S.F. _____ Section 1. Section 702.17, subsection 3, Code 2015, is 1 amended to read as follows: 2 3. Contact between the finger or hand of one person and 3 the genitalia , breast, or anus of another person, except in 4 the course of examination or treatment by a person licensed 5 pursuant to chapter 148 , 148C , 151 , or 152 . 6 EXPLANATION 7 The inclusion of this explanation does not constitute agreement with 8 the explanation’s substance by the members of the general assembly. 9 This bill relates to the definition of “sex act” and “sexual 10 activity”. 11 Under the bill, the term “sex act” and “sexual activity” 12 includes any sexual contact by a finger or hand of one person 13 and the breast of another person except during the course of a 14 legitimate medical examination. 15 The bill, by expanding the definition of “sex act” and 16 “sexual activity”, also expands the definition of numerous 17 criminal offenses, including but not limited to sexual 18 abuse (Code chapter 709), lascivious acts with a child (Code 19 section 709.8), indecent exposure (Code section 709.9), sexual 20 exploitation by a counselor, therapist, or school employee 21 (Code section 709.15), sexual misconduct with offenders or 22 juveniles (Code section 709.16), sexual abuse of a corpse 23 (Code section 709.18), enticing a minor (Code section 710.10), 24 and solicitation of commercial sexual activity (Code section 25 710A.2A). 26 -1- LSB 1816SC (2) 86 jm/nh 1/ 1
