that meet all of the following criteria: 1 (1) Meets the needs of kindergarten through grade twelve 2 students identified as at risk of dropping out and of returning 3 dropouts . 4 (2) Are beyond those provided by the regular school program. 5 (3) Are necessary to provide the services listed in the 6 school district’s dropout prevention plan submitted pursuant 7 to section 257.38 . 8 (4) Will remain with the kindergarten through grade twelve 9 at-risk program, alternative program or alternative school, or 10 returning dropout and dropout prevention program. 11 d. Up to five percent of the total budgeted amount received 12 pursuant to subsection 1 may be used for purposes of providing 13 district-wide or building-wide returning dropout and dropout 14 prevention programming targeted to students who are not deemed 15 at risk of dropping out. 16 Sec. 48. Section 257.41, Code 2015, is amended by adding the 17 following new subsection: 18 NEW SUBSECTION . 4. Other uses. Notwithstanding subsection 19 2 and section 282.24, if a student has been determined by the 20 school district to be likely to inflict self-harm or likely to 21 harm another student and all of the following apply, the school 22 district may use the modified supplemental amount established 23 under subsection 1 to pay the instructional costs necessary to 24 address the student’s behavior during instructional time when 25 those services are not otherwise provided to students who do 26 not require special education and the costs exceed the costs of 27 instruction of students in a regular curriculum: 28 (1) The student does not require special education. 29 (2) The student is not in a court-ordered placement under 30 chapter 232 under the care and custody of the department of 31 human services or juvenile court services. 32 (3) The student is not in the state training school or the 33 Iowa juvenile home pursuant to a court order entered under 34 chapter 232 under the care and custody of the department of 35 -61- LSB 2651XC (6) 86 kh/tm 61/ 77
S.F. _____ human services. 1 (4) The pupil is not placed in a facility licensed under 2 chapter 135B, 135C, or 135H. 3 DIVISION VIII 4 SUPPLEMENTARY WEIGHTING FOR K-12 LIMITED ENGLISH PROFICIENT 5 STUDENTS 6 Sec. 49. Section 257.31, subsection 5, paragraph j, Code 7 2015, is amended to read as follows: 8 j. Unusual need to continue providing a program or other 9 special assistance to non-English speaking pupils after the 10 expiration of the five-year period of years specified in 11 section 280.4 . 12 Sec. 50. Section 280.4, subsection 3, Code 2015, is amended 13 to read as follows: 14 3. a. In order to provide funds for the excess costs of 15 instruction of limited English proficient students specified 16 in paragraph “b” above the costs of instruction of pupils in 17 a regular curriculum, students identified as limited English 18 proficient shall be assigned an additional weighting of 19 twenty-two hundredths, and that weighting shall be included in 20 the weighted enrollment of the school district of residence for 21 a period not exceeding five the period of years specified in 22 paragraph “b” . However, the school budget review committee may 23 grant supplemental aid or a modified supplemental amount to 24 a school district to continue funding a program for students 25 after the expiration of the five-year specified period of 26 years . 27 b. (1) For students first determined to be limited English 28 proficient for a budget year beginning on or after July 29 1, 2010, but before July 1, 2015, the additional weighting 30 provided under paragraph “a” shall be included in the weighted 31 enrollment of the school district of residence for a cumulative 32 period of time not exceeding five years beginning with the 33 budget year for which the student was first determined to be 34 limited English proficient. The five years of eligibility 35 -62- LSB 2651XC (6) 86 kh/tm 62/ 77
S.F. _____ for the additional weighting need not be consecutive and 1 a student’s eligibility for the additional weighting is 2 transferable to another district of residence. 3 (2) For students first determined to be limited English 4 proficient for the budget year beginning on July 1, 2015, the 5 additional weighting provided under paragraph “a” shall be 6 included in the weighted enrollment of the school district of 7 residence for a period not exceeding six years beginning with 8 the budget year for which the student was first determined to 9 be limited English proficient. 10 (3) For students first determined to be limited English 11 proficient for a budget year beginning on or after July 1, 12 2016, the additional weighting provided under paragraph “a” 13 shall be included in the weighted enrollment of the school 14 district of residence for a period not exceeding seven years 15 beginning with the budget year for which the student was first 16 determined to be limited English proficient. 