Section
1.
Section
123.50,
Code
2015,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
1A.
The
administrator
shall
assess
a
civil
3
penalty
in
the
amount
of
one
hundred
dollars
for
any
licensee,
4
wine
permittee,
or
beer
permittee
found
in
violation
of
section
5
123.152.

Sec.
2.
NEW
SECTION
.
123.152
Posting
notice
on
effects
of
7
alcohol
during
pregnancy
required.

A
holder
of
a
liquor
control
license,
wine
permit,
or
9
beer
permit
shall
post
in
a
prominent
place
on
the
licensed
10
premises
a
notice,
provided
by
the
division,
warning
of
the
11
danger
of
birth
defects
which
may
be
caused
as
a
result
of
the
12
consumption
of
alcohol
during
pregnancy.
The
size,
print
size,
13
location,
and
content
of
the
notice
shall
be
established
by
14
rule
of
the
division.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
17
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
holders
of
liquor
control
licenses,
wine
19
permits,
or
beer
permits
to
post
a
notice
on
the
licensed
20
premises
warning
of
the
danger
of
birth
defects
which
may
21
be
caused
as
a
result
of
the
consumption
of
alcohol
during
22
pregnancy.
The
bill
requires
the
alcoholic
beverages
division
23
to
provide
the
notice
and
to
adopt
rules
governing
the
size,
24
location,
and
content
of
the
notice.
25
Code
section
123.50,
concerning
civil
and
criminal
26
penalties,
is
amended
to
provide
that
a
violation
of
this
new
27
provision
by
any
licensee
or
beer
or
wine
permittee
shall
be
28
subject
to
a
civil
penalty
of
$100.
