S.F. _____ Section 1. Section 572.34, subsection 3, Code 2015, is 1 amended to read as follows: 2 3. The registry administrator shall be indexed index the 3 registry by owner name, general contractor name, mechanics’ 4 notice and lien registry number, property address, legal 5 description, tax parcel identification number, and any 6 other identifier considered appropriate as determined by 7 the administrator pursuant to rule. To the extent a legal 8 description conflicts with a property address, tax parcel 9 identification number, or any other identifier considered 10 appropriate by the administrator, the legal description shall 11 define the land to which the lien is attached. 12 EXPLANATION 13 The inclusion of this explanation does not constitute agreement with 14 the explanation’s substance by the members of the general assembly. 15 This bill relates to the mechanics’ notice and lien 16 registry. 17 Under current law, a mechanics’ notice and lien registry 18 exists which is an internet database that provides a central 19 repository for the submission and management of preliminary 20 notices, notices of commencement of work on residential 21 construction properties, and mechanics’ liens on all 22 construction properties. The registry is administered by the 23 secretary of state. 24 The bill provides that if a legal description conflicts with 25 a property address, tax parcel identification number, or any 26 other identifier considered appropriate by the administrator, 27 the legal description shall define the land to which the lien 28 is attached. 29 -1- LSB 2332XC (2) 86 jh/rj 1/ 1