17 Sec. 51. EFFECTIVE UPON ENACTMENT. This division of this 18 Act, being deemed of immediate importance, takes effect upon 19 enactment. 20 Sec. 52. APPLICABILITY. This division of this Act applies 21 to school budget years beginning on or after July 1, 2015. 22 DIVISION IX 23 GIFTED AND TALENTED PROGRAM —— STAFF 24 Sec. 53. Section 257.42, unnumbered paragraph 3, Code 2015, 25 is amended to read as follows: 26 The department shall employ a one full-time qualified staff 27 member or consultant for gifted and talented children programs. 28 DIVISION X 29 GAP TUITION ASSISTANCE PROGRAM —— ELIGIBILITY REQUIREMENTS 30 Sec. 54. Section 260I.3, subsection 2, Code 2015, is amended 31 to read as follows: 32 2. a. Eligibility for tuition assistance under this chapter 33 shall be based on financial need. Criteria to be assessed in 34 determining financial need shall include but is not limited to: 35 -63- LSB 2651XC (6) 86 kh/tm 63/ 77
S.F. _____ a. (1) The applicant’s family income for the twelve six 1 months prior to the date of application. 2 b. (2) The applicant’s family size. 3 c. (3) The applicant’s county of residence. 4 b. An applicant approved for assistance under the 5 supplemental nutrition assistance program at the time of 6 application for assistance under this chapter shall be 7 deemed to have met the financial need requirements under this 8 subsection. 9 Sec. 55. Section 260I.4, Code 2015, is amended by adding the 10 following new subsections: 11 NEW SUBSECTION . 7. Persons earning incomes between 12 one hundred fifty percent and two hundred fifty percent, 13 both percentages inclusive, of the federal poverty level as 14 defined by the most recently revised poverty income guidelines 15 published by the United States department of health and human 16 services shall be given first priority for tuition assistance 17 under this chapter. Persons earning incomes below one hundred 18 fifty percent of the federal poverty level shall be given 19 second priority for tuition assistance under this chapter. 20 NEW SUBSECTION . 8. A person who is eligible for financial 21 assistance pursuant to the federal Workforce Investment Act of 22 1998, Pub. L. No. 105-220, or the federal Workforce Innovation 23 and Opportunity Act, Pub. L. No. 113-128, shall be ineligible 24 for tuition assistance under this chapter unless such funds 25 budgeted for training assistance for the adult, dislocated 26 worker, or youth programs have been fully expended by a 27 workforce region. 28 DIVISION XI 29 IOWA TUITION GRANT —— AMOUNT 30 Sec. 56. Section 261.12, subsection 1, paragraph b, Code 31 2015, is amended to read as follows: 32 b. For the fiscal year beginning July 1, 2013 2015 , and 33 for each following succeeding fiscal year, five thousand five 34 hundred dollars. 35 -64- LSB 2651XC (6) 86 kh/tm 64/ 77
S.F. _____ DIVISION XII 1 ALL IOWA OPPORTUNITY SCHOLARSHIP PROGRAM 2 Sec. 57. Section 261.87, subsection 3, Code 2015, is amended 3 by striking the subsection and inserting in lieu thereof the 4 following: 5 3. Extent of scholarship. A qualified student at an 6 eligible institution may receive scholarships for not more than 7 the equivalent of two full-time academic years of undergraduate 8 study, excluding summer semesters, or the equivalent. 9 Scholarships awarded pursuant to this section shall be awarded 10 on an annual basis and shall not exceed the lesser of the 11 following, as determined by the commission: 12 a. The student’s financial need. 13 b. One-half of the average resident tuition rate and 14 mandatory fees established for institutions of higher learning 15 governed by the state board of regents. 16 c. The resident tuition and mandatory fees charged for the 17 program of enrollment by the eligible institution at which the 18 student is enrolled. 19 DIVISION XIII 20 SCHOOL BOARD VACANCIES 21 Sec. 58. Section 279.6, Code 2015, is amended to read as 22 follows: 23 279.6 Vacancies —— qualification —— tenure. 24 1. a. Vacancies Except as provided in paragraph “b” and 25 subsection 2, vacancies occurring among the officers or members 26 of a school board shall be filled by the board by appointment. 27 A person so appointed to fill a vacancy in an elective office 28 shall hold office until a successor is elected and qualified 29 pursuant to section 69.12 . To fill a vacancy occurring among 30 the members of a school board, the board shall publish notice 31 in the manner prescribed by section 279.36, stating that the 32 board intends to fill the vacancy by appointment but that 33 the electors of the school district have the right to file 34 a petition requiring that the vacancy be filled by a special 35 -65- LSB 2651XC (6) 86 kh/tm 65/ 77
S.F. _____ election conducted pursuant to section 279.7. The board may 1 publish notice in advance if a member of the board submits a 2 resignation to take effect at a future date. The board may 3 make an appointment to fill the vacancy after the notice is 4 published or after the vacancy occurs, whichever is later. 5 b. (1) If within fourteen days after publication of a 6 notice required pursuant to paragraph “a” for a vacancy that 7 occurs more than one hundred eighty days before the next 8 regular school election, or within fourteen days after the 9 appointment is made, there is filed with the secretary of the 10 school board a petition requesting a special election to fill 11 the vacancy, an appointment to fill the vacancy is temporary 12 and the board shall call a special election pursuant to section 13 279.7, to fill the vacancy for the remaining balance of the 14 unexpired term. 15 (2) If within fourteen days after publication of a notice 16 required pursuant to paragraph “a” for a vacancy that occurs 17 one hundred eighty days or less before the next regular school 18 election, or within fourteen days after the appointment is 19 made, there is filed with the secretary of the school board 20 a petition requesting to fill the vacancy by election, an 21 appointment to fill the vacancy is temporary and the school 22 board shall require that the remaining balance of the unexpired 23 term be filled at the next regular school election. 24 (3) For a petition to be valid under this paragraph “b” , the 25 petition must be signed by eligible electors equal in number 26 to not less than one hundred or thirty percent of the number of 27 voters at the last preceding regular school election, whichever 28 is greater. 29 (4) Notwithstanding any requirement of this paragraph to 30 the contrary, when the board is reduced below a quorum, the 31 secretary of the board, or if there is no secretary, the area 32 education agency administrator, shall call a special election 33 in the district, subdistrict, or subdistricts, as the case may 34 be, to fill the vacancies. 35 -66- LSB 2651XC (6) 86 kh/tm 66/ 77
S.F. _____ c. A person appointed to fill a vacancy in an appointive 1 office shall hold such office for the residue of the unexpired 2 term and until a successor is appointed and qualified. Any 3 person so appointed shall qualify within ten days thereafter in 4 the manner required by section 277.28 . 5 2. A vacancy shall be filled at the next regular school 6 election if a member of a school board resigns from the board 7 not later than forty-five days before the election and the 8 notice of resignation specifies an effective date at the 9 beginning of the next term of office for elective school 10 officials. The president of the board shall declare the office 11 vacant as of the date of the next organizational meeting. 12 Nomination papers shall be received for the unexpired term of 13 the resigning member. The person elected at the next regular 14 school election to fill the vacancy shall take office at the 15 same time and place as the other elected school board members. 16 Sec. 59. Section 279.7, subsection 1, Code 2015, is amended 17 to read as follows: 18 1. If a vacancy or vacancies occur among the elective 19 officers or members of a school board and the remaining 20 members of the board have not filled the vacancy within thirty 21 days after the vacancy becomes known by the secretary or the 22 board or if a valid petition is submitted to the secretary 23 of the board pursuant to section 279.6, subsection 1 , or 24 when the board is reduced below a quorum, the secretary of 25 the board, or if there is no secretary, the area education 26 agency administrator, shall call a special election in the 27 district, subdistrict, or subdistricts, as the case may be, 28 to fill the vacancy or vacancies. The county commissioner of 29 elections shall publish the notices required by law for special 30 elections, and the election shall be held not sooner than 31 thirty days nor later than forty days after the thirtieth day 32 following the day the vacancy becomes known by the secretary or 33 the board. If the secretary fails for more than three days to 34 call an election, the administrator shall call it. 35 -67- LSB 2651XC (6) 86 kh/tm 67/ 77
S.F. _____ EXPLANATION 1 The inclusion of this explanation does not constitute agreement with 2 the explanation’s substance by the members of the general assembly. 3 This bill appropriates moneys for fiscal years 2015-2016 and 4 2016-2017 from the general fund of the state to the college 5 student aid commission, the department for the blind, the 6 department of education, and the state board of regents and its 7 institutions. 8 DIVISION I —— FY 2015-2016. The bill appropriates to the 9 department for the blind for its administration. 10 The bill includes appropriations to the college student 11 aid commission for general administrative purposes, student 12 aid programs, the loan repayment program for health care 13 professionals, the national guard educational assistance 14 program, the teacher shortage loan forgiveness program, the all 15 Iowa opportunity foster care grant and scholarship programs, 16 the registered nurse and nurse educator loan forgiveness 17 program, the barber and cosmetology arts and sciences tuition 18 grant program, the teach Iowa scholar program, the rural 19 Iowa primary care loan repayment program, and the rural Iowa 20 advanced registered nurse practitioner and physician assistant 21 loan repayment program. 22 The bill modifies the standing appropriations for Iowa 23 tuition grants for students attending nonprofit and for-profit 24 institutions. The bill notwithstands the $2.75 million 25 standing appropriation for the Iowa work-study program and 26 provides that the amount appropriated for fiscal year 2015-2016 27 is zero. 28 The bill appropriates moneys to the department of education 29 for purposes of the department’s general administration, 30 vocational education administration, division of vocational 31 rehabilitation services including independent living programs, 32 the entrepreneurs with disabilities program, and independent 33 living centers, state library for general administration 34 and the enrich Iowa program, public broadcasting division, 35 -68- LSB 2651XC (6) 86 kh/tm 68/ 77
S.F. _____ regional telecommunications councils, vocational education to 1 secondary schools, school food service, early childhood Iowa 2 fund, expansion of the federal Individuals with Disabilities 3 Education Improvement Act birth through age three services, 4 early head start projects, textbooks for nonpublic school 5 pupils, the student achievement and teacher quality program, 6 jobs for America’s graduates specialists, attendance center 7 performance assessment, the beginning administrator mentoring 8 and induction program, the English language literacy for all 9 grant program, the online state job posting system, support 10 for education task forces, commissions, and councils, area 11 education agency support system, successful progression for 12 early readers, early warning system for literacy, Iowa reading 13 research center, implementation of competency-based education 14 recommendations, state supplemental assistance for high-need 15 schools, Iowa academic standards, four-year career planning 16 system for grades 9-12, distribution to the midwestern higher 17 education compact to pay Iowa’s member state annual obligation, 18 area education agencies, and community colleges. 19 The bill requests the legislative council to establish a 20 school funding inequities interim study committee in 2015. 21 The bill provides that programs awarded grants by the child 22 development coordinating council to provide new or additional 23 child development services to at-risk children must meet the 24 national association for the education of young children 25 program standards and accreditation, the Iowa preschool program 26 standards and criteria, or other approved program standards, as 27 determined by the department of education. 28 The bill codifies in Code chapter 256I session law from 29 education appropriations enacted in recent years relating to 30 the duties of the early childhood Iowa state board and area 31 boards. 32 Statutory provisions under the student achievement and 33 teacher quality program allocations for national board 34 certification, beginning teacher mentoring and induction, 35 -69- LSB 2651XC (6) 86 kh/tm 69/ 77
S.F. _____ professional development program, teacher quality committees, 1 evaluator training, teacher development academies, and teacher 2 leadership supplemental aid payments, and a teacher leadership 3 delivery system are modified and the program allocation for 4 high-needs schools, and related references, are eliminated. 5 The bill appropriates moneys to the state board of regents 6 for the board office, universities’ general operating budgets; 7 the southwest Iowa regents resource center; the northwest Iowa 8 regents resource center; the quad-cities graduate studies 9 center; Iowa public radio; the state university of Iowa; Iowa 10 state university of science and technology; the university of 11 northern Iowa; and for the Iowa school for the deaf and the 12 Iowa braille and sight saving school, including tuition and 13 transportation costs for students residing in the schools and 14 licensed classroom teachers. 15 The bill allows the state board of regents to use 16 indebtedness to finance certain projects resulting in energy 17 savings. 18 The bill also requires the department of administrative 19 services to pay the state school for the deaf and the Iowa 20 braille and sight saving school moneys collected from counties 21 for expenses related to prescription drug costs for students 22 attending the schools. 23 DIVISION II —— WORKFORCE TRAINING PROGRAMS —— APPROPRIATIONS 24 FY 2015-2016. The bill appropriates moneys from the Iowa 25 skilled worker and job creation fund to the department of 26 education and the college student aid commission. 27 DIVISION III —— FY 2016-2017. Division II appropriates 28 moneys from the general fund of the state to the department 29 for the blind, the college student aid commission, the 30 department of education, and the state board of regents and the 31 institutions it governs, at generally 50 percent of the amounts 32 appropriated for the same purposes for the prior fiscal year. 33 DIVISION IV —— WORKFORCE TRAINING PROGRAMS —— APPROPRIATIONS 34 FY 2016-2017. The bill appropriates moneys from the Iowa 35 -70- LSB 2651XC (6) 86 kh/tm 70/ 77
S.F. _____ skilled worker and job creation fund to the department of 1 education and the college student aid commission at generally 2 50 percent of the amounts appropriated for the same purposes 3 for the prior fiscal year. 4 DIVISION V —— STATEWIDE PRESCHOOL PROGRAM COSTS. The bill 5 authorizes children participating in the preschool program to 6 be transported by the school district to activities associated 7 with the program along with other children. The bill specifies 8 that for community-based providers the costs of transportation 9 involving children participating in the preschool program and 10 other children may be prorated. 11 Under current law, a community provider under the 12 program is authorized to use not more than 5 percent of the 13 preschool foundation aid passed through to the provider for 14 administrative costs. The bill increases that amount to 10 15 percent. 16 The bill also provides that the costs of outreach activities 17 and rent for facilities not owned by the school district are 18 considered permissive use of administrative funds. 19 This division of the bill takes effect upon enactment and 20 applies retroactively to July 1, 2014. 21 DIVISION VI —— STATEWIDE PRESCHOOL PROGRAM —— ADDITIONAL 22 WEIGHTING FOR LIMITED ENGLISH PROFICIENT. The bill provides 23 for additional weighting, beginning with the 2016-2017 school 24 year, for students who are enrolled in the statewide preschool 25 program for four-year-old children if they are identified as 26 limited English proficient. The additional weighting shall 27 be equivalent to one-half the amount assigned to students in 28 kindergarten through grade 12 (K-12) who are identified as 29 limited English proficient. Currently, such K-12 students 30 are assigned additional weighting of twenty-two hundredths. 31 The additional weighting shall be included in the preschool 32 budget weighted enrollment, as defined in the bill, of the 33 school district of residence for the budget year for which 34 the eligible student is determined to be limited English 35 -71- LSB 2651XC (6) 86 kh/tm 71/ 77

The years of limited English proficiency weighting 1 received under current law for students in K-12 do not include 2 the year of limited English proficiency weighting received for 3 an eligible student enrolled in the statewide preschool program 4 for four-year-old children. 5 This division of this Act applies to school budget years 6 beginning on or after July 1, 2016. 7 DIVISION VII —— AT-RISK, ALTERNATIVE, AND DROPOUT PROGRAMS 8 AND FUNDING. The bill makes changes relating to at-risk 9 programs, alternative programs and alternative schools, and 10 returning dropout and dropout prevention programs and funding 11 for the schools and programs. 12 The bill modifies a provision that establishes supplementary 13 weighting for programs serving at-risk pupils and alternative 14 school pupils in secondary schools to add alternative programs 15 for secondary school pupils and programs for returning dropouts 16 and dropout prevention. 17 The bill authorizes a school district to use, in the budget 18 year, up to 5 percent of the total supplementary weighting 19 amounts received pursuant to Code section 257.11, subsection 4, 20 or up to 5 percent of a modified supplemental amount received 21 pursuant to Code section 257.41 for at-risk pupils, alternative 22 program and alternative school pupils, or pupils in returning 23 dropout and dropout prevention programs, for purposes of 24 providing district-wide or building-wide at-risk and dropout 25 prevention programming targeted to students who are not deemed 26 at risk. 27 The bill strikes a provision that allows a school district 28 to use up to 5 percent of its total budgeted amount received 29 for an approved program for returning dropouts and dropout 30 prevention to be used for purposes of providing district-wide 31 or building-wide returning dropout and dropout prevention 32 programming targeted to students who are not deemed at risk of 33 dropping out. 34 The bill provides that when a student who does not require 35 -72- LSB 2651XC (6) 86 kh/tm 72/ 77
S.F. _____ special education and who is not in a court-ordered placement 1 under the care and custody of the department of human services 2 or juvenile court services and who is not in the state training 3 school or the Iowa juvenile home and who is not placed in 4 a hospital, health care facility, or psychiatric medical 5 institution for children and who has been determined by the 6 school district to be likely to inflict self-harm or likely 7 to harm another student, the school district may use the 8 supplementary weighting amounts and the modified supplemental 9 amounts received for at-risk, alternative program and school, 10 or returning dropout and dropout prevention programs to pay the 11 instructional costs necessary to address the student’s behavior 12 during instructional time when those services are not otherwise 13 provided to students who do not require special education 14 and the costs exceed the costs of instruction of pupils in a 15 regular curriculum. 16 The modified supplemental amount which a school district 17 may request must be for costs in excess of the supplementary 18 weighting amounts received by the school district for at-risk 19 students, alternative program and school students, and 20 potential or returning dropouts. 21 The bill makes conforming changes relating to the submission 22 of comprehensive program plans to the department of education 23 by school districts requesting to use a modified supplemental 24 amount for costs in excess of the supplementary weighting 25 received for at-risk, alternative school, and returning 26 dropouts and dropout prevention; and relating to budgets for 27 programs funded with modified supplemental amounts and to 28 allowable uses of program funding. 29 The bill strikes a provision requiring the department to 30 submit an annual report to the general assembly describing the 31 ways school districts used modified supplemental amounts for 32 returning dropout and dropout prevention programs in the prior 33 school year. 34 DIVISION VIII —— SUPPLEMENTARY WEIGHTING FOR K-12 LIMITED 35 -73- LSB 2651XC (6) 86 kh/tm 73/ 77
S.F. _____ ENGLISH PROFICIENT STUDENTS. The bill relates to limited 1 English proficient education by modifying the supplementary 2 weighting for limited English proficient students. 3 Current Code section 280.4 provides supplementary weighting 4 for the excess costs of instruction of limited English 5 proficient students. The current amount of the supplementary 6 weighting for students identified as limited English proficient 7 is 0.22 per student. The weighting is provided for those 8 students first determined to be limited English proficient for 9 a budget year beginning on or after July 1, 2010, and may be 10 included in the weighted enrollment of the school district for 11 a period not exceeding five years. 12 The bill also specifies the number of years during which the 13 additional weighting may be included in the school district’s 14 weighted enrollment. For students first determined to be 15 limited English proficient for a budget year beginning on or 16 after July 1, 2010, but before July 1, 2015, the additional 17 weighting may be included for a period not exceeding five 18 years. For students first determined to be limited English 19 proficient for the budget year beginning on July 1, 2015, the 20 additional weighting may be included for a period not exceeding 21 six years. For students first determined to be limited English 22 proficient for a budget year beginning on or after July 1, 23 2016, the additional weighting may be included for a period not 24 exceeding seven years. 25 The division takes effect upon enactment and applies to 26 school budget years beginning on or after July 1, 2015. 27 DIVISION IX —— GIFTED AND TALENTED PROGRAM —— STAFF. The 28 bill codifies a requirement that the department of education 29 employ one full-time qualified staff member or consultant for 30 gifted and talented children programs. The department is 31 currently required to employ a consultant for talented and 32 gifted children programs. 33 DIVISION X —— GAP TUITION ASSISTANCE PROGRAM —— ELIGIBILITY 34 REQUIREMENTS. The bill relates to eligibility requirements 35 -74- LSB 2651XC (6) 86 kh/tm 74/ 77
S.F. _____ for the gap tuition assistance program, which provides funding 1 to community colleges for need-based tuition assistance 2 to applicants to enable completion of continuing education 3 certificate training programs for in-demand occupations. 4 The bill changes one of the financial need criteria for the 5 program to the applicant’s family income for the six months 6 prior to the date of application. Currently, the period for 7 the criterion is 12 months. 8 The bill provides that an applicant approved for assistance 9 under the federal supplemental nutrition assistance program 10 at the time of application for tuition assistance shall be 11 deemed to have met the financial need requirements for tuition 12 assistance. 13 Eligibility for tuition assistance is currently limited to 14 persons earning incomes at or below 250 percent of the federal 15 poverty level as defined by the most recently revised poverty 16 income guidelines published by the United States department 17 of health and human services. The bill provides that persons 18 earning incomes between 150 percent and 250 percent, both 19 percentages inclusive, of the federal poverty level shall be 20 given first priority for tuition assistance. The bill provides 21 that persons earning incomes below 150 percent of the federal 22 poverty level shall be given second priority for tuition 23 assistance. 24 The bill also provides that a person who is eligible 25 for financial assistance pursuant to the federal Workforce 26 Investment Act of 1998 or the federal Workforce Innovation and 27 Opportunity Act shall be ineligible for tuition assistance 28 unless such funds budgeted for training assistance for the 29 adult, dislocated worker, or youth programs have been fully 30 expended by a workforce region. 31 DIVISION XI —— IOWA TUITION GRANT —— AMOUNT. The bill 32 increases the amount of an annual Iowa tuition grant to a 33 qualified full-time student enrolled in an accredited private 34 postsecondary educational institution from $5,000 to $5,500. 35 -75- LSB 2651XC (6) 86 kh/tm 75/ 77
S.F. _____ DIVISION XII —— ALL IOWA OPPORTUNITY SCHOLARSHIP PROGRAM. 1 The bill amends statute to authorize a qualified student at 2 an eligible institution, which is defined in the Code as a 3 community college or regents university, to receive an all 4 Iowa opportunity scholarship for not more than two full-time 5 academic years of undergraduate study, excluding summer 6 semesters. The scholarship must be awarded by the college 7 student aid commission to the student on an annual basis. 8 Under current law, a qualified student who receives the 9 scholarship must each year meet the eligibility requirements 10 established in the Code. 11 DIVISION XIII —— SCHOOL BOARD VACANCIES. The bill requires 12 that a school board publish notice of the intent of the board 13 to fill a vacancy among the members of a school board by 14 appointment, but the electors of the school district have the 15 right to file a petition requiring that the vacancy be filled 16 by a special election. The bill allows the board to publish 17 the notice in advance of a vacancy if the officer or member 18 of the board submits a resignation that will take effect at a 19 future date. The bill allows the board to make an appointment 20 after the notice is published or after the vacancy occurs, 21 whichever is later. The bill provides that the appointment 22 is considered temporary if a valid petition to call a special 23 election is filed with the secretary of the school board within 24 14 days after publication of the notice or within 14 days after 25 the appointment is made. 26 The bill provides that a valid petition must be signed by 27 at least 100 eligible electors or eligible electors equaling 28 at least 30 percent of the number of voters at the preceding 29 regular school election, whichever is greater. 30 The bill requires that a special election be called by the 31 school board upon the filing of a valid petition for a vacancy 32 that occurs more than 180 days before the next regular school 33 election. The special election shall be held in accordance 34 with requirements under current law for filling school district 35 -76- LSB 2651XC (6) 86 kh/tm 76/ 77
S.F. _____ board vacancies. The bill requires that a school district 1 fill such a vacancy at the next regular school election if a 2 valid petition is filed for a vacancy that occurs 180 days or 3 less before the next regular school election.
